Council of the City of Port Orchard, Washington, called to regular session by
Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson,
Childress, Morrison, Geiger, Smith and Grable. Staff present: City Attorney
Haberly, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City
Clerk Hower. Councilwoman Powers excused.
Councilman Clauson led the audience and Council in the Pledge of Allegiance.
On motion by Councilman Grable, seconded by Councilman Geiger, Council
approved the minutes of the September 14, 1992 regular meeting as
distributed.
Councilman Geiger authorized the Mayor to sign Transportation improvement
Board contract proposal for design phase of Mitchell Avenue improvement
project at a cost of $60,000.00. Seconded by Councilman Morrison and carried.
Councilman Clauson moved to declare the 1977 Dodge pickup (Public Works
Vehicle #5) as surplus to the needs of the city and authorize disposal of this
vehicle in the best interest of the City, seconded by Councilman Grable.
On motion by Councilman Smith, seconded by Councilmen Geiger and Clauson,
Council amended the motion to surplus 1977 Dodge pickup to include that the
vehicle be offered to South Kitsap High School auto shop.
Council unanimously approved the original motion as amended to declare the
1977 Dodge pickup as surplus to the needs of the City and authorize its
disposal in the best interest of the city, with the South Kitsap High School
auto shop to have first option.
At the request of City Engineer Curles, Councilman Clauson moved to authorize
the City Engineer to draft an Ordinance for council consideration to define
SEPA appeal process, updating SEPA ordinances and establishing a fee
structure, seconded by Councilman Geiger and carried.
City Engineer introduced Jim Longley as the new City Planner. Mr. Longley
started with the City today and will quickly be assuming duties with the
Comprehensive Plan and Growth Management. Mayor and Councilmembers
welcomed him aboard.
On motion by Councilman Smith, seconded by Councilmen Morrison and Grable,
Council approved the Mutual Aid Firefighting Assistance Agreement with
Manchester Fuel Depot and authorized the Mayor to sign agreement documents.
On motion by Councilman Geiger, seconded by Councilman Grable, Council
unanimously approved payment of vouchers as follows: Claims Warrant No.
17611-17671 in the amount of $89,350.79.

At 7:45 PM Mayor Weatherill opened continued Public hearing relevant to
Petition to Vacate a portion of Morton Street as submitted by Robert Ruffner,
et al. LEGAL DESCRIPTION OF PROPOSED VACATION: Situated in Section 26,
Township 24 North, Range 1 East, Kitsap County. The full sixty foot width of
Morton Street which abuts Lots 17 and 18, Block 14 of Sidney 1st Addition and
Lots 1 and 2, Block 10 Sidney 1st Addition.
Engineer Curles reviewed development history of Mr. Ruffner's property at
1010 Coles Lane which is zoned Residential High. A previous owner
constructed a duplex with a basement which is a nonconforming use under RH
zoning. Mr. Ruffner would like to convert the structure to a triplex. An
additional 3,000 sq ft is needed for the duplex to comply with RH zoning
requirements and an additional 6,000 sq ft of land is required for a triplex.
Mr. Curles further defined the parking requirements for multiple housing
units and gave staff recommendations for alternatives to resolve Mr. Ruffner's
situation which include seeking a zone reclassification, variance from parking
standards and acquisition of additional property.
After much discussion between Mr. Ruffner, Councilmembers and staff, Council
continued this public hearing to October 26, 1992 at 7:45 PM to (1) allow Mr.
Ruffner to obtain statements from other petitioners and adjacent property
owners as to their interest or lack of interest in purchasing right-of-way if it
is vacated; and (2) allow staff to research records relevant to the acquisition
of Coles Lane property.
Mayor Weatherill adjorned regular meeting at 8:30 P.M.
