06/14/1993 - Regular - MinutesPort Orchard, Washington June 14, 1993 Council of the City of Port Orchard, Washington, called to regular session at 7:30 PM by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Childress, Morrison, Geiger, Powers and Grable. Staff present: Police Chief Mathews, Deputy Clerk Hager, City Engineer Curies, City Planner Brown, Fire Chief Snow, City Attorney Goodwin, and City Clerk Hower. Councilman Smith excused - leave of absence approved April 26, 1993. Councilman Clauson led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Geiger, Council unanimously approved the consent agenda items as follows: 3.a. May 24, 1993 Council meeting minutes. 3.b. Payment vouchers as follows: Claims Warrant No. 18880-18978 in the amount of $150,316.67 and May 1993 Payroll Warrant No. 117589-117769 in the amount of $155,098.66. 3.c. Ordinance No. 1583 amending Ordinance No. 1490 to amend the legal description therein which vacated a portion of Alder Lane. 3.d. Ordinance No. 1534 dedicating "Lloyd Parkway" as a public right of way. Judd Turner requested the Council amend Fathoms O' Fun's Public Event Permit by changing the festival start date from June 26, 1993 to June 24, 1993 to facilitate carnival set up. On motion by Councilman Clauson, seconded by Councilwoman Powers, Council authorized the date change amendment to the Fathoms O' Fun Public Event Permit to allow the carnival to begin set up on the 24th. Judd Turner further requested the use of 28 parking spaces on the waterfront parking area to meet a condition set by the Port of Bremerton to compensate for the carnival use of the Port of Bremerton's parking spaces. On motion by Councilman Clauson, seconded by Councilman Grable, Council approved Fathoms O' Fun Festival request and authorized the following : (1) reservation of 28 spaces within Waterfront Parking Lot #1 for Port of Bremerton use during the period that Fathoms of Fun carnival is utilizing the Port's parking area located east of Waterfront Parking Lot #4. Vehicles with a Port of Bremerton parking pass will be exempt from parking time restrictions including the 7:00-7:30 AM prohibition and from parking fees; (2) allow cars with Lot #1 monthly passes to park in Lot #2 all day; and (3) enforce four hour parking on all other vehicles. Jim Hall, representing Port Orchard Chamber of Commerce, requested an amendment to their Circus Public Event Permit by allowing the relocation of the circus from the Sedgwick Interchange to the Mitzel's South Kitsap Plaza on Mile Hill Drive, east of the South Kitsap Mall. June 14, 1993 Page 2 of 4 On motion by Councilman Morrison, seconded by Councilman Clauson and Grable, Council sanctioned an amendment to the Chamber of Commerce Public Events Permit to allow relocation the circus from the Sedgwick Interchange to the Mitzel's South Kitsap Plaza on Mile Hill Drive east of the South Kitsap Mall on June 24, 1993. Mayor Weatherill opened the 7:35 PM Public Hearing regarding an application for a Special Use Permit as submitted by South Kitsap Helpline to allow transitional housing in two four plexes at 103 Lippert Drive. LEGAL DESCRIPTION: Attachment "A" City Engineer Curies gave staff report and briefed Councilmembers on the Planning Commission's recommendation for approval of this Special Use Permit. Kathy Menz, Executive Director for the South Kitsap Helpline, requested approval of this project and stressed the need for transitional housing for families with children in the South Kitsap area. City Clerk Hower read into record letter of support from Christopher J. Koh which also requested the city monitor the project to assure maintenance of quality management. Mayor Weatherill called for additional input either for or against the Special Use Permit Application as submitted by the South Kitsap Helpline. As no response was received Mayor Weatherill closed the public input portion of this hearing and referred the matter to Council for consideration. