08/26/1991 - Regular - MinutesPort Orchard, Washington August 26, 1991 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Morrison, Geiger, Powers, Smith and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, and Fire Chief Snow. Councilmen Clauson and Childress absent (excused Page 1 par.4). Chief Snow led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the minutes of the August 12, 1991 regular meeting as distributed. On motion by Councilman Morrison, seconded by Councilman Grable, Council excused Councilmen Childress and Clauson from the current meeting. Mayor Weatherill presented a plaque to Stephanie Charbonneau (10 years old) who composed the song "Pretty Port Orchard" which she presented at the July 8, 1991 Council meeting. Pam Lewis, City Solid Waste Representative, updated Council on the City's recycling alternatives regarding cost and method of collection as identified by the Kitsap County Solid Waste Advisory Committee. Mayor Weatherill opened Public Hearing scheduled for 7:45 PM regarding an application for a Special Use Permit as submitted by Betty Lloyd. The proposal is to allow conversion of a single family residence located at 504 Austin Street to professional offices. LEGAL DESCRIPTION: Section 26, Township 24, Range 1 East: Lot 9, Block 5 of S.M. Steven's Town Plat of Sidney, according to Plat recorded in Volume 1, Page 1, records of Kitsap County, Washington. City Engineer Curles briefed Council on the proposed project and read Planning Commission recommendations for approval with 4 conditions. Glen Tanner, attorney representing Betty Lloyd, requested approval and assured Council they will comply with all conditions. Howard Minor, 1400 Bay Street, spoke in favor of the proposed Special Use Permit, and noted this project made the best use of this piece of property. August 26, 1991 Page 2 of 3 Mayor Weatherill called for additional input either for or against the proposed Special Use Permit as submitted by Betty Lloyd. As no further response was received, Mayor Weatherill closed Public Hearing. On motion by Councilman Geiger, seconded by Councilman Smith, Council adopted Planning Commission Resolution No. 169-91 as their own and approved the issuance of a Special Use Permit to Betty Lloyd to allow conversion of a single family residence located at 504 Austin Street to professional offices as submitted by Betty Lloyd with the following conditions: (1) Exterior expansion of the structure is prohibited unless approved the City Council in accordance with conditions imposed by the Zoning Ordinance, Chapter six; (2) advertisement by pole and monument sign is prohibited; (3) basement area shall not be used for office purposes and only as storage space; (4) onsite parking shall not be less than one space for each 400 sq. ft. of gross floor area as calculated by the floor area above the basement. Councilwoman Powers, Public Property Committee Chair, recommended Fur, Fin and Feathers continue renting property from City on a month to month basis until a Lease Agreement can be drawn up. On motion by Councilman Morrison, seconded by Councilman Powers, Council adopted Ordinance No. 1514, amending Ordinance No. 1469 relating to landscape standards for Commercial Development, with an addition to Section H "All planting materials found dead or diseased within one year of installation shall be replaced at the property owners expense." Councilwoman Powers, Public Property Committee Chair, recommended and received concurrence, that the City retain ownership of property located at the northeast corner of Sidney Avenue and Kendall Street intersection for any future development of Givens School. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 15563-15619 in the amount of $60,395.07 and the August payroll Warrant No. 113989-114206 in the amount of $189,113.89. On motion by Councilman Geiger, seconded by Councilman Smith, Council authorized the Mayor to sign Contract with Addendum for the sale of 810 Bay Street to Agape Unlimited. On motion by Councilman Grable, seconded by Councilman Morrison, Council authorized the City Engineer to clean and repaint water reservoir behind Fire Station No. 2 (2051 Sidney Avenue) in the approximate amount of $2,450.00. August 26, 1991 Page 3 of 3 On motion by Councilman Geiger, seconded by Councilman Smith, Council authorized staff to prepare a draft ordinace to amend Ordinance No 647 (Health and Sanitation) to require non- residential units use duricans instead of regular cans. On motion by Councilman Geiger, seconded by Councilman Smith, Council authorized the redesignation of monies from the Fire Department Funds to outfit the new .fire truck.
