April 13, 1992
Council of the City of Port Orchard, Washington, called to
regular session by Mayor Leslie J. Weatherill at 7:30 PM.
Councilmembers present: Clauson, Childress, Morrison, Geiger,
Smith and Grable. Staff present: City Attorney Haberly, Deputy
Clerk Thomas, Police Chief Mathews, City Engineer Curles, City
Planner Davis, Fire Chief Snow and City Clerk Hower.
Councilwoman Powers excused.
Councilman Grable led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Morrison,
Council approved the minutes of the March 23, 1992 regular
meeting as distributed.
Carol Vaughn, Day Camp Director for South Kitsap Totem Girl Scout
Council, requested permission to use Van Zee Park as a Day Camp
on August 10-14, 1992 from 8:30 AM to 4:40 PM. The park will
remain open to the public during the day camp.
On motion by Councilman Smith, seconded by Councilman Grable,
Council approved the use of Van Zee Park as a Day camp as
requested by the South Kitsap Totem Girl Scouts on August 10-14,
1992 from 8:30 AM to 4:40 PM, subject to City receiving required
insurance certificate.
City Clerk Hower reported on bid opening held April 7, 1992 at
4:30 PM for Phase I of the main fire station. The bids were
received as follows:

On motion by Councilman Clauson, seconded by Councilman Geiger,
Council accepted the bidding and awarded Phase I of the main fire
station project to the low bidder, Boddie's Building Construction
in the amount of $297,834.00 and authorized execution of contract
documents.

City Clerk Hower read Mayor's Proclamation designating the week
of April 24 through May 1, 1992 as "Earthquake Awareness Week".
On motion by Councilman Clauson, seconded by Councilman Smith,
Council concurred with Mayor Weatherill declaring the week of
April 24 through May 1, 1992 as "Earthquake Awareness Week".
City Clerk Hower read Mayor's Proclamation designating the week
of April 12-18, 1992 as "National Telecommunicators Week".
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council concurred with Mayor Weatherill in declaring the week of
April 12-18, 1992 as "National Telecommunicators Week".
At 7:45 PM Mayor Weatherill opened Public Hearing regarding a
Community Block Grant Application.
City Planner Davis introduced Norm McLaughlin from the Kitsap
County Housing Authority. Mr. McLaughlin gave a brief
description of the state block grant which will be used to
provide a housing study of Kitsap County.
Roger Wade, Phoenix Group spoke on the technical issues of the
block grant.
Howard Minor 1400 Bay Street, voiced concern on recent impact
fees and interest rates and the effect on low income individuals.
Doug Eide, 2475 Bethel Avenue, spoke in favor of the block grant
application.
Mayor Weatherill called for additional input. As no response was
received, Mayor Weatherill closed Public Hearing and referred
matter to Council for consideration.
On motion by Councilman Clauson, seconded by Councilman Smith,
Council approved City's participation in the Community
Development Block Grant application process, authorizing the
Mayor to sign grant application documents and adopted Resolution
No. 1595 establishing a Community Development Block Grant
Certification of Compliance.
Mayor Weatherill opened 8:00 PM Public Hearing regarding policies
protecting critical environmental areas.

City Planner Davis reviewed policies and advised Council and
audience these policies are mandated through the Growth
Management Act.
City Clerk read into record a letter from Rodney M. 011as, 662 SW
Bay Street, opposing City's adoption of protection policies and a
letter from Elaine Manheimer, 1120 Spokane in support of the
policies.
Mayor Weatherill called for public input concerning the policies
protecting critical environmental areas.
Doug Eide, 2475 Bethel Road, voiced concern for property owner
rights, regarding compensation for reduction in property value,
suggesting the City develop a policy of allowing higher zoning
designation for properties effected by critical area policies.
Mr. Eide proposed a round table discussion with the citizens of
Port Orchard to develop these policies.
gel Holgerson, 2051 Beach Drive, suggested Council provide
guidelines for wetland vegetation buffers.
Howard Minor, 1400 Bay Street, urged city to mitigate effect of
wetlands.
Lorraine Davidson, 1776 Say Street, would like City to keep her
informed on wetland process.
Lori Walton, 240 Melcher, who has a pond on her property, voiced
concern about property taxes and would like to be compensated for
any wetlands which cause a reduction in property values.
Gary Spaulding, 2135 Sheridan Road #C, owns property near the
head waters of Ross Creek, expressed concern for future loss of
value of wetland property. He also suggested public records need
to indicate wetland property.
Milton H. Laeder, 2300-47th Ave SW. Seattle, would like to know
all information concerning wetlands and what the limitations are.
Sam Mitchell, 607 E Edgemont Dr, Wenatchee, WA, owns 8 to 9 acres
in the city and also would like to be informed on all issues
concerning wetlands.
Russell Barringer, 604 Melcher, asked if his property would be
:�nsidered wetlands. Mayor Weatherill directed Mr. Barringer and
�11 concerned citizens to contact the Planning Department for
detailed information on their individual properties.

