Council of the City of Port Orchard, Washington, called to regular session at 7:30 PM by
Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Childress, Morrison, Geiger,
Van Zee and Grable. Councilwoman Powers excused. Staff present: Police Chief Mathews,
Deputy Clerk Hager, City Engineer Curles, City Planner Brown, Fire Chief Snow, and City
Attorney McCluskey.
City Attorney McCluskey led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments from items not listed on this agenda, no
response was received.
On motion by Councilman Grable, seconded by Councilman Clauson, Council approved
Consent Agenda items as follows:
3.a. (1) Minutes of March 28, 1994 Council meeting.
(2) March 31, 1994 Continued Public Hearing on Draft Comprehensive Plan
(meeting canceled due to lack of quorum and rescheduled for April 7,
1994)
(3) April 4, 1994 Study Session
3.b. Payment vouchers as follows: Claims Warrant No. 20345-20437 in the amount
of $90,145.70 and March, 1994 Payroll Warrant No. 119479-119654 in the
amount of $170,825.10.
3.c. Ordinance No. 1603 approving Vacation of a portion of Bay Street and an
unnamed right of way lying between public right of way.
3.d. Authorization for Mayor Weatherill to sign proposed amendment to Drug Task
Force Agreement adding Mason County as a party to said contract.
City Engineer Curies distributed the Mitchell Avenue Reconstruction Project bid results, with a
recommendation to award to the lowest bidder, R.V Associates. The bid opening was held
March 30, 1994 at 2:00 PM, 10 bids were received with the appropriate bid bond. See
attachment "A" for bid result information.
On motion by Councilman Grable, seconded by Councilman Clauson, Council accepted the
bidding for the Mitchell Avenue Reconstruction Project and awarded the bid to the low bidder,
R.V Associates in the amount of $728,924.30.
City Engineer Curies reported on the bid opening held March 31, 1994 at 4:30 PM for the
Road and Utility Repair. At the request of the City Engineer, Council held over bid award
process to allow the engineer an opportunity to meet with the apparent low bidder.
On motion by Councilman Van Zee, seconded by Councilman Clauson, Council offered
support to the Alliance of Southworth Commuters with no any monetary contribution.

On motion by Councilman Morrison, seconded by Councilman Clauson, Council denied
request as submitted by the Krwanis Club of Port Orchard to locate a newspaper recycle bin
within the city right of way at the intersection of Kendall and Austin. Motion passed with 5
ayes and 1 nay. Councilman Van Zee voting nay.
On motion by Councilman Clauson, seconded by Councilman Grable, Council approved an
application for Public Event as submitted by the Totem Girl Scouts and authorized the use of
Van Zee Park for the Totem Girl Scouts Day Camp on July 18 - 22, 1994.
On motion by Councilman Morrison, seconded by Councilman Grable, Council approved the
1994 Paving Program as follows: (1) Overlay Sidney Avenue from Tremont Street to Lippert
Avenue (2) Pave dead end extensions off of Mitchell Avenue during the reconstruction project
(Dwight Street, DeKalb Street and Kitsap Street), (3) Install a type 2 catch basin at the bottom
of Morton Street to serve as a dry well.
On motion by Councilman Morrison, seconded by Councilman Van Zee, Council authorized
the City Engineer to proceed with designating Frederick Street one-way northbound with
diagonal parking between Bay Street and Prospect Street.
On motion by Councilman Geiger, seconded by Councilman Van Zee, Council authorized the
reimbursement of $1,300.00 to Windermere Realty for parking lot access improvements, as
part of the Bethel Widening Project.
On motion by Councilman Morrison, seconded by Councilman Geiger, Council authorized the
City Engineer to proceed with obtaining library expansion soil testing based on low quote.
Mayor Weatherill directed the Finance Committee to appropriate the necessary funds to
complete the new fire station at 200 Tremont Street.

In review of the bid documents, minor errors were found in one of the bid documents.
The corrected numbers are shown in the bid tabulation. The errors were not significant
enough to change the order of the bidders, i.e. low to high.
PIease find enclosed ten (10) copies of the bid summary which provides a more
comprehensive breakdown of the bid results.
We have solicited comments from the low bidder's listed references, and based on our
review of the low bid, as well as, the Contractor's familiarity with this type of work,
the magnitude of the project, and our conversations with the contractor, we hereby

recommend that the City award the Mitchell Avenue Reconstruction Project, Schedules
A & B, to R.V. Associates, Inc., of Port Orchard, Washington, in the amount of
$724,702.35 which includes 8.1 percent sales tax for the Schedule B watermain
reconstruction work. Mr. Don Geise of the T.I.B. gave verbal authorization to award
the project on April 5, 1994. PIease note Schedule C was an optional with owner
schedule involving work that the South Kitsap School District requested. We have
spoken to Mr. Rudy Fyles of the School District and they have elected not to award
this schedule. Please also note Schedule A work does not require sales tax per
Washington State Revenue Rule 171. For the record, we wish to state that we have
personally spoken to the contractor, specifically Mr. Doug Freeman, and he has stated
that he has no intent of claiming a bid error and -foresees no problem in completing the
work within the required time frame. Please advise should you require any additional
information in this regard.
We recommend returning all but the top three bid bonds for this project until the
contract has been signed. At that time, the remaining bid bonds should be returned.
