November 25, 1991
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Council
members present: Clauson, Childress, Morrison, Geiger, Powers,
Smith and Grable. Staff present: City Attorney McCluskey,
Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles,
Fire Chief Snow and City Clerk Hower.
Chief Mathews led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Powers,
Council approved the minutes of the November 12, 1991 regular
meeting as distributed.
Mim Heuss, Bremerton/Kitsap Co. Visitor and Convention Bureau,
presented a brochure on where the City Hotel/Motel Tax dollars
are being spent and how they will be used in the 1992 budget.
Margie Gissberg, speaking on behalf of Paulie Williams, expressed
concern regarding increased traffic speeds and lack of street
lights on Prospect Street Alley east of Sidney Avenue. Mayor
Weatherill referred this matter to Street/Alley Committee for
review.
Bill Rill, representing Pendleton -Gilchrist Funeral Home,
requested a 6 month extension on Special Use Permit No. 1054 for
property located at 1151 Mitchell Avenue.
On motion by Councilman Grable, seconded by Councilman Clauson,
Council approved a 6 month extension on Special Use Permit No.
1054 for property located at 1151 Mitchell Avenue.
At 7:45 PM Mayor Weatherill introduced Notice of Intent to
Petition for Annexation as submitted by EJ and Shirley Bourdeau
for property west of city limits and north of SR160. LEGAL
DESCRIPTION: Parcel "A" All the portion of the West 375 feet of
Government Lot 1, Section 26, Township 24 North, Range 1 E,ast,
Willamette Meridian, lying northerly of County Road; together
with Lots 1 through 11, inclusive,'Block 1, Sidney Tidelands
situate in front of, adjacent to or abutting thereon; situate in
Kitsap County, Washington. Parcel "B" That portion of the East
150 feet of the West 525 feet of Government Lot 1, Section 26,
Township 24 North, Range 1 East, Willamette Meridian, Lying North
of State Highway No. 14; together with tidelands as conveyed by
the State of Washington, situate in front of, adjacent to and
abutting thereon; situate in Kitsap County, Washington.
Jay Bourdeau, petitioner, spoke concerning the annexation and
availed himself to answer questions from the Council.

On motion by Councilman Clauson, seconded by Councilman Geiger,
Council approved acceptance of petition for Annexation into the
City of Port Orchard as presented by EJ and Shirley Bourdeau.
on motion by Councilwoman Powers, seconded by Councilman Geiger,
Council required the simultaneous adoption of a Comprehensive
Plan Designation for property as described.
on motion by Councilwoman Powers, seconded by Councilman Geiger,
Council required all properties included in the proposed EJ and
Shirley Bourdeau Annexation assume their share of existing city
indebtedness upon annexation.
Marven Parks spoke to council concerning the school bus exit at
the high school on Mitchell Avenue.
Mayor Weatherill directed Police Chief Mathews to contact the Dr.
Gower, superintendent of South Kitsap School District, and try to
develop a solution to the traffic problems on Mitchell Avenue
regarding the school bus exits.
On motion by Councilwoman Powers, seconded by Councilman Geiger,
Council approved ordinance No. 1530 vacating a portion of
Rockwell Avenue as submitted by Albert and Helen Kleffner,
contingent upon legal description being approved by City Attorney
and City Engineer.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council approved ordinance No. 1531 vacating a portion of Fir
Street and a portion of Bayview Street (Division Street). LEGAL
DESCRiPT[ON: All that portion of Fir Street lying between Blocks
9 and 10, of the Plat of Wheeler's Addition to Sidney as per
recorded Plat filed in Volume 1 page 61 of Plats record of Kitsap
County, Washington, extending South from the North line of Lot 6,
Block 9 of said Plat of Wheeler's Addition to the South line of
Bayview Street (Division Street) as shown on the recorded Plat of
Tom Cline's Addition to Sidney filed in Volume 1, page 29 of
Plats. All that portion of Bayview Street (Division Street) in
said Plat of Wheeler's Addition to Sidney, lying East of the West
line of Block 9 and West of the East line of Lot 13, Block 9 of
said Plat of Wheeler's Addition. Also all that portion of
Bayview Street (Division Street) in said Plat of Tom Cline's
Addition to Sidney, lying East of the West line of Block 9 of
said Wheeler's Addition to Sidney and West of the East line of
Lot 1 of Block 2 of Tom Cline's Addition to Sidney.

On motion by Councilman Geiger, seconded by Councilman Clauson,
Council authorized the compensation received from the Rockwell
Avenue street vacation (Albert and Helen Kleffner) and the street
vacation submitted by Sunset Lane Cemetery (portion of Fir Street
and a portion of Bayview Street) be redistributed from Street
Fund to the Designated Unreserved Fund Balance for Parks.
Councilman Morrison moved to approved Ordinance No. 1532
regulating signs in the street right of way, seconded by
Councilman Clauson.
Councilman Morrison moved to amend motion to add two additional
conditions: (1) sign boards need to be removed nightly (2)
businesses that place a sign board on the sidewalk need to
include the city as additional insured, seconded by Councilman
Clauson. Amended motion passed with 4 ayes and 3 nayes.
Councilmen Grable, Smith and Childress voting nay.
Councilwoman Powers moved to table Ordinance No. 1532 regulating
signs in the street right of way for further review, seconded by
Councilman Grable and carried. Motion passed with 6 ayes and 1
nay. Councilman Clauson voting nay.
Mayor Weatherill requested Council's concurrence with the
appointment of Rick Wyatt to the Port Orchard Planning
Commission. Mr. Wyatt is filling an unexpired term which will
expire on December 31, 1992.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council concurred with Mayor Weatherili's appointment of Rick
Wyatt to the Port Orchard Planning Commission.
On motion by Councilman Morrison, seconded by Councilman Grable,
Council rejected Claim for Damages as submitted by William
Vincent Wiley and instructed the City Clerk to refer this claim
to the city's insurance carrier.
Mayor Weatherill recommended December 9, 1991 at 7:45 PM as date
and time for a meeting with Russell.and Kathleen Allaway, to
discuss Notice of Intent to Petition for Annexation.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council unanimously approved payment of vouchers as follows:
Claims Warrant No. 16009-16063 in the amount of $24,723.86 and
the November 1991 Payroll Warrant No. 114515-114663 in the amount
of $136,268.86.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved Ordinance No. 1533 amending Ordinance No. 1527
and establishing a rate of compensation for City Council Members.

on motion by Councilman Clauson, seconded by Councilman Morrison,
Council authorized the Mayor to sign contract with Fish Pro, in
an amount not to exceed $10,000.00, to begin technical work on
Ross Creek, subject to approval by City Engineer and Department
of Ecology.
On motion by Councilman Morrison, seconded by Councilman Clauson,
Council authorized the City Engineer to: (1) assign the City
Attorney's office the task of resolving the right of way
confusion between Sidney Avenue and the Port Orchard Boulevard;
(2) hire Ward Muller to survey the area; (3) hire Richards and
Associates to do the required appraisals of the right of way in
question.
Mayor Weatherill referred to Street/Alley Committee request from
Richard L. Peterson, permission to lease a portion of Austin
street for employee parking.
