April 22, 1991
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Smith and Grable.
Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police
Chief Mathews, City Engineer Curles, and Fire Chief Snow. Councilman
Powers excused.
Councilman Smith led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Geiger,
Council approved the minutes of the April 8, 1991, regular Council
meeting as circulated.
On motion by Councilman Clauson, seconded by Councilman Smith,
Council accepted and authorized the issuance of Firework Stand
Permits to the following organizations:
Jim Strode
Lighthouse Building Fund
Port Orchard Lions Club
Rochelle's Fine Fabrics
Plisko Lane/SR 160
Westbay Shopping Center
True Value Parking Lot
S.K. Mall Parking Lot
Deputy Clerk read Proclamation declaring May 5 through 11, 1991 as
Municipal Clerks' Week. On motion by Councilman Clauson, seconded by
Councilman Geiger, Council concurred with Mayor Weatherill declaring
the week of May 5 through May 11, 1991 as Municipal Clerks' Week.
On motion by Councilman Clauson, seconded by Councilman Morrison,
Council approved Ordinance No. 1511 amending Port Orchard Zoning
Ordinance reclassifying property from Residential High to Multiple
Family 20, located at the southeast corner of Pottery Avenue and
Lippert Drive, Prime Pacific Partners, owners of record.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved Ordinance No. 1512 closing the By -Pass Fund and
authorizing transfer of balance of said fund to cumulative reserve
fund for municipal facilities.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council authorized all future monies collected from real estate
excise taxes be placed in the cumulative reserve fund for municipal
facilities.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council adopted Resolution No. 1572 approving the issuance of a
Special Use Permit to Elizabeth Jackson for property located at 614
Dwight Street to allow conversion of a single family home to
professional offices.

Brian Petro, Fathoms 0' Fun, thanked Councilman Grable for his many
hours of work helping to assemble the Fathoms' 0' Fun float in time
for the Daffodil Festival. Mr. Petro advised Council on June 29 and
30, 1991 the Fathoms 0' Festival, will be Utilizing 10 of the Port of
Bremerton Parking spaces and the Port has requested the use of 10
City parking spaces in the Marina Lot.
On motion by Councilman Clauson, seconded by Councilman Geiger,
Council authorized the trade of 10 parking spaces with the Port of
Bremerton during the Fathom's 0' Fun Festival on June 29 and 30,
1991.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council authorized the City Engineer to negotiate a utility easement
across city property in the 900 block of Mitchell Avenue to allow
Bill Gross, Flowers to Go, (871 Bethel Avenue) access to a water
main.
On motion by Councilman Smith, seconded by Councilman Clauson,
Council moved to reduce the water bill at 1010 Bay Street in the
amount of $100.00, as allowed for in the City Port Orchard Water Leak
Policy, with the remainder of the bill to be paid by the property
)wner.
Councilman Morrison, chairman Street/Alley Committee, recommended
denial of request by Dan Barsay for the City to maintain or vacate an
alleyway between the 600 block of Cline and Austin Avenue, seconded
by Councilman Geiger and carried.
Mayor Weatherill called for a 5 minute recess with the meeting to
reconvene at 8:15 PM.
On motion by Councilman Morrison, seconded by Councilman Grable,
Council approved Ordinance No. 1513 establishing procedures to
Petition to Vacate public right of way.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council adopted Resolution No 1573 establishing fees to Petition to
Vacate public right of way.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council excused Councilman Smith from the May 13, 1991 Council
meeting.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of vouchers as follows: Claims
Warrant No. 14930-14992 in the amount of $54,848.60.

On motion by Councilman Geiger, seconded by Councilman Clauson,
Council concurred with the proposed lease of a dump truck from the
Waste Water Treatment Facility, contingent upon approval by the City
Attorney.
On motion by Councilman Morrison, seconded by Councilman Grable,
Council granted permission for City Planner Brad Davis, to attend the
Spring Planning Conference in Wenatchee on May 29 and 30, 1991.
Mayor Weatherill referred Claim for Damages as submitted by Lee
Caldwell in the amount of $69.53 for a plugged sewer main to the
Water/Sewer Committee for review and recommendation.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council declared as surplus (see list - Attachment "A") and
authorized the Fire Department to dispose of them in the best
interest of the City.
Meeting adjourned at 9:12 PM.
