01/27/1992 - Regular - MinutesPort Orchard, Washington January 27, 1992 Council of the City of Port Orchard, Washington called to regular session by Mayor Pro-tempore Robert Geiger at 7:30 PM. Council members present: Clauson, Childress, Morrison, Geiger, Powers, Smith and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Mayor Pro-tempore Geiger led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilwoman Powers, Council approved the minutes of the January 13, 1992 regular meeting as distributed. Mayor Pro-tempore Geiger outlined letters from several social service agencies requesting the City's admission tax rate be increased to same as the Kitsap County rate and tax revenues received be allocated for social services. These agencies have been receiving admission tax revenue funds from Kitsap County, however the annexation of property which included South Sound Cinema has reduced the county's admission tax revenue, thus reducing allocations to these agencies. Pro-tempore Geiger referred this request to Finance Committee for review and recommendation. At 7:45 PM Mayor Pro-tempore Geiger opened Public Hearing regarding an application for a Zone Reclassification from Green Belt to Residential High as submitted by the City of Port Orchard for property located at 200 Tremont. LEGAL DESCRIPTION: Section 35, Township 24 North, Range 1 East, Kitsap County: Parcel four of Short Plat 1033, Recorded October 5, 1984 under Auditors File Number 8410050134, Records of Kitsap County, Washington; except the northern most 120 feet. City Engineer Curles briefed Council on location of subject property and outlined the Planning Commission's recommendation to approve the City of Port Orchard Zone Reclassification from Green Belt to Residential High. Howard Minor, 1400 Bay Street, congratulated the City for the development of the new fire station. Mayor Pro-tempore Geiger called for additional input either for or against the proposed rezone. As no response was received Mayor Pro-tempore Geiger closed the Public Hearing and referred matter to Council for consideration. January 27, 1992 Page Two of Three On motion by Councilman Smith, seconded by Councilman Clauson, Council adopted Planning Commission Resolution No. 177-91 setting forth findings of fact, conclusion and conditions as their own and approved the zone reclassification from Green Belt to Residential High for property located at 200 Tremont, with the following 8 conditions: 1) A landscape plan shall be submitted identifying type, location and size of planting materials; 2) A lighting plan shall be submitted and approved prior to placement of outdoor illumination; 3) Landscaping found dead or diseased within one year of planting will be replaced; 4) The private access road and building parking area shall be paved with asphalt; 5) A minimum six foot fence shall be constructed per City standards; 6) The stormwater detention pond shall be constructed per City standards; 7) All parking stalls shall be striped and marked including handicapped areas; 8) Pianting materials shall be installed prior to building occupancy. Mayor Pro-tempore Geiger read Mayor's Proclamation designating the week of February 16-22, 1992 as Engineer's Week. Councilman Clauson moved to concur with Mayor Pro-tempore Geiger declaring the week of February 16-22, 1992 as Engineer's Week in the City of Port Orchard, seconded by Councilman Grable and carried. On motion by Councilwoman Powers, seconded by Councilman Grable, Council removed from table,.tabled-motion to. adopt proposed Ordinance No. 1532 regulating signs in the street right of way with two additional conditions (1) sign boards need to be removed nightly (2) businesses that place a sign board on the sidewalk must include the city as an additional insured on their liability insurance coverage. Councilman Geiger withdrew his motion to adopt proposed Ordinance No. 1532 and Councilman Clauson also withdrew his second. Mayor Pro-tempore Geiger requested the Finance Committee to review Peddlers and Hawkers Ordinance No. 392 (POMC 5.44). This ordinance was approved in 1931 and has not been updated since that time. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 16292-16363 in the amount of $192,297.04. Councilmembers discussed letter from Dr. Willa Fisher, Bremerton/ Kitsap County Health Dept requesting 3 parking permits for Family Planning Agency staff (619 Division St), which would allow them to park in excess of the 2 hour limit on Division Street. Due to nature of their work, they can not leave clients to move their vehicles and have received several parking tickets. January 27, 1992 Page Three of Three Councilman Clauson moved to deny request from the Health Department for special parking privileges on Division Street stating parking around the Kitsap County Courthouse is limited and when the City approved the County Campus plans it was agreed on -street parking would be utilized for courthouse business. Motion seconded by Councilman Morrison and carried with a vote of 6 ayes and 1 nay. Councilwoman Powers voting no. On motion by Councilman Morrison, seconded by Councilman Grable, Council authorized the Mayor to sign agreement with the Transportation Improvement Board (TIB) for the design phase of the Mitchell Avenue reconstruction project (No. 9W-153(002)-1}. Council discussed suggestion of relocating the Port Orchard Library to the old Givens School site. Mayor Pro-tempore Geiger referred this matter to Public Property Committee for study and recommendation. Meeting adjourned at 9:00 PM. CITY CLERK
