January 22, 1990
Council of the City of Port Orchard, Washington called to regular session by
Mayor Weatherill at 7:30 PM. Councilmembers present: Clauson, Childress,
Morrison, Geiger, Powers, Smith and Grable. Staff present: City Attorney
McCluskey, Deputy Clerk Thomas, City Treasurer Miller, Police Chief Mathews,
City Engineer Curles, Fire Chief Snow and City Clerk Hower.
At the request of Mayor Weatherill, Councilman Morrison led the audience and
Council in the Pledge of Allegiance.
Councilman Grable moved to approve the minutes of the January 8, 1990 meeting
as circulated, seconded by Councilman Geiger and carried.
Economic Development Council, President Earl Smith, Chairman Ray White and
Blaine Highfield, updated Council on EDC activities and future plans. They
encouraged the City to join the EDC at an annual cost of $1,000.00.
Mayor Weatherill opened Public Hearing scheduled for 7:45 PM to receive input
on application for a Special Use Permit as submitted by the Bethany Lutheran
Church to allow the construction of a church and sanctuary in the northwest
corner of Tremont Street and Port Orchard Boulevard, (Rylanders Addition to
Port Orchard).
Engineer Curles updated Council on the current zoning of the property and
outlined the Planning Commission recommendations.
Mel Holgerson, Civil Engineer, representing the Bethany Lutheran Church, spoke
concerning traffic flow in the area and availed himself to answer questions.
Mayor Weatherill called for additional public input. As no response was
received Mayor Weatherill closed Public Hearing and referred matter to Council
for consideration.
Councilman Geiger moved to adopt Planning Commission Resolution No. 138-89 as
their own and approve issuance of a Special Use Permit to the Bethany Lutheran
Church for the construction of a church and sanctuary in the northwest corner
of Tremont Street and Port Orchard Boulevard (Rylanders Addition to Port
Orchard), seconded by Councilman Grable.
Councilman Geiger moved to reopen Public Hearing for further testimony,
seconded by Councilman Grable and carried.
Pastor Bryant, Bethany Lutheran Church, advised Council the operation time of
the school and church are flexible and can be changed if there is a conflict
with traffic flow on Tremont.
Mayor Weatherill called for further input either for or against the proposed
Special Use Permit as submitted by the Bethany Lutheran Church, as no response
was received, Mayor Weatherill closed Public Hearing.

Council unanimously approved, original motion as presented by Councilman
Geiger, seconded by Councilman Grable to adopt Planning Commission Resolution
No. 138-89 as their own and approve issuance of a Special Use Permit to
Bethany Lutheran Church for the construction of a church and sanctuary in the
northwest corner of Tremont Street and Port Orchard Boulevard (Rylanders
Addition to Port Orchard). LEGAL DESCRIPTION: Section 36, Township 24 N,
Range 1 E, Rylanders Addition to Port Orchard.
Win Granlund, Kitsap County Commissioner, presented a video on law and justice
costs in the State of Washington. Commissioner Granlund urged the Council and
audience to call local legislators to urge support of law and justice issues
during the current legislative session.
At 8:47 PM Mayor Weatherill declared a 5 minute recess.
Councilman Geiger read letter from Kurtis Mayer requesting a waiver from in
lieu of assessment fees for new construction at Orchard on the Green
Apartments.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council moved
to deny request to waive the fees in lieu of assessment for new construction
at Orchard on the Green Apartments. The fees in question are considered late
comer fees for previous water and sewer LID's and this particular piece of
property has not previously participated in a LID.
Councilman Clauson moved to accept Claim for Damages as submitted by John
Henry Page in the amount of $500.00 for lost and/or misplaced jail bail,
seconded by Councilman Smith.
Councilman Geiger moved to amend motion to submit Claim for Damages to
insurance carrier, seconded by Councilman Grable and carried.
Council approved, original motion as amended to accept Claim for Damages as
submitted by John Henry Page in the amount of $500.00 for lost and/or
misplaced jail bail and to submit to insurance carrier.
City Clerk Hower reported on bid opening held November 27, 1989 for computer
hardware and application software for the Administrative Offices and one
workstation for Police Department. Three bids were received as follows with
the necessary Performance Bonds attached:
Eden Systems/Business Pro Computer $56,825.00
Syntax/Diversified System Consultants 65,817.00
IBM/Far West Data Control 73,338.00

On recommendation from the Computer Review Committee, Councilman Clauson moved
to award the computer hardware and application software bid to the lowest
bidder Eden Systems/Business Pro Computer in the amount of $56,825.00 and
authorized the purchase of an additional workstation (for a total of two
workstations) for the Police Department, if budget allocation allows, seconded
by Councilmen Grable/Morrison and carried.
Lorraine Davidson, questioned Council on the status of her property being
vacated by the City. City Engineer Curles advised Ms. Davidson and Council
the City is waiting for a legal description of the property in question.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council
accepted, from Colonel and Mrs. Brady a donation of property located north of
206 Mitchell Avenue with the City paying for a title search on the property.
Tax Account No. 252401-3-035-2001
Vouchers audited and certified by the auditing officer (City Clerk) as
required by RCW 42.24.080 and those expense reimbursement claims certified as
required by RCW 42.24.090 have been recorded on a listing and made available
to the Council.
Councilman Geiger moved to approve payment of those vouchers in the amount of
$166,672.36 as presented by the City Clerk, seconded by Councilman Clauson.
Councilman Clauson moved to amend motion to reject voucher to Unisys for the
maintenance on the Burroughs B92 computer in the amount of $11,726.53 and
voucher to Syntax User's Group for the hardware maintenance on the Police
Department Computer in the amount of $1,150.00, seconded by Councilman Grable.
Council approved, original motion as amended to approve payment of Claim
Warrant No. 12854-12901 in the amount of $153,795.83 with claim vouchers
denied to Unisys for the maintenance on the Burroughs B92 computer in the
amount of 511,726.53 and Syntax User's Group for the hardware maintenance on
the Police Department Computer in the amount of $1,150.00.
City Engineer Curles reported on the consultant selection process for the
Coastal Zone Management Wetlands Inventory.
On motion by Councilman Geiger, seconded by Councilman Grable, Council
concurred with the City Engineer's recommendation and selected Fish Pro as the
consultant for the Coastal Zone Management Wetlands Inventory project.
On motion by Councilman Morrison, seconded by Councilman Clauson, Council
moved to proceed with the production of a 5 minute "City Video Program" in
conjuction with Olympic Cablevision.
City Engineer Curles reported on three proposals received for upgrading the
electrical system for Well No. 6. as follows:

On motion by Councilman Grable, seconded by Councilman Smith, Council
concurred with recommendation by the City Engineer and accepted proposal from
Ahearn Electric in the amount of $2,999.00 for the upgrading the electrical
system for Well No. 6.
