05/26/1992 - Regular - MinutesPort Orchard, Washington May 26, 1992 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Council members present: Clauson, Morrison, Geiger, Powers and Grable. Staff present: City Attorney McCloskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, City Planner Davis, and Fire Chief Snow. Councilmembers Smith and Childress excused. Police Chief Mathews led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Morrison, Council approved the minutes of the May 11, 1992 regular meeting as distributed. Robert Baglio, Kitsap County Administrative Services, discussed proposed uses of the Givens Community Center. Mayor Weatherill opened Public Hearing scheduled for 7:45 PM. This is the first of two Public Hearings to establish a Comprehensive Plan Map Designation(s) for 186.57 acres of property which was annexed into the City on 11/11/91 commonly known as the Vine Street Corporation (K-Mart) Annexation. LEGAL DESCRIPTION: Attachment "A" City Planner Davis updated the Council on the purpose of this Public Hearing. Mayor Weatherill called for public input in favor of or opposed to the City establishing a Comprehensive Plan Map designation(s) for 186.57 acres of property which was annexed into the City on 11/11/91 commonly known as the Vine Street Corporation (K-Mart) Annexation. As no response was received Mayor Weatherill closed the Public Hearing. This was the first of two Public Hearings, the second and final Public Hearing will be held 7/13/92 at 7:30 PM. Mayor Weatherill placed Application for Public Events as submitted by Van Vlist for "The Cruz", August 16, 1992 into Street/Alley Committee for review and recommendation. May 26, 1992 Page Two of Four City Engineer Curles reported on bid opening held May 21, 1992 at 4:30 PM regarding the Bethel Wye Watermain. Bids were received and opened as follows: Stan Palmer $46,820.00 + bid bond Pape & Sons 29,935.00 + bid bond Crescent Construction 32,306.10 + bid bond Sound Excavation 28,425.00 + bid bond Tinners 34,565.00 + bid bond Del Mar Construction 36,510.00 + bid bond Lyrch & Associates 26,760.00 + bid bond Engineer's Estimate $28,640.00 On motion by Councilman Geiger, seconded by Councilman Grable, Council accepted the bidding and awarded the bid for the Bethel Wye Watermain to the lowest bidder, Lyrch & Associates in the amount of $26,760.00. City Engineer Curles reported on bid opening held May 21, 1992 at 4:30 PM regarding the Tremont Watermain. Bids were received and opened as follows: Del Mar Construction $21,925.00 + bid bond Tinner's 21,340.00 + bid bond Sound Excavation 17,315.00 + bid bond Case Excavation 25,200.00 + bid bond Stan Palmer 28,220.00 + bid bond Pape & Sons 25,875.00 + bid bond Engineers Estimate $16,100.00 On motion by Councilman Geiger, seconded by Councilman Grable, Council accepted the bidding and awarded the bid for the Tremont Watermain to the lowest bidder, Sound Excavation in the amount of $17,315.00. Bryan Petro, Chairman of Fathoms O' Fun, presented to the City a silver plate won by the Fathoms O'Fun float in the 1992 "Ski to Sea" Grand Parade. Mr. Petro also requested the Council reconsider their motion denying the Fathoms O' Fun carnival on the waterfront parking lot. Sharon McAfee and David Libby, representing citizens of South Kitsap, also urged Council to reconsider the use of the parking lot for the carnival. May 26, 1992 Page Three of Four After much discussion between Councilmembers, staff and those present regarding Fathoms O' Fun request for reconsideration of proposal to locate the carnival in the Waterfront Parking Lot #4, Councilman Geiger moved to allocate revenue received from Waterfront Parking Lot #4 from June 24 - July 4 (up to $2,000) to Fathom 0' Fun to help fund carnival space rental, if they moved to another location (other than Waterfront Parking Lot #4), seconded by Councilman Morrison and carried. Motion passed with 4 ayes and 1 nay. Councilwoman Powers voting nay. Councilman Clauson moved to approve Waterfront Parking Lot #4 as site for the Fathoms 0' Fun carnival from June 24 through July 4, 1992, with the Fathoms O' Fun Committee agreement to (1) fund a minimum of two additional police officers, and (2) provide emergency vehicle access to carnival area to the Fire Chief's satisfaction, seconded by Councilwoman Powers and carried. Motion passed by 4 ayes and 1 nay. Councilman Geiger voting nay. Councilman Morrison abstaining. Mayor Weatherill called for a 10 minute recess with meeting to reconvene at 9:40 PM. Elliott Swanson, representing the Library Board, discussed the potential relocation of the Port Orchard Library to the Givens Community Center. City Planner Davis briefed the Council on Prime Pacific Properties request to dismiss required landscape bond for the Orchard Pointe Apartments located at Lippert and Pottery. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council rescinded requirement that Prime Pacific Properties provide a landscape bond for the Orchard Pointe Apartments located at Lippert and Pottery. City Planner Davis updated the Council on past discussions concerning proposal to amend or rescind the 18 month time limit on land use reclassifications. Councilman Morrison, on behalf of the Growth Management Committee, recommend no change be made and thus no action is necessary. Councilmembers concurred and proceeded with agenda items. On motion by Councilman Geiger, seconded by Councilman Grable, Council moved to administratively approve the wording revisions in the Shoreline Master Plan as recommended by the Department of Ecology and to use the floodway as the jurisdiction limit for the Shoreline Master Plan. On motion by Councilman Geiger, seconded by Councilman Clauson, Council moved to deny request to build a fence in the right-of- way at 1138 Tacoma Avenue. May 26, 1992 Page Four of Four On motion by Councilman Geiger, seconded by Councilman Clauson, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 16921-16977 in the amount of $40,260.38. On motion by Councilman Clauson, seconded by Councilman Grable, Council excused Councilman Morrison from the June 8, 1992 Council meeting. On motion by Councilman Clauson, seconded by Councilmembers Powers and Grable, Council authorized the Mayor to sign supplement FAUS #6 funding for the Bethel Widening Project. on motion by Councilwoman Powers, seconded by Councilman Geiger, Council authorized a change order to add plywood to the shear wall in the new firestation, in the approximate amount of $3,000.00. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council authorized the City Engineer to proceed with repair of the existing culvert at the former landfill. Mayor Weatherill placed into City Hall Facilities Committee, review of City Hall expansion project. On motion by Councilman Morrison, seconded by Councilman Clauson, Council approved Diamond Parking Inc., request to relocate the ingress and egress of the parking lot located on the corner of Lawrence Street and Arnold Avenue to Lawrence Street.
