September 24, 1990
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Childress, Geiger, Powers, Smith and Grable.
Councilman Morrison excused. Staff present: City Attorney
McCluskey, Deputy Clerk Thomas, City Treasurer Miller, Police Chief
Mathews, City Engineer Curles and Fire Chief Snow.
Councilman Smith led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Clauson,
Council approved the minutes of the September 10, 1990 meeting as
circulated.
Ron Henshaw, representing Northwest Mosquito Fleet Days, thanked
City for sponsorship and support of the 1990 Mosquito Fleet Days
festival. Mr. Henshaw also requested to be on the next Council
agenda concerning the proposal to preserve the San Mateo ferry.
Dr. Fran Solomon, Department of Ecology, reported on the goals and
implementation of the Sinclair Inlet Action Plan.
Sharron King, Centennial Committee Chair and Kay Morrison, Port
Orchard Chamber of Commerce Past President thanked the Mayor and
City Council for their support and cooperation in granting numerous
requests for staff time, use of City properties, equipment and
financial assistance which helped make the Centennial celebration a
great success. The Fire and Police Departments were also highly
commended for their willingness to help whenever called upon. -
Steve Davis, R.V. Associates, approached Council concerning their
desire to purchase a parcel of City property on Old Clifton Road.
Mayor Weatherill referred matter to the Property Committee for
review.
Rich Medved, South Kitsap Plaza, requested a one year extension on
the time limit condition on Rezone No. 1070. Property located at
1800 SR160.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council granted a one year extension on the time limit condition
for the South Kitsap Plaza located at 1800 SR160. (Rezone No. 1070)
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved Ordinance No. 1493 which repeals Ordinance No.
1466 (POMC 13.04 and 13.08) and establishes regulations providing
for the control, management, maintenance and use of public and
private water and sewer systems and providing rates for connection
and use of such systems. Councilman Smith abstained from
discussion and voting on this due to conflict of interest.

On motion by Councilman Clauson, seconded by Councilman Powers,
Council adopted Resolution No. 1552, setting October 22, 1990 at
7:45 PM as date and time for a Public Hearing on a Petition to
Vacate an unnamed alley in Block 2 of the Plat of Tom Cline's
Addition to Sidney (700 Block between Taylor and Division Streets -
east of Sunset Lane Cemetery and west of Bethel Avenue) as
submitted by Richard D. Gehring. LEGAL DESCRIPTION: All that
portion of Lots 16, 17 and 18, Block 2, Tom Cline's Addition of
Sidney, City of Port Orchard, according to plat recorded in Volume
I of Plats, page 29 in Kitsap County, lying west of a line drawn
parallel with and 50 feet westerly, when measured at right angles,
from the center line survey of State Highway Route 160 (PSH No.
14), Blackjack Creek to Port Orchard.
Elaine Perkowitz, Barbara Saker and Hazel Simmons, representing
V.F.W. Post 2669, presented an American flag to Mayor Weatherill to
replace the Municipal Court Building flag which was stolen.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved the Agreement Regarding Jury Panels for Municipal
Court.
On motion by Councilman Geiger, seconded by Councilman Powers,
Council authorized Municipal Court Judge Mittet sign the Agreement
Regarding Jury Panels for Municipal Court.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council set October 11, 1990 at 7:30 PM as date and time for a
special meeting to discuss the Notice of Intent to Petition for
Annexation into the City as submitted by Port Orchard Church of the
Nazarene. Motion passed with 4 ayes and 2 nays. Councilman
Childress and Geiger voting nay.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council adopted Resolution No. 1553, setting October 22, 1990 at
8:00 PM as date and time for a Public Hearing on a Petition to
Vacate an unnamed alley in Block 2 of the Plat of Torn Cline's
Addition to Sidney (700 Block between Taylor and Division Streets -
east of Sunset Lane Cemetery and west of Bethel Avenue) as
submitted by Norman K. and Marlene L. Savage. LEGAL DESCRIPTION:
Lots 19 to 24, inclusive, Block 2, Tom Cline's Addition of Sidney,
City of Port Orchard, according to plat recorded in Volume 1 of
Plats, page 29 in Kitsap County, Washington; EXCEPT 25 feet of said
lots 19 and 20 for road.
Mayor Weatherill referred to the Public Property Committee for
review, letter from David Nelson, 1013 Kitsap Street offering to
purchase City property which is located on corner of Kitsap Avenue
and Seattle Avenue (Lot No. 4053-010-012-0003).

Councilman Geiger, member of Street/Alley Committee, advised the
Port Orchard Methodist Church a moratorium was placed on
installation of signs, however, Councilman Geiger suggested the
Church research the possibility of placing a row of church signs on
the "Welcome to Port Orchard" service club sign on Tremont Street.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council removed from the table, the motion to approve 1991 Animal
Control Services Agreement with Kitsap Humane Society, at a cost of
$15,103.
Councilman Geiger moved to amend motion to include Addendum to
Section 1-10 of the Animal Control Service Agreement, seconded by
Councilman Clauson and carried.
Council unanimously approved the 1991 Animal Control Services
Agreement with Kitsap Humane Society with Addendum to Section 1-10,
at a cost of $15,103.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of vouchers as follows:
Claims Warrant No. 13911-13967 in the amount of $63,077.56.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council approved the City Attorney to proceed with updating the
Port Orchard Municipal Code and Criminal Code.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council authorized Parametrix to proceed with the Hydraulic Permit
issued by the Department of Fisheries for the Bethel Widening
Project at a cost of approximately $4,000.00
Mayor Weatherill adjourned Council into Executive Session for 15
minutes to discuss a Interlocal Agreement.
Meeting adjourned at 9:15 PM.
