08/28/1995 - Regular - MinutesPort Orchard, Washington August 28, 1995 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie Weatherill at 7:30 PM at 216 Prospect Street, Port Orchard. Councilmembers present: Clauson, Morrison, Geiger, Powers, Van Zee and Grable. Councilman Childress excused page 2, paragraph 10. Staff present: Police Chief Mathews, Deputy Clerk Hager, City Planner Brown, City Engineer Curles, Fire Chief Snow, City Attorney McCluskey and City Clerk Parks. Councilman Van Zee led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. Howard Minor, 1400 Bay Street, requested an opportunity to address Council on the reconfiguration of the downtown/waterfront parking lot during the "Old Business" portion of the meeting. Chief Mathews introduced Jason Glantz as the newly hired Police Officer for the City of Port Orchard Police Department. Officer Glantz was hired by funds provided through the Federal COPS/FAST Grant. City Planner Brown introduced Julie Brown as the new Code Enforcement/Associ ate Planner. On motion by Councilman Grable, seconded by Councilwoman Powers, Council unanimously approved the consent agenda with the following corrections to the August 14, 1995 minutes: Page two, paragraphs 11 and 12, page three, paragraph 1 to read: Annapolis8" Pedestrian Walkway. a. Minutes of the August 14, 1995 Council meeting as corrected. b. Payment vouchers as follows: Claims Warrant No. 23114-23185 in the amount of $40,133.72. C. Ordinance No. 1639 amending Section II (P.O.M.0 9.24.050) of Ordinance No. 1606 relating to Public Disturbance Noises. d. Resolution No. 1707 authorizing the Mayor to apply for Community Development Block Grants. e. Resolution No. 1708 endorsing the new juvenile detention facility. f. Resolution No. 1709 amending Resolution No. 1699 establishing increase and/or decrease of speed limit on city streets or intersections. This amendment establishes a speed limit of 10 MPH in all alleyways. Mayor Weatherill opened the 7:35 PM Public Hearing regarding an appeal of the Planning Commission denial on Application for Variance as submitted by Lorin Blank. The Variance Application is seeking reduction of front yard setback for establishing off street parking at the front of property line at 241 Perry Avenue North. LEGAL DESCRIPTION: Lot 6, except the South 15 feet, and all of Lot 7, Block 12, Annapolis as per Plat recorded in Volume 1 of Plats, pages 64 and 65, records of Kitsap County, Washington. City Planner Brown updated Council on the Planning Commission's decision for denial of the Application for Variance at 241 Perry Avenue North. August 28, 1995 Page 2 of 3 David Roberts, attorney representing Lorin Blank, spoke in support of the variance and referenced several variances, along Perry Avenue which had been previously granted either reducing or eliminating front yard setbacks. Mayor Weatherill called for public input from those either for or against this appeal of the Planning Commission's recommendation to deny Application for Variance for property located at 241 Perry Avenue North. Howard Minor, 1400 Bay Street, representing the Planning Commission, noted two yes votes were received during the Planning Commission's consideration of this application. Dr. Minor noted for the record he spoke in support of the Application for Variance for property located at 241 Perry Avenue North. Lorin Blank, 303-Perry Avenue North, applicant, stated the reason for the Application for Variance was to allow for a safe place to park and to provide safe ingress/egress to Perry Avenue. City Clerk Parks read into record letters from (1) Clem Stritt; (2) Michael Williams, 320 Perry Avenue North; (3) A.C. and Virginia LeFevre, 147 Perry Avenue North, all supporting the Planning Commission's recommendation to deny the Application for Variance at 241 Perry Avenue North. David Roberts, attorney representing Lorin Blank, offered rebuttal of statements received in the three letters read by the City Clerk. Mayor Weatherill called for further public input regarding the Planning Commission's denial for an Application for Variance as submitted by Lorin Blank. As no further input was received, Mayor Weatherill closed the public input portion of this meeting and referred this matter to Council for consideration. On motion by Councilman Clauson, seconded by Councilman Morrison, Council moved to deny appeal and uphold the Planning Commission's denial of Application for Variance as submitted by Lorin Blank seeking reduction of front yard setback for his property located at 241 Perry Avenue North, motion passed with 4 ayes and 2 nays. Councilmembers Powers and Van Zee voting nay. Mayor Weatherill called for a 10 minute recess with meeting reconvening at 8:51 PM. Gary Brady, Facility Administrator for Port Orchard Care Center 2031 Pottery Avenue, gave a brief overview of the Port Orchard Care Center's future expansion plans. Mayor Weatherill placed into the Public Property Committee, a letter from Mark and Barbara Bricker, 1781 Sidney Avenue, requesting a nine month extension of a mobile home on their property at 1785 Sidney Avenue and permission to keep the mobile home at 1785 Sidney Avenue which was granted November 28, 1994 with conditions that the mobile home remain unused and not connected to City utilities. Howard Minor, 1400 Bay Street, requested bid process for the waterfront parking lot improvements be held in abeyance until he receives the results of a title search on his property. Dr. Minor reported he has ordered a title search to clarify ownership of that property which lies between the "0" tide line and his property which is contiguous to the downtown/waterfront parking lot. On motion by Councilman Morrison, seconded by Councilman Clauson, Council excused Councilman Childress from this Council meeting. August 28, 1995 Page 3 of 3 On motion by Councilman Morrison, seconded by Councilman Van Zee, Council authorized the Mayor to sign the COPS/FAST Grant Agreement. On motion by Councilman Clauson, seconded by Councilman Grable, Council authorized a sewer connection agreement for property located at 1432 Wilkins Place, contingent upon property owner also entering in an Annexation Agreement. On motion by Councilman Van Zee, seconded by Councilman Clauson, Council authorized the Mayor to sign Change Order No. 1 with DND Construction, for the Road and Sewer Repairs, 1995. Change Order No. 1 increases the contract price by $249.11 from $18,187.14 to $18,436.25 (total includes applicable sales tax). The contract completion time is not changed.
