AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
REPEALING ORDINANCE NO. 1236 AND RELATING TO AND
PROVIDING FOR THE ANNEXATION OF TERRITORY TO THE CITY
OF PORT ORCHARD FOR MUNICIPAL PURPOSES (Wastewater
Treatment Facility)
Copies of Ordinance No. 1815 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1815 will be
provided at a nominal charge.

Legal Description: NE'/4 of the NE'/ of Section 25, Township 24 North, Range 1 E
WHEREAS, the City of Port Orchard is the owner of record of the following described property
consisting of two tax parcels (4689-002-001-0104 and 4538-010-003-0009) totaling 5.2 acres. A 2.5 acre portion of
the property to be annexed was recently acquired by the City to be used for municipal sewerage purposes as an
integral part of the City's wastewater treatment facility; and
WHEREAS, a 2.7 acre portion of this property was annexed into the City in 1983 by Ordinance No.
1236; and
WHEREAS, on February 15, 2000 the City of Port Orchard and the Veteran's Home, Washington
Department of Veterans Affairs filed a Declaration of Boundary Line Adjustment correcting the boundaries and legal
description of the property annexed in 1983; and
WHEREAS, it is the intent of the city with concurrence by county assessor's office to combine the
two parcels into one tax parcel upon annexation; and
WHEREAS, it has been agreed the best method of correcting the legal description as stated within
Ordinance No.1236 and to prepare for combining the two parcels is to describe the property with one legal
description; and
WHEREAS, RCW 35.13.180 provides for annexation of property for municipal purposes; and
WHEREAS, this property is to be used for wastewater treatment facility purposes, now, therefore
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 1236 is hereby repealed in its entirety.
SECTION 2. THAT the following described territory owned by the City of Port Orchard and non-
contiguous to the City of Port Orchard be and the same hereby is annexed to the City of Port Orchard for municipal
purposes and from and after the effective date of this Ordinance shall be and become subject to all the Laws and
Ordinances thereof.

Tracts, Volume 2, Page 61 of Plats and that portion of Block B, and Lot 1 of Block C of the Re -plat
of Gaffner's Garden Tracts, Volume 2, Page 89 of Plats, and that portion of vacated Daniel Avenue
and Port Orchard Street and Front Street, per Kitsap County Commissioner's Journal, Volume 3,

the East line of the Northeast quarter of Section 25, 1924.48 feet, to the centerline of County Road
(Bay Street); thence North 72' 36' 57" West, along centerline of Bay Street, 221.24 feet; thence
continuing along the centerline of Bay Street; North 85' 38' 37" West, 684.22 feet; thence leaving
said centerline, South 4° 21' 23" West, 30.00 feet to the South right-of-way margin of Bay Street
and the True Point of Beginning; thence South 85° 38' 37" East, along said South margin, 111.89
feet to a point of curvature; thence Southeasterly along a curve to the right, having a central angle
of 79' 14' 02" and a radius of 35.00 feet for an arc distance of 48.40 feet to a point on the Westerly
right-of-way margin of Olney Avenue; thence South 6° 24' 35" East, along said Westerly margin,
