11/12/1991 - Regular - MinutesPort Orchard, Washington November 12, 1991 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson, Childress, Morrison, Smith, Powers and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curies, Fire Marshall Wernet and City Clerk Hower. Councilman -Geiger absent (excused page 1 par 3). Councilwoman Powers led the audience and Council in the Pledge of Allegiance. On motion by Councilman Clauson, seconded by Councilman Grable, Council excused Councilman Geiger from this Council meeting. On motion by Councilman Grable, seconded by Councilman Morrison, Council approved the minutes of the October 28, 1991 regular meeting as distributed. On motion by Councilman Clauson, seconded by Councilman Grable, Council approved Ordinance No. 1529 fixing the amount of Ad Valorem taxes to be raised for the year 1992. On motion by Councilman Grable, seconded by Councilman Smith, Council rescheduled the 8:00 PM meeting with EJ & Shirley Bourdeau to discuss their Notice of Intent to Petition for Annexation to November 25, 1991 at 7:45 PM. The Notice of Intent includes two tax parcels located west of the city limits and north of SR 14 commonly known as SR160. On motion by Councilman Smith, seconded by Councilman Morrison, Council authorized the City Engineer to prepare a draft short plat ordinance. On motion by Councilman Smith, seconded by Councilman Grable, Council authorized the City Clerk hire Marven Parks as census enumerator for the Vine Street Annexation. At 7:45 PM Mayor Weatherill opened Public Hearing regarding a Petition to Vacate a portion of Bayview Street (Division Street) as submitted by Sunset Lane Cemetery. LEGAL DESCRIPTION: All that portion of Fir Street lying between Blocks 9 and 10, of the Plat of Wheeler's Addition to Sidney as per recorded Plat filed in Volume 1 page 61 of Plats record of Kitsap County, Washington, extending South from the North line of Lot 6, Block 9 of said Plat of Wheeler's Addition to the South line of Bayview Street (Division Street) as shown on the recorded Plat of Tom Cline's Addition to Sidney filed in Volume 1, page 29 of Plats. All that portion of Bayview Street (Division Street) in said Plat of November 12, 1991 Page Two of Three Wheeler's Addition to Sidney, lying East of the West line of Block 9 and West of the East line of Lot 13, Block 9 of said Plat of Wheeler's Addition. Also all that portion of Bayview Street (Division Street) in said Plat of Tom Cline's Addition to Sidney, lying East of the West line of Block 9 of said Wheeler's Addition to Sidney and West of the East line of Lot 1 of Block 2 of Tom Cline's Addition to Sidney. City Engineer gave staff report on requested vacation and outlined the proposed area on an aerial map. Sill Rill, representing Sunset Lane Cemetery, availed himself to answer questions from the Council. Mayor Weatherill called for additional pubic input either for or against the proposed street vacation as submitted by Sunset Lane Cemetery. As no response was received Mayor Weatherill closed Public Hearing and referred matter to Council for consideration . On motion by Councilman Clauson, seconded by Councilmen Grable and Smith, Council approved the Petition to Vacate a portion of Bayview Street (Division Street) as submitted by Sunset Lane Cemetery. On motion by Councilman Clauson, seconded by Councilman Grable, Council unanimously approved payment of vouchers as follows: Claims Warrant No. 15918-16008 in the amount of $78,458.77. Mayor Weatherill called for a 14 minute recess with meeting to reconvene at 8:30 PM. Mayor Weatherill opened Public Hearing scheduled for 8:30 PM regarding a Petition to Vacate a portion of Rockwell Avenue as submitted by Albert C. and Helen E. Kleffner. LEGAL DESCRIPTION: That portion of Rockwell Avenue fronting Lots 22 to 27 inclusive, and fronting the south 2 feet of Lot 28 in Block 5 of the Plat of Sweany's 2nd Addition to Sidney, per plat recorded in Vol. 2 of Plats on Page 18, records of Kitsap County, Washington and situated within the corporate limits of the City of Port Orchard. City Engineer gave staff report outlining the proposed vacation area on an aerial map and challenged value of subject property presented by petitioners. Helen Kleffner advised Council the reason they had petitioned for vacation of this alleyway, was that during the process of selling their property, it became apparent that structures were situated within the city right of way. As a condition of sale they were to petition to vacate the subject property to clear the title. November 12, 1991 Page Three of Three Tim Roller, speaking on behalf of his mother Ruby Roller who owns property south of Kleffners, expressed concern that surveys of this area show conflicting property boundaries and stated it appears that a portion of the property proposed for vacation is on his mother's side of the fence and has historically been considered her property. Sandy and John O'Donnell (purchasers) agreed to amend boundary of requested vacation to the wire fence line (lot 22) and not extend the vacation through the Roller property. Faye McCree, daughter of Mr. & Mrs. Kleffner, advocated approval of this petition describing the stress her parents and Mrs. Roller have experienced due to conflicting surveys, property line problems and the clouded land title. Mayor Weatherill called for additional pubic input either for or against the proposed street vacation as submitted by Helen and Albert Kleffner. As no response was received Mayor Weatherill closed the Public Hearing and referred matter to Council for consideration. On motion by Councilwoman Powers, seconded by Councilman Clauson, Council approved Helen and Albert Kleffner's Petition to Vacate a portion of Rockwell Avenue with amended boundary starting at the wire fence line of lot 22 to the northern line of lots 27 and Council further instructed the City Engineer to review appraisal documents and negotiate with petitioners to determine a price for the proposed vacation. Mayor Weatherill called for a 4 minute recess with meeting to reconvene at 9:20 PM. On motion by Councilman Smith, seconded by Councilman Grabie, Council authorized the City Engineer to hire Norm Olson and Tom Herstad to prepare the construction drawings for the new fire station at 200 Tremont, with the cost not to exceed $8,000.00.
