Council of the City of Port Orchard, Washington, called to regular session by Mayor
Leslie J. Weatherill at 7:30 PM at City Hall, 216 Prospect Street. Councilmembers
present: Childress, Morrison, Geiger, Powers, Van Zee and Grable. Councilman
Clauson excused. Staff present: Police Chief Mathews, City Planner Brown, City
Engineer Curles, Eire Chief Snow, Deputy Clerk Hager, and City Attorney McCluskey.
Chief Mathews led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
No response was received.
On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the
Consent Agenda as follows:
(a) Minutes of the following Council meetings:
(1) September 12, 1994 regular Council Meeting
(b) Payment vouchers as follows: Claims Warrant No. 21232-21295 in
the amount of $350,249.63.
(c) Resolution No. 1676 providing for a Conditional Use Permit and
Variance for Shipwatch Shores.
(d) Resolution No. 1677 authorizing an interfund transfer loan for
the Arterial Street Fund.
(e) Ordinance No. 1612 approving Preliminary Plat of Poplar Court
Subdivision as submitted by Charles Bowman, property located at
106 Poplar Street.
(f) Ordinance No. 1613 amending Port Orchard Zoning Ordinance No.
1469; by amending the area and use maps thereof, reclassifying a
1.33 acre parcel located at 106 Poplar Street from Residential
Low to Residential High (Charles Bowman, owner.)
(g) Ordinances and other matters to be placed on 10/10/94 Council
agenda:
1. Animal Appeal Board Ordinance.
2. Mobile Home Park Ordinance.
3. Ordinance establishing duties of the Code Enforcement
Officer.
Mayor Weatherill opened the continued 7:35 PM Public Hearing regarding an
application for a zone reclassification from Residential Low to Residential High and
a Preliminary Plat to allow a subdivision of 9 acres into 35 lots for single family
residences as submitted by Jerry Clark for Heron Ridge. Site location: 200 block
of Melcher Avenue West. LEGAL DESCRIPTION: Attachment "A"

Councilman Morrison stepped down from Council table, due to a possible conflict of
interest.
City Planner discussed Planning Commission's concerns regarding placement of
sidewalks on Melcher Avenue to Pottery Avenue. After brief discussions, City
Planner recommended a continuance of this Public Hearing due to the fact site plan
revisions were submitted after Planning Commission's recommendation and staff has
not reviewed new plans.
Jerry Clark, proponent, also expressed concern with the placement of the sidewalks
regarding the steep topography in the area.
Howard Minor, 1400 Bay Street, spoke in favor of the project, however stressed the
need for sidewalks in front of project.
On motion by Councilwoman Powers, seconded by Councilman Geiger, Council continued
this public hearing to October 10, 1994 at 7:50 PM for further review by City staff.
Mayor Weatherill opened the 7:40 PM Public Hearing regarding an application for a
Shorelines Permit and Variance to allow a boat bottom washing system at 53 W. Bay
Street, as submitted by Dockside Sales and Service, Don Morrison, owner. LEGAL
DESCRIPTION: That portion of the Harbor area, situated in front of Lots 1, 2 and
the east half of Lot 3, Port Orchard Bay Water front tracts, recorded in Section 26,
Township 24 North, Range 1 East, W.M.
Councilman Morrison stepped down from Council table, due to a conflict of interest.
City Engineer Curles updated the Shorelines permit procedures and the proposed Boat
Bottom Wash System.
Don Morrison, owner, Dockside Sales and Service, discussed the operation of the
pressure wash filtration system and the proposed structure.
Howard Minor, 1400 Say Street, spoke in favor of the project, however expressed
concern with the various governmental regulations.
Mayor Weatherill called for further input either for or against the proposed
application for a Shorelines Permit and Variance. As no further response was
received, Mayor Weatherill closed the public input portion of the Public Hearing and
referred the matter to Council for their consideration.
On motion by Councilman Van Zee, seconded by Councilman Grable, Council approved the
Shorelines Permit and Variance to allow a boat bottom washing system at 53 W. Bay
Street, Dockside Sales and Services, as submitted by Don Morrison, owner.
On motion by Councilwoman Powers, seconded by Councilman Van Zee, Council adopted
Resolution No. 1678 providing a permit and variance for Dockside Sales and Service
Sales, for the pressure washing filtration system.

On motion by Councilman Geiger, seconded by Councilman Morrison, Council approved
the 1995 Humane Society Animal Control Agreement.
Mayor Weatherill placed into Finance Committee for review, proposed step system for
the Municipal Court Cleric and Assistant Court Clerk.
On motion by Councilman Geiger, seconded by Councilman Van Zee, Council waived water
and sewer in lieu of assessment fees for the South Kitsap Health Care Campus
Complex, due to the substantial improvements to the City's utility system.
On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized
the Mayor to sign Change Order No. 2 in the amount of $13,451.31 for the Mitchell
Avenue Reconstruction project.
On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized
the placement of a street light on Tracy Avenue, north of Chester Street.
