ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held November 26,2001.
ORDINANCE NO. 1838
AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN
ORDINANCE NO. 1634; BY AMENDING THE COMPREHENSIVE PLAN
MAP FOR PROPERTIES LOCATED EAST OF PALMER AVENUE,
NORTH OF MILE HILL DRIVE AND SOUTH OF HORSTMAN ROAD.
Copies of Ordinance No. 1838 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days afler publication, copies of Ordinance No. 1838 will be
provided at a nominal charge.

WHEREAS, the City Council of the City of Port Orchard has initiated a Comprehensive Plan
& Zoning Map Amendment, CA-09-01, requesting designation of recently annexed properties described
herein, and all legal requirements have been performed; and
WHEREAS, the intent of this Comprehensive Plan Map Amendment is to provide a
Comprehensive Plan and Zoning Map Designation which most closely reflects the designation for the subject
properties prior to annexation; and
WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least evely five years
take action to review and, if needed, revise its Comprehensive Plan; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and
procedures of the Growth Management Act; and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of
the City of Port Orchard their findings and conclusions as stated in Resolution 323-01, that the
Comprehensive Plan Map be amended for the reasons stated therein;
WHEREAS, the proposed Comprehensive Plan Map Amendment CA-09-01 is found to be
consistent with the goals of the community, adopted Comprehensive Plan, and general requirements of the
Growth Management Act (RCW 36.70A); now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS That the City Council does hereby adopt Planning Commission
Resolution No 323-01, Attachment "A", with findings and conclusion, as it's own and does hereby designate
certain properties on the Comprehensive Plan Map as "Medium Density Residential"; as illustrated on
Attachment '6; and, to be reflected as "R8- Residential" on the Cityk Official Zoning Map as illustrated on
Attachment "B.
PASSED by the City Council of the City of Port Orchard, signed by the Mayor and attested
by the City Clerk in authentication of such passage this 26Ih day of Novembfl001.

PLANNING COMMISSION
RESOLUTION 32361
A RESOLUTION OF THE CITY OF PORT ORCHARD PLANNING
COMMISSION RECOMMENDING THE APPROVAL OF A
LAND RECENTLY ANNEXED INTO PORT ORCHARD FROM URBAN
LOW (KITSAP COUNTY), TO MEDIUM DENSITY RESIDENTIAL, AND
TO APPLY CORRESPONDING ZONING DESIGNATION OF R8;
IS COMMONLY KNOWN AS THE "WILEY ANNEXATION" COMPRISED
OF 11.80 CRES OF LAND EAST OF PALMER AVENUE, NORTH OF
MILE HILL DRIVE AND SOUTH OF HORSTMAN ROAD.
WHEREAS, the Planning Commission held a Public Meeting for the Comprehensive Plan
WHEREAS, the intent of this Comprehensive Plan Map Amendment is to provide a
Comprehensive Plan Designation which most closely reflects the current zoning designation for the
subject properties; and
WHEREAS, the City of port Orchard is following State Law RCW 36.70A.130 which
dictates that cities shall at least every five years take action to review and, if needed, revise its
Comprehensive Plan; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies,
and procedures of the Growth Management Act; and,
WE THEREFORE FIND that the Comprehensive Plan Amendment, CA-09-01, is not
detrimental to the health, safety, and welfare of the community and is proposed to be within the character
of the Growth Management Act, Comprehensive Plan, and the community.
CONCLUSION: Based upon the facts, testimony, and the materials presented at the
Meeting, we therefore conclude that the Comprehensive Plan Amendment, CA-09-01, is consistent with
the health, safely, and welfare of the City of Port Orchard.
BE IT RESOLVED that the Planning Commission of the City of PortOrchard does hereby
respectfully request that the City Council approve the Comprehensive Plan Amendment, CA-09-01 to re-
designate land recently annexed into Port Orchard from Urban Low (Kitsap County), to Medium Density
Residential, and to apply corresponding zoning designation of R8; Residential 8.0 unitdnet useable acre.
