Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Powers, Smith and
Grable. Staff present: City Attorney Haberly, Deputy Clerk
Thomas, City Treasurer Miller, Police Chief Mathews, City Engineer
Curles, Fire Chief Snow and City Clerk Hower.
Councilman Powers led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Powers,
Council approved the minutes of the April 23, 1990 meeting as
circulated.
Shawn Kimball, South Kitsap D.J., requested permission to hold a
public street dance following Fathoms 0' Fun Festival Parade.
Mayor Weatherill requested Mr. Kimball to work with Patty Olson,
Director of Fathoms 0' Fun, Fire Chief Snow and Police Chief
Mathews to coordinate this event and return to the next Council
meeting for review.
Sharon King, President Port Orchard Centennial Committee, requested
permission to paint commemorative mural on west wall of the Library
at 87 Sidney Avenue and sought financial support for mural project.
Councilman Clauson moved to approve request by the Port Orchard
Centennial Committee to paint a mural to commemorate Port Orchard"s
100th Birthday on the west wall of the Library at 87 Sidney Avenue,
seconded by Councilman Morrison.
Councilman Powers moved to amend motion to approve mural painting
on Library wall subject to City Council approval of pictorial
scene, seconded by Councilman Grable and carried.
Council unanimously approved the original motion as amended
authorizing the Port Orchard Centennial Committee to paint a mural,
to commemorate Port Orchard's 100th Birthday, on the west wall of
the Library at 87 Sidney Avenue, subject to City Council approval
of pictorial scene.
Mayor Weatherill presented letter from Deborah Leabo regarding
recycling in Kitsap County. Council concurred with Ms. Leabo's
concerns.
At 7:45 PM Mayor Weatherill opened Public Hearing to receive input
on application for a Special Use Permit as submitted by Bethany
Lutheran Church, 715 & 717 Sidney Avenue. LEGAL DESCRIPTION:
Section 26, Township 24N, Range 1E, Portion of the SE 1/4 of the SE
1/4; Beginning at a point 403 feet south and 30 feet east of the NW

corner of the SW 1/4, SW 1/4; thence south 125 feet, east 72 feet,
north 125 feet and west 72 feet to the point of beginning. Also
Lots 1 and 2 of Wheelers 3rd Addition to Sidney.
Councilman Powers advised Council and audience that she owns
property within 300' of proposed project and asked if anyone
objected to her sitting on council table. No objection was
received from Council or audience.
City Engineer Curles reviewed project proposed by Bethany Lutheran
Church and reported on Planning Commission recommendations.
Renee LaMarsh, 6615 Sunnyslâť‘pe Rd SW, Co -Petitioner with Bethany
Lutheran Church, presented site drawings of the proposed project
and a petition from property owners who support issuance of the
Special Use Permit at 715 & 717 Sidney Avenue. Mr. LaMarsh
requested no parking be allowed on Sidney Avenue in front of school
along fence line.
Paul Powers, 825 Ada Street, expressed concern about increased
traffic and parking problems in area if this project is allowed as
presented.
Mayor Weatherill called for further input either for or against the
proposed Special Use Permit as sumbitted by the Bethany Lutheran
Church, as no response was received, Mayor Weatherill closed Publ.ic
Hearing.
Councilman Clauson moved to adopt Planning Commission Resolution
No. 145-90 as their own and approve issuance of a Special Use
Permit to the Bethany Lutheran Church to allow professional offices
in a residential area (715 & 717 Sidney Avenue), with the following
conditions: (1) The property lines along new driveway and parking
lot be screened with landscaping, such as a laurel hedge; (2) All
handicapped spaces be installed as provided by State standards; (3)
The parking plan be modified to show correct dimensions and become
site plan specific. Parking cannot be decreased with City Council
approval; (4) Any parking lot lighting installed be shielded to
reduce glare to the neighbors; (5) The former church building be
structurally inspected prior to its conversion to offices, seconded
by Councilman Smith.
Councilman Powers moved to amend motion to allow right in and right
out turns only, on Sidney Avenue, south of the sanctuary building
and right in turns only, on Sidney Avenue, by the school building,
seconded by Councilman Grable. Amended motion passed with 6 ayes
and 1 nay, Councilman Smith voting nay.
Councilman Morrison moved to amend amended motion to designate one

Mayor Weatherill opened Public Nearing scheduled for 8:00 PM to
review proposed expansion of Blessed Margaret Catholic Church
located at 1255 Pottery Avenue. LEGAL DESCRIPTION: Section 35,
Township 24N, Range 1E, the West half of the Northwest Quarter of
the Southwest Quarter of the Northwest Quarter of Section 35,
Township 24N, Range 1 East, W.M., in Kitsap County, Washington:
Except the North 210 feet; and Except the West 15 feet from County
Road No. 76.
Mayor Weatherill called for public input either for or against the
proposed expansion of Blessed Margaaret Catholic Church located at
1255 Pottery Avenue.
Bishop Aylward, proponent, availed himself to answer questions from
the Council.
Gloria Jean Church, member of Blessed Margaret Catholic Church,
advised Council of the growth of the congregation and the need for
expansion.
Mayor Weatherill called for additional public input. As no
response was received Mayor Weatherill closed Public Nearing and
referred matter to Council for consideration.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council adopted Planning Commission Resolution No. 144-90 as their
own and approved the expansion of Blessed Margaret Catholic Church
located at 1255 Pottery Avenue.
At 9:15 PM Mayor Weatherill declared a 5 minute recess.

