Council meeting held August 13, 2001.

AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
ADDING A NEW SECTION 5.28.025 TO THE PORT ORCHARD
MUNICIPAL CODE PROHIBITING HOUSE-BANKED SOCIAL CARD
GAMES WITHIN THE CITY LIMITS.
Copies of Ordinance No. 1825 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1825 will be
provided at a nominal charge.

WHEREAS, RCW 9.46.295 states that cities and counties may absolutely prohibit any or
all of the gambling activities authorized by state law; and
WHEREAS, the City Council deems it in the public interest and welfare to prohibit certain
social card games as defined in RCW 9.46.0282, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 5.28.025 of the Port Orchard Municipal Code is hereby added to
read as follows:
5.28.025 House-Banked Social Card Games Prohibited. The
city, in accordance with RCW 9.46.295 as amended, prohibits the conduct
or operation of house-banked social card games as a commercial
stimulant, as defined in RCW 9.46.0217 and RCW 9.46.0282, provided,
house-banked social card games lawfully operating as of the effective date
of this ordinance may continue to operate in accordance with the
provisions of RCW 9.46 and the rules adopted thereunder until September
1, 2004; and further provided that this section shall not apply to social card
games conducted or operated by a bona fide charitable or nonprofit
organization pursuant to RCW 9.46.031 1.
SECTION 2. The moratorium established pursuant to Ordinance No. 1822 is repealed
as of the effective date of this ordinance.
SECTION 3. If any section, sentence, clause or phrase of this ordinance should be held
to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this
ordinance.
SECTION 4. This Ordinance shall be in full force and effect five (5) days afler its
passage, approval, posting and publication as provided by law. A summary of this ordinance may be
published in lieu of the entire ordinance, in its entirety.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
