09/09/1991 - Regular - MinutesPort Orchard, Washington September 9, 1991 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson, Childress, Morrison, Geiger, Powers, Smith and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, City Treasurer Miller, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. City Engineer Curles led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilwoman Powers, Council approved the minutes of the August 26, 1991 regular meeting as distributed. Mayor Weatherill presented to letter from Dan Mitzel requesting an 18 month extension of zoning for property known as South Kitsap Plaza (1800 SR160). On motion by Councilman Clauson, seconded by Councilwoman Powers, Council tabled, for further review, letter from Dan Mitzel requesting an 18 month extension of zoning for property located at 1800 SR160 (South Kitsap Plaza). Sheldon Parr presented "Journey to Port Orchard" a video promoting Port Orchard and South Kitsap Community. On motion by Councilman Geiger, seconded by Councilman Morrison, Council adopted Resolution No. 1582, repealing Resolution No. 1570 and establishing regulations and fees related to parking, stopping or standing in certain areas of the City. Alice Hill, Shirley Dobbs, Margaret Litch, and Denise Sitz, employees from Myhre's Restaurant, voiced concern for the safety of downtown merchant employees who park in the waterfront parking lot areas. Mayor Weatherill referred matter to Street/Alley Committee for recommendation. On motion by Councilwoman Powers, seconded by Councilman Clauson, Council approved the Utility Extension Agreement between the City of Port Orchard and Tyee Sinclair Partnership. On motion by Councilman Geiger, seconded by Councilman Smith, Council adopted Resolution No. 1583 approving the issuance of a Special Use Permit to Betty Lloyd, allowing property located at 504 Austin Avenue to be converted from a single family residence to professional offices with specific conditions. September 9, 1991 Page 2 City Clerk Hower read Proclamation proclaiming the week of September 17-23, 1991 as Constitution Week. Councilman Clauson moved to concur with Mayor Weatherill declaring the week of September 17-23, 1991 as Constitution Week in the City of Rcrt orchard, seconded by Councilman Grable and carried. City Engineer reported on bid opening held September 5, 1991 at 4:30 PM in regards to the demolition of 240 Tremont as follows: Sound Excavation $ 9,437.00 + bid bond Rhine Demolition 11,970.00 + bid bond William Dickson 16,294.00 + bid bond J. Harper 9,400.00 + bid bond Olsen Land Development 9,470.13 + bid bond On motion by Councilman Smith, seconded by Councilmen Clauson/Grable, Council accepted the bidding and awarded the bid to J. Harper as the lowest bidder, in the amount of $9,400.00. Mayor Weatherill referred to letter from Larry Pappas, owner of Clambake Restaurant, requesting permission to hook-up to City sewer. After much discussion, Councilwoman Powers moved to authorize the City Engineer to negotiate a utility extension agreement with the Clambake Restaurant, seconded by Councilman Geiger and carried. On motion by Councilwoman Powers, seconded by Councilman Geiger, Council authorized city staff to make an offer to purchase property located at 560 Bay Street, based on County Assessor Valuation. On motion by Councilwoman Powers, seconded by Councilman Morrison, Council approved October 26, 1991, as the date for the Council Work Study Retreat. on motion by Councilman Geiger, seconded by Councilman Clauson, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 15620-15694 in the amount of $62,903.02. On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized the staff to write a letter to Southsound Sanitation to seek an amendment of the garbage franchise agreement to provide for the use of DuraKans for commercial accounts. City Treasurer reported on the ULID Water/Sewer Revenue Bonds, noting one tender offer was received. on motion by Councilman Clauson, Council denied the tender offer Bonds. September 9, 1991 Page 3 seconded by Councilwoman Powers, for the ULiD Water/Sewer Revenue on motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized the City Engineer to negotiate with Gelco to continue with the sewer grouting in the Pottery Hill area_ Mayor Weatherill adjourned Council into Executive Session for 20 minutes to discuss annexation litigations.
