07/23/1990 - Regular - MinutesPort Orchard, Washington July 23, 1990 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Childress, Morrison, Geiger, Powers and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Eire Chief Snow and City Clerk Hower. Councilman Smith excused and Councilman Clauson absent. (Councilman Clauson excused on page 3, paragraph 2.) Councilman Morrison led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the minutes of the July 9, 1990 meeting as circulated. Doris Small, Department of Fisheries, advised Council of their new local office at 502 High Street, Suite 207 and updated Council on fisheries and storm water regulations for Port Orchard area. City Clerk Hower read letter from Win Granlund, Kitsap County Commissioner regarding County's proposal to relocate the law library in a modular unit within Division Street right of way. Councilman Morrison moved to deny request to relocate County law library in a modular unit within Division Street right of way, seconded by Councilman Grable and carried. Motion passed with 3 ayes and 2 nays. Councilmen Grable and Powers voting nay. On motion by Councilman Geiger, seconded by Councilman Powers, Council moved to set August 6, 1990 at 8:00 PM as date and time for a special meeting to discuss the Notice of Intent to Petition for Annexation into the City as submitted by Herbert E. Loop, et al for property commonly known as Ross Point area. City Clerk reported on bid opening held July 19, 1990 for the Morton Street Water Reservoir. Three bids were received with the required bid bond as follows: Hole Boring and Tank Co. $120,060.00 United Steel 166,186.20 Morse Construction Group 164,709.00 Engineers Estimate $131,000.00 On motion by Councilman Powers, seconded by Councilman Grable, Council accepted the bidding and awarded the bid for the Morton Street Water Reservoir to the lowest bidder, Hole Boring and Tank Co. in the amount of $120,060.00. July 23, 1990 Page Two On motion by Councilman Geiger, seconded by Councilman Grable, Council authorized Northwest Steam Society to block off 4 parking spaces near the Totem Pole on August 4 and 5, 1990. At 7:55 Mayor Weatherill declared a 5 minutes recess. At 8:00 PM Mayor Weatherill reopened Public Hearing and called for input relevant to a Petition to Vacate a portion of an unnamed alley way between Mitchell and Bethel Avenues (700 block) as submitted by G. Bud Buckley on behalf of Dr. Browning, et al. LEGAL DESCRIPTION: Situated in Section 25, Township 24 North, Range 1 East, Kitsap County. That portion of an unnamed alley which abuts Lots 13, 14, 15, 16, 17 and 18 of Block 1 of Tom Cline's Addition to Sidney as recorded in Volume 1 of Plats, Page 29, in Kitsap County, Washington; together with that portion of the said alley which extends 30 feet southerly to the centerline of vacated Taylor (Central) Street. City Clerk Hower advised Council of the location and current status of the proposed street vacation. Bud Buckley, representing Dr. Browning, et al, spoke in favor of the proposed vacation and answered questions from the Council. After discussion Mayor Weatherill called for additional comments or testimony from those present. As no response was received Mayor Weatherill closed Public Hearing and referred matter to Council for consideration. On motion by Councilman Powers, seconded by Councilman Geiger, Council approved Petition to Vacate a portion of an unnamed alley way between Mitchell and Bethel Avenues (700 block) as submitted by G. Bud Buckely on behalf of Dr. Browning, et al. Compensation received from this Vacation to be redistributed from Street Fund to the Designated Unreserved Fund Balance for Parks. On motion by Councilman Morrison, seconded by Councilman Grable, Council approved request by the Centennial Committee to allow Company M set up a vintage military encampment in the Marina Park and the east waterfront parking lot area on September 14 and 15, 1990 for the Centennial Celebration. Centennial Committee must obtain permission from the Port of Bremerton to use the Marina Park area. Nancy Hess, President Farmers Market, presented signed petitions and letters which she obtained from Port Orchard Merchants, regarding the proposed extension of the Farmers Market hours. After discussion it was recommended that the Street/Alley Committee meet with the Farmers Market to further review extending the hours and relocation of the Farmer's Market. July 23, 1990 Page Three On motion by Councilman Powers, seconded by Councilman Morrison, Council excused Councilman Grable from the August 13, 1990 Council meeting. On motion by Councilman Geiger, seconded by Councilman Grable, Council excused Councilman Clauson from the July 23, 1990 Council meeting. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 13654-13703 in the amount of $31,491.44. On motion by Councilman Geiger, seconded by Councilman Powers, Council waived the Fees in Lieu of Assessments for Division 2 and 3 of Cedar Canyon Estates. Councilman Childress refrained from voting due to a conflict of interest. On motion by Councilman Powers, seconded by Councilman Morrison, Council authorized the City Engineer to schedule a Public Hearing and prepare an ordinance for Council consideration regarding proposed amendments to the Port Orchard Building Codes. On motion by Councilman Grable, seconded by Councilman Morrison, Council authorized the City Engineer to negotiate a contract with Bovay Northwest, Inc., for the design of four guardrails as funded by the Washington State Department of Transportation. Mayor Weatherill adjourned Council into Executive Session for 45 minutes to discuss an Interlocal Agreement. Meeting adjourned at 10:30 PM. CLERK f MAYOR
