03/25/1991 - Regular - MinutesPort Orchard, Washington March 25, 1991 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson, Morrison, Geiger, Powers, Smith and Grable. Staff present: City Attorney McCluskey, City Planner Davis, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Councilman Childress absent (excused P. 2 par. 8). Councilman Grable led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the minutes of the March 11, 1991, regular Council meeting as circulated. Christina Phelps, 1991 Street Fair Committee Chairman, presented Street Fair plans and logistics. Mrs. Phelps requested closure of Frederick & Sidney Avenues from Bay Street north to the waterfront parking area and Bay Street from Harrison Avenue west to Orchard Avenue on August 3 & 4, 1991. After much discussion, Councilman Morrison moved to refer Street Fair Committee proposal to Street/Ailey Committee for further review and requested Police Chief Mathews contact State Dept. of Transportation regarding potential two day closure of Bay Street (SR160), seconded by Councilman Smith and carried. Mayor Weatherill opened meeting relevant to Notice of Intent to Petition for Annexation into the City of Port Orchard as presented by Richard Granquist for an area lying between SR16 and Sidney Road on the east and west and Hovde Road and Sedgwick Road on the north and south plus a 10 acre parcel situated in the southeast quadrant of the Sedgwick/Sidney intersection. Richard Granquist urged Council to accept petitions for annexation of this' area. Jack Carter, owner of property within proposed annexation boundaries opposed the Granquist Annexation action. Mary Carter, owner of property within proposed annexation boundaries voiced opposition to the Granquist Annexation. On motion by Councilman Powers, seconded by Councilman Grable, Council approved acceptance of petition for annexation for area which consist of all properties west of SR16 to Sidney Road and south from Hovde Road to Sedgwick Road and a ten acre parcel lying in the southeast quadrant of the Sedgwick/Sidney intersection (Granquist Annexation). March 25, 1991 Page Two On motion by Councilman Clauson, seconded by Councilman Grable, Council unanimously approved the City adopting a comprehensive plan and zoning designations as closely related to what the Granquist Annexation area is zoned by Kitsap County at this time. On motion by Councilman Geiger, seconded by Councilman Grable, Council required the assumption of all or any portion of existing City indebtedness by the Granquist Annexation area upon finalization of annexation. James Hall, PO Chamber Circus Committee, submitted application for Circus Permit and requested the City waive permit fee. The Chamber is sponsoring a circus scheduled for June 21, 1991, (2:00 pm and 8 pm) on lot east of South Kitsap Mall. Proceeds will be used for community projects. Councilman Clauson moved to approve issuance of a Circus Permit to PO Chamber Circus Committee for June 21, 1991, seconded by Councilman Smith and carried. Pete Douvis, Puget Sound Bank questioned intent and details of Westbay Lease of city property adjacent to Blackjack Creek. Clerk will provide information to Mr. Douvis. On motion by Councilman Geiger, seconded by Councilman Grable, Council removed from the table, tabled motion to deny request for installation of a spot light on the Library Building Centennial Mural. (Motion by Councilman Geiger, seconded by Councilman Powers) Councilman Geiger withdrew motion, Councilman Powers withdrew second. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 14773-14838 in the amount of $58,935.50. On motion by Councilman Clauson, seconded by Councilman Morrison, Council excused Councilman Childress from this meeting. City Planner Davis reviewed parking problems in area of County administration building and recommended a temporary moratorium on zone reclassification to Public Property and Commercial General designations. After lengthy discussion Councilman Morrison moved to enact a one year moratorium, on all land use reclassifications to Public Property and Commercial General, including the conversion of buildings to government offices within the area between Sroufe and Dwight Streets to the south and north, and between Sidney Avenue and West Avenue to she east and west, seconded by Councilman Grable and carried. March 25, 1991 Page Three On motion by Councilman Clauson, seconded by Councilman Grable, Council authorized Mayor Weatherill to sign Interlocal Drug Task Force Agreement. On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized Mayor Weatherill to sign Interlocal Agreement for Crime Stoppers Program. On motion by Councilman Clauson, seconded by Councilman Grable, Council declared as surplus three vehicles (1) 1980 Chevrolet Malibu, (2) 1980 Chevrolet Malibu, and (3) 1979 Chevrolet Impala authorized the Police Department to dispose of them in the best interest of the City. On motion by Councilman Clauson, seconded by Councilman Grable, Council declared two vehicles, a 1972 Ford LTD & 1968 Ford Pickup, as surplus and authorized the Police Department to dispose of them in the best interest of the City. Monies derived from sale of these two vehicles to be allocated to the SIU Fund. Councilman Clauson moved to authorize the purchase of a VCR from Criminal Justice funds allocated in the 1991 budget for Law Enforcement Training Network (LETN), seconded by Councilman Grable and carried. On motion by Councilman Grable, seconded by Councilman Morrison, Council authorized City Engineer Curles to replace panels, doors and carpet in old police department area. Councilman Morrison moved to authorize Mayor Weatherill to sign FEMA Resolution designating Lawrence J. Curles as the City's authorized representative for obtaining federal and/or state emergency or disaster assistance funds, seconded by Councilman Geiger and carried. On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized City Engineer Curles to replace the Red Barn garage door on Mitchell Avenue. On motion by Councilman Morrison, seconded by Councilman Clauson, Council approved and accepted proposal from Stead & Bagerly to provide telemetry. Councilman Morrison moved to direct staff to commence proceedings to repeal Ordinance No. 922 to rescind action which vacated a portion of Spokane Street, seconded by Councilman Grable and carried. Fire Chief Snow informed Council fire lanes will be established at the Kitsap County Administration complex under POMC 10.60. March 25, 1991 Page Four Councilman Geiger moved to declare an emergency and authorize the Fire Chief to select and purchase a used ladder fire truck at a cost of up to $70,000 (+ tax) contingent upon approval of municipal financing package and directed the City Attorney to draw up the appropriate papers, seconded by Councilman Smith. Councilman Geiger moved to amend motion to grant Mayor Weatherill authority to approve an addition $10,000 (+ tax) if needed to purchase a used ladder fire truck, seconded by Councilman Clauson and carried. Original motion as amended was unanimously approved to declare an emergency and authorize the Fire Chief to select and purchase a used ladder fire truck at a cost of up to $70,000 (+ tax) contingent upon approval of municipal financing package and directed the City Attorney to draw up the appropriate papers, and further authorized Mayor Weatherill to approve an additional $10,000 (+ tax) if needed.