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council adopted Planning Commission Resolution No. 200-93 as their own and approved the issuance of a Special Use Permit to South Kitsap Helpline allowing transitional housing at 103 Lippert Drive with the following condition: The nature of the transitional housing cliental will be restricted to emergency housing for families with children only no single persons will be housed at this location. The Special Use Permit will not provide for uses as defined in a halfway house or other uses which provide an increased public safety requirement. Mayor Weatherill opened the continued 7:45 PM Public Hearing regarding an Appeal to an Abatement Order to clean a lot at the northeast corner of Chester Street and Farragut Avenue. City Engineer Curies advised Council the lot has been cleaned and recommended dismissal of this action. City Clerk Hower reported Mr. Davis informed her office that he would not attend this meeting and does not wish to pursue the appeal. Mayor Weatherill closed public input portion of this public hearing and referred matter to Council for their consideration. On motion by Councilman Geiger, seconded by Councilmen Clauson and Grable, Council dismissed Mr. Paul Davis's Appeal to Abatement Order and authorized the City Engineer to vacate Mr. Davis's Abatement Order. June 14, 1993 Page 3 of 4 On motion by Councilman Clauson, seconded by Councilman Grable, Council excused Councilwoman Powers from the June 28, 1993 council meeting. Mrs. Powers will be out of town on personal business. On motion by Councilman Clauson, seconded by Councilman Childress, Council authorized Police Chief Mathews and Mayor Weatherill to sign the Westnet Interlocal Drug Task Force Agreement with the expenditure of $3,000 from the S.I.U. Fund. On motion by Councilwoman Powers, seconded by Councilman Morrison, Council authorized the preparation of a draft ordinance restricting the use and discharge of fireworks within the City of Port Orchard. Mayor Weatherill opened the 8:00 PM Public Hearing regarding a request to amend the South Kitsap Health Care Campus site plan as submitted by N.L. Olson and Associates representing Harrison Hospital. Councilman Childress stepped down from council table due to conflict of interest. City Engineer Curles gave staff report on the proposed site plan changes for the South Kitsap Health Care Campus. Mark Dorsey, Project Manager for the South Kitsap Health Care Campus, discussed the revised master site plan identifying the restaurant, gas station/convenience store and the bank as the main retail reconfigurations within the project. Tim Arnold, Bradley Scott, answered questions regarding the relocation of commercial sites within the project site. Mayor Weatherill called for a 10 minute recess, with meeting to resume at 9:00 PM. Gerry Gerome, ā¯‘esign Architect for Phase I of the South Kitsap Health Care Campus, displayed an architectural model of the proposed medical office facility and outlined the reduced square footage of the building. On motion by Councilman Morrison, seconded by Councilman Clauson, Council moved to continue Public Hearing to June 28, 1993 at 8:00 PM to allow developer an opportunity to provide elevation drawings in conjunction with the revised site plan. Donna Brown, City Planner, updated Council on the Urban Boundaries Community Workshop held Saturday, June 12, 1993 on Rural Design. Ms. Brown urged Councilmembers to attend the Planning Commission meeting scheduled for June 21, 1993. Mr. Isley will be present to review proposed draft urban boundaries issues. Howard Minor, 1400 Bay Street, voiced concern regarding the future of affordable housing in Kitsap County. June 14, 1993 Page 4 of 4 On motion by Councilman Morrison, seconded by Councilman Clauson, Council authorized the Mayor to sign the Community Development Block Grant Agreement accepting funding in the amount of $132,000 for the Tremont Street Fire Station/Firefighter Residency Training Program and $18,000 for AAA improvements to the Port Orchard Library Building. On motion by Councilman Clauson, seconded by Councilman Morrison, Council declared as surplus to the needs of the City, a 1979 Pontiac Lemans station wagon VIN #2D35Y9P576944, 6 gasoline cans and a Royal typewriter (inoperable) and authorized the City Engineer to dispose of these items in the best interest of the City. On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized Mayor Weatherill to sign the extension of the Urban Forestry Grant to allow for seasonal planting. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council authorized the City Engineer to accept cost proposal from Apply -A -Line for the City Street striping.