Mary Felts, 1050 Hull Avenue, asked how would a person know if
they own wetlands and what can be done on wetlands?
Judy Howe, 1217 Sidney Avenue, reinforced Mr. Eide's proposal
recommendation for round table discussions.
Roger Nelson 526 Melcher, asked "What is a wetland?"
Mark Bricker, 1785 Sidney Avenue, requested to see maps
designating wetland areas. City Planner Davis invited interested
citizens to visit the Planning Department to review the maps.
William M. Palmer, representing Board of Realtors, voiced
concerns about policies having been adopted without citizen
input.
Dick Jacobsen, 8306 Marine Drive NW, Gig Harbor, requested
designated wetlands be given a high density.
Richard A. Brown, property owner, encouraged round table
discussions.
Sandy O'Donnell, 1130 Bethel Road, stated property owners need to
be notified concerning wetland issues.
Jean Jones, 713 Jones Drive, would like to be included in all
mailings concerning wetlands.
Vivian Boddle, Association of Realtors, encouraged round table
discussions and public testimony.
David Haven -Saunders, 3353 Anderson Hill Road, asked for the
definition of "taking of property", and supported continued
discussions on wetland issues.
Jerry Arnold, 1265 Sherman Avenue, asked "What will happen to
homes already built on wetlands?"
Delores Barringer, 604 Melcher, stated property owners need to be
informed on wetland issues.
Bruce Jarrett, 1376 Higher Ground Lane, asked "What is the next
process?" and encouraged small study session groups.
Mayor Weatherill called for additional input regarding the
policies protecting critical environmental areas. No further
response was received.

Mayor Weatherill called for a 5 minutes recess with meeting to
resume at 10:10 PM.
City Engineer Curles reviewed letters written to and received
from Debra and Chris Michak regarding the fence at 1803 Bay
Street.
on motion by Councilman Morrison, seconded by Councilman Geiger,
Council granted Debra and Chris Michak an extension to May 8,
1992, for their fence repair work, and instructed the City
Engineer to clarify location and description of fence.
on motion by Councilman Morrison, seconded by Councilman Clauson,
Council concurred with Mayor Weatherill's appointment of Bernie
Angel to the Planning Commission to fill the unexpired term of
Lee Caldwell, who submitted a letter of resignation on March 31,
1992.
on motion by Councilman Morrison, seconded by Councilman Clauson,
Council revoked zoning classification at 225 Sidney Avenue, for
failure to comply with 18 month time limit, (Frank Haberlack,
owner of record). Property reverts to Residential High Zone
Designation.
On motion by Councilman Smith, seconded by Councilman Morrison,
Council approved Mutual Aid and First Response Agreement between
the City of Port Orchard and Kitsap County Fire District No. 7.
Mayor Weatherill advised Council West Sound Cycle has voluntarily
withdrawn the bicycle race scheduled for July 4, 1992.
On motion by Councilman Morrison, seconded by Councilman Clauson,
Council approved application for public event as submitted by the
Robert Ojima, President Downtown Merchants Association, to hold
the 1992 Street Fair on August 2, 1992.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council moved to amend Water/Sewer Ordinance No. 1493 to
establish a classification for snackbar/espresso bars at a rate
of $14.00 per month.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of vouchers as follows:
Claims Warrant No. 16664-16778 in the amount of $135,305.91 and
March 1992 Payroll Warrant No. 115195-115348 in the amount of
,150,033.92.

On motion by Councilman Grable, seconded by Councilman Smith,
Council approved Ordinance No. 1542 establishing a permit system
for the City R.V. Park, subject to City Attorney approval.
On motion by Councilman Grable, seconded by Councilman Smith,
Council adopted Resolution No. 1596 establishing rules and
regulations for the City RV Park, subject to City Attorney
approval.
On motion by Councilman Geiger, seconded by Councilmen Morrison
and Clauson, Council approved purchase of property located at 560
Bay Street in the amount of $95,000.00, (Kitsap County Assessed
Evaluation).
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council authorized a Call for Proposals to select an architect
for a future city hall facility. The architect will develop the
exterior design concept and evaluate departmental requirements to
establish interior design.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council moved to authorize the City Engineer to construct the
north most 600' of Bethel Avenue sewer system.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council declared as surplus, the 1984 Ford VIN #1FABP39MXEG236610
and the 1985 Ford LTD, VIN #1FABP39M6FG213794, and authorized the
Police Department to dispose of these two vehicles in the best
interest of the City.
on motion by Councilman Morrison, seconded by Councilman Smith,
Council authorized the Mayor to sign agreement with Al's Exxon to
wash all marked city emergency vehicles in the amount of $50.00
per month, subject to approval of contract by the City Attorney.
on motion by Councilman Clauson, seconded by Councilman Morrison,
Council authorized the City Engineer to solicit cost proposals to
install a video system for the Municipal Court arraignments.
On motion by Councilman Morrison, seconded by Councilman Geiger,
Council authorized the City Engineer to begin the right-of-way
acquisition process for the Port Orchard Bypass with permission
to contract for the following services: (1) $3,150 to Entranco
Engineers to write the legal descriptions based on the centerline
of the existing road; (2) approximately $5,000 to appraise the
three properties that have to be purchased; (3) Contract with Mr.
Ken Endorf at $20.00 per hour to negotiate with the property
owner for the real estate, using the above appraisals.

On motion by Councilman Clauson, seconded by Councilman Geiger,
Council authorized the City Engineer to advertise for a design
consultant for the Mitchell Avenue reconstruction project.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council authorized the City Engineer to advertise for bids for
the Bethel "Y" watermain and the Tremont Street watermains.
Mayor Weatherill placed into the Street/Alley Committee a request
to place a fence in the right-of-way at 1138 Tacoma Avenue.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council authorized the City Engineer to survey the easement for
Radey Street sewer main replacement in the approximate cost of
$800.00.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council placed into Water/Sewer Committee a request by R.V. and
lssociates to waive the Fee In Lieu of Assessment for the Lloyd
,arkway Watermain.