Mayor Weatherill opened Public Hearing scheduled for 8:15 PM
regarding an appeal to Planning Commission approval of Variance to
Doug Eide allowing front yard setback requirement from 15 feet to
within 5 feet of the DeKalb Street right of way located at 528-534
DeKalb Street.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council continued the Public Hearing regarding appeal (filed by
Marty M. McMurray) to Planning Commission approval of a variance
allowing reduction of front yard setback requirements at 528-534
DeKalb Street until Tuesday, May 29, 1990 at 8:15 PM.
Mayor Weatherill opened Public Hearing scheduled for 8:30 PM
regarding an application for a Zone Reclassification from
Residential -High to Multiple -Family 20 as submitted by Doug Eide to
allow construction of eleven dual level condominiums with garages
at 528-534 DeKalb Street.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council continued the Public Hearing regarding an application for a
Zone Reclassification from Residential -High to Multiple -Family 20
as submitted by Doug Eide to allow construction of eleven dual
level condominiums with garages at 528-534 DeKalb Street until
Tuesday, May 29, 1990 at 8:30 PM.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council adopted Resolution No. 1537 repealing Resolution No. 1519
establishing regulations and fees related to parking, stopping or
standing in certain areas of the City. (Reflected change is to
Section 4 which deletes Wednesday morning parking restrictions on
Frederick Street.)
On motion by Councilman Geiger, seconded by Councilman Smith,
Council adopted Resolution No. 1536 approving the issuance of a
Special Use Permit to Paul and Donna Buettgenbach with conditions.
The Special Use Permit was requested to allow an open storage
yard. LEGAL DESCRIPTION: Section 25, Township 24 North, Range 1
East, Wheelers Addition to Sidney, Block 4, Lots 3 and 4.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council concurred with Mayor Weatherill declaring September 14-16,
1990 as Mosquito Fleet days.
Councilman Geiger, Chairman Water/Sewer Committee, moved to grant a
$100.00 credit adjustment (as specified in the City's current water
leak policy, Resolution No. 1469) to Anita Sanford for water/sewer
bill at 1105 Spokane, seconded by Councilman Powers and carried.
On motion by Councilman Powers, seconded by Councilman Clauson,
Council authorized the Mayor to sign lease agreement between the
City and Brem-Air Disposal for city property on Old Clifton Road.

On motion by Councilman Clauson, seconded by Councilman Grable,
Council authorized the City Attorney to draw up a Hold Harmless
Agreement for the Mayor to sign releasing James Barton from any
liabilities which may be incurred by Police Department use of his
bicycle.
On motion by Councilman Clauson, seconded by Councilman Childress,
Council authorized the City Engineer to proceed with advertising
for the DeKalb Pier extension project.
On motion by Councilman Clauson, seconded by Councilman Morrison,
Council authorized the Mayor to sign agreement with CM3 Associates
for designing a brochure on the dangers and hazards of putting oils
down catch basins.
On motion by Councilman Powers, seconded by Councilman Clauson,
Council authorized the purchase of a radio for Public Works station
wagon with funds derived from the sidewalk construction monies and
the purchase of a Fax Machine with funds derived from the
Water -Sewer Fund.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council scheduled a study session for May 23, 1990 at 7:30 PM
regarding Puget Sound Council of Governments Vision 20/20.
On motion by Councilman Clauson, seconded by Councilman Childress,
Council authorized for the month of June 1990 that parking ticket
recipients will be offered the option to ride Kitsap Transit buses
for 5 days in lieu of paying the $5.00 parking fine.
On motion by Councilman Geiger, seconded by Councilman Smith,
Council approved payment of expenses for any City Official to
attend the AWC Convention in Wenatchee, June 12 - 15, 1990.
Vouchers audited and certified by the auditing officer (City Clerk)
as required by RCW 42.24.080 and those expense reimbursement claims
certified as required by RCW 42.24.090 have been recorded on a
listing and made available to the Council.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council unanimously approved payment of those vouchers as follows:
Claims Warrant No. 13283-13381 in the amount of $68,897.65 and
April 1990 Payroll in the amount of $110,569.93 (Warrant No.
111716-111824).
Mayor Weatherill recessed Council into executive session to discuss
City property.
