07/10/1995 - Regular - MinutesPort Orchard, Washington July 10, 1995 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 PM at City Hall, 216 Prospect Street. Councilmembers present: Morrison, Geiger, Powers, and Grable. Councilmembers Van Zee, Childress and Clauson excused. Staff present: Police Chief Mathews, Deputy Clerk Hager, City Planner Brown, City Engineer Curles, Fire Chief Snow, City Clerk Parks and City Attorney David Weibel. Councilman Grable led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. Warren Adams, 2250 South Flower, Morgan's Mobile Home Park Caretaker, reported that the new owners of the mobile home park have required as a condition of occupancy each driveway be excavated 1/2 inches below the public roadway surface. Mr. Adams asked for City assistance from the Public Works Department stating that due to the age and fixed income of the tenants, they can not comply. After much discussion, Council advised Mr. Adams the City does not do work on private property but recommended he contact the Area Agency on Aging as a possible resource for assistance. On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the consent agenda with adding item "D" and making one correction to the June 26, 1995 minutes as follows: (a) Minutes of the ,tune 26, 1995 regular meeting with correction to page 1, paragraph 5, deleting "Councilman Childress" and inserting "Councilman Morrison". (b) Payment vouchers as follows: Claims Warrant No. 22866-22944 in the amount of $177,432.41 and June 1995 Payroll Warrant No. 122367-122624 in the amount of $262,183.47. (c) Resolution No. 1700 approving the issuance of a Special Use Permit to Robert and Christy Kurts for property located at 152 Shamrock Lane to allow a paint business to be located in a single family residence. (d) Councilman Clauson excused from this Council meeting. Mayor Weatherill presented a plaque and Certificate of Appreciation to Volunteer Firefighter Terry Bontrager for having responded to 5,000 Fire/Aid Runs during his 30 years and 2 months of volunteer service with Port Orchard Fire Department. Mayor Weatherill and Council applauded Mr. Bontrager for his dedication and support to the community. Mayor Weatherill opened the 7:35 PM Public Hearing regarding a reconsideration of a Special Use Permit and examination of compliance of Section 6.I.A.3 of the Port Orchard Zoning Ordinance as well as recommended Condition No. 7 of Planning Commission Resolution No. 215-94 in regards to an application considered on May 16, 1994. The applicants and property owners are Donald and Anna Ryan for property located at 1003 Sidney Avenue. LEGAL DESCRIPTION: Section 35, Township 24 Range 1E, Sweany's Second Addition to Sidney, Lot 1 and 2, Block 1, Sweany's Second Addition to Sidney, according to the Plat thereof, recorded in Volume 2 of Plats, Page 18, Records of Kitsap County, Washington. City Planner Brown gave staff report and briefed Councilmembers on the Planning Commission's recommendation for denial of this Special Use Permit. Recommendation for denial was based upon, but not necessarily limited to, the fact that the proposed off- street parking for the use did not meet zoning ordinance requirements. July 10, 1995 Page 2 of 3 Mayor Weatherill called for public input from those either for or against this Special Use Permit. Tom Sands, 720 Smith Street, expressed concern with owners renting a portion of the property and believes this would be detrimental to the neighborhood. Mayor Weatherill called for further public input regarding a reconsideration of a Special Use Permit and examination of compliance of Section 6.1.A.3 of the Port Orchard Zoning Ordinance as well as recommended Condition No. 7 of Planning Commission Resolution No. 215-94 in regards to an application considered on May 16, 1994. As no additional input was received, Mayor Weatherill closed Public Hearing and referred matter to Council for consideration. On motion by Councilman Geiger, seconded by Councilwoman Powers, Council adopted Planning Commission Resolution No. 239-95 and rescinded Special Use Permit to allow the conversion of a section of a single family home into a property maintenance office for property located at 1003 Sidney Avenue, as requested by Anna and Donald Ryan. On motion by Councilwoman Powers, seconded by Councilman Grable, Council authorized Mayor Weatherill to sign Interlocal Cooperation Agreement to form Consortium Under the National Affordable Housing Act. Council directed Clerk to remove item 5(e) from Old Business: Howard Minor request to lease 1/2 acre of property at the city's Old Clifton Road property. This item removed due to inactivity. Matter may be returned for consideration upon response by Dr. Minor. Councilman Grable moved to sponsor a city ordinance prohibiting the sale of fireworks. Motion died for lack of second. Sue Gazarek, 1012 Kitsap Street, spoke in favor of fireworks. At the request of Councilman Geiger, Mayor Weatherill adjourned Council into executive session to discuss current labor negotiations for 12 minutes with an extension of an additional 5 minutes. On motion by Councilman Geiger, seconded by Councilman Morrison, Council accepted and ratified a three year Public Works Labor Agreement. Revisions include but not limited to: WAGES: 10/1/94 - $.25 base wage increase plus 3.25. Cost of Living Wage increase retroactive to 10/01/94 for all public works employees employed by the City of Port Orchard at the date of contract signing. 10/1/95 - $.25 base wage increase plus 100% of the Greater Seattle CPI-U (7/94- 7/95) not to exceed 5%. 10/1/96 - $.25 base wage increase plus 100% of the Greater Seattle CPI-U (7/95- 7/96) not to exceed 5%. MEDICAL: Effective 10/1/96, Public Works Employees shall pay a co -pay insurance premium each month as follows: Employee only None 1 dependent $ 7.00 2 dependents $14.00 3 or more dependents $21.00 July 10, 1995 Page 3 of 3 On motion by Councilman Geiger, seconded by Councilman Morrison, Council authorized a 3.2% Cost of Living Wage increase retroactive to 10/01/94 to all non -represented employees of the City of Port Orchard who are actively employed as of July 10, 1995. Plus effective 10/1/96, all subject employees shall pay a co -pay insurance premium each month as follows: Employee only None 1 dependent $ 7.00 2 dependents $14.00 3 or more dependents $21.00 On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized the Mayor to sign and acknowledge the City's concurrence in Kitsap Co. Sewer District No. 5 acceptance of bids and contract award to purchase an emergency generator for the Joint Sewer Treatment Plant. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council authorized the City Engineer to draft amendment to the City's current noise ordinance to prohibit operation of construction equipment during certain hours. Specified hours to be consistent with Kitsap County's designated allowable work hours. On motion by Councilwoman Powers, seconded by Councilman Grable, Council authorized an expenditure of up to $3,500 for the repairs to the library wail mural.
