October 22, 1990
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Morrison, Geiger, Powers, and Smith. Councilmen
Childress and Grable absent. Staff present: City Attorney
Haberly, Deputy Clerk Thomas, City Planner Davis, Police Chief
Mathews, City Engineer Curles and Fire Chief Snow. Councilmen
Childress and Grable excused page 6.
Councilman Geiger led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved the minutes of the October 8, 1990 meeting as
circulated.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved the minutes of the special meeting on October 11,
1990 as circulated.
Win Granlund, Kitsap County Commissioner, introducted Bill Isley,
Kitsap County's Architectual Consultant who presented and reviewed
Kitsap County's Master Campus Plan Proposal. Mr. Isley also
availed himself to answer questions.
At 7:45 PM Mayor Weatherill opened Public Hearing and called for
input relevant to a Petition to Vacate a portion of an unnamed
alley in Block 2 of the Plat of Tom Cline's Addition to Sidney (700
Block between Taylor and Division Streets - east of Sunset Lane
Cemetery and west of Bethel Avenue), as submitted by Richard D.
Gehring. LEGAL DESCRIPTION: All that portion of Lots 16, 17 and
18, Block 2, Tom Cline's Addition of Sidney, City of Port Orchard,
according to plat recorded in Volume 1 of Plats, page 29 in Kitsap
County, lying west of a line drawn parallel with and 50 feet
westerly, when measured at right angles, from the center line
survey of State Highway Route 160 (PSH No. 14), Blackjack Creek to
Port Orchard.
City Engineer Curles gave staff report on the location of this
parcel and current status.
Mayor Weatherill called for public input either for or against the
proposed Petition to Vacate a portion of an unnamed alley.
Mark Rill, representing, Rill -Sunset Lane Cemetery, advised Council
as an adjacent property owner, they are in favor of the vacation.
City Clerk Hower read into record, letter from L. William Rill,
notifying the Council of their support and retention of their
rights and/or options to an equal share of the property being
vacated surrounding the cemetery.

JaLilly Hastings, owner of Lots 25, 26 and 27, (north of subject
property) supported petition to vacate a portion of a right of way
and voiced desire to vacate a portion of an alley adjacent to her
property. Ms. Hastings has been advised how to commence with
vacation proceedings.
Mayor Weatherill called for additional input either for or against
the petition to vacate a portion of an unnamed alley. No response
was received.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council moved to continue Public Hearing to November 26, 1990 at
8:15 PM for further review regarding Petition to Vacate a portion
of an unnamed alley way in Block 2 of the Plat of Tom Cline's
Addition to Sidney (700 Block between Taylor and Division Streets -
east of Sunset Lane Cemetery and west of Bethel Avenue), as
submitted by Richard D. Gehring.

Norman K. and Marlene L. Savage. LEGAL DESCRIPTION: Lots 19 to
24, inclusive, Block 2, Tom Cline's Addition of Sidney, City of
Port Orchard, according to plat recorded in Volume 1 of Plats, page
29 in Kitsap County, Washington; EXCEPT 25 feet of said lots 19 and
20 for road.
Mayor Weatherill called for additional input either for or against
the petition to vacate a portion of an unnamed alley. As no
response was received, Mayor Weatherill referred matter to Council
for their consideration.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council moved to continue Public Hearing to November 26, 1990 at
8:30 PM for further review regarding Petition to Vacate a portion
of an unnamed alley way in Block 2 of the Plat of Tom Cline's
Addition to Sidney (700 Block between Taylor and Division Streets -
east of Sunset Lane Cemetery and west of Bethel Avenue), as
submitted by Norman K. and Marlene L. Savage.
Mayor Weatherill opened Public Hearing scheduled for 8:15 PM. This
is the first of two Public Hearings to establish a Comprehensive
Plan Map Designation petitioned by Norm Olson on behalf of David
Hedger. The owner has requested a Comprehensive Plan Map
Designation amendment from Residential High to Commercial General
for property located at 104 Tremont Street. LEGAL DESCRIPTION:
That portion of the northeast quarter of the southwest quarter,
Section 35, Township 24 North, Range 1 East, W.M., described as

follows: Beginning at the southwest corner of said northeast
quarter of the southwest quarter, thence north 654 feet to a point
on a line that is 10 feet south of the parallel with the south
margin of Tremont Street as shown on the Plat of Sidney Land Co's
2nd Addition to Sidney, as per plat recorded in Volume 2 of Plats,
page 9, records of Kitsap County; thence east 186 feet, thence
south 170 feet; thence west 186 feet, thence north 170 feet to the
point of beginning.
City Planner Davis briefed Council on location of subject property
and outlined the Planning Commission's recommendation to approve
the amendment to the Comprehensive Plan Map Designation.
Norm Olson, representing David Hedger, outlined the proposed uses
of the property and answered questions from the Council.
David Hedger, proponent, spoke on behalf of the proposed project,
and answered questions from the Council.
Wayne Tripp, 1900 Higgins Road, potential tennent, assured Council,
his business would not have any outside storage on property.
Doug Eide, 2479 Bethel Avenue, spoke in favor of the amendment to
the Comprehensive Plan Designation.
Carlotte Kraft, 104 Tremont, also spoke in favor of developing the
property for commercial use, stating attempts to sell her property
as residential have failed because of plans to widen Tremont.
Mayor Weatherill called for further public input in favor of or
against establishing a Comprehensive Plan Map Designation of
Commercial General as submitted by David Hedger. No response was
received.
At the request of Mayor Weatherill, Councilman Morrison, moved to
continue Public-Hearina to November 20, 1990 at 7:45 PM (this will
be the second and final hearing) regarding a Comprehensive Plan Map
Designation petitioned by Norm Olson on behalf of David Hedger,
seconded by Councilman Geiger and carried.
Mayor Weatherill opened Public Hearing scheduled for 8:30 PM
regarding an application for a Zone Reclassification from
Residential High to Commercial General as submitted by David -Hedger
for property located at 104 Tremont Street. LEGAL DESCRIPTION:

City Planner Davis recommended to continue this Public Hearing to
November 26, 1990 as this Public Hearing is in direct relationship
with the prior Public Hearing concerning the amendments to the
Comprehensive Plan Designation.
Mayor Weatherill called for additional public input either for or
aginst the proposed Zone Reclassification. No response was
received.
On motion by Councilman Morrison, seconded by Councilman Powers,
Council continued Public Hearing to November 26, 1990 at 8:00 PM
concerning a Zone Reclassification from Residential High to
Commercial General as submitted by David Hedger for property
located at 104 Tremont Street.
City Clerk reported on bid opening held November 18, 1990 at 4:30
PM for wood stockpile. One bid was received with the required bid
bond as follows:
William E. King $318.00
On motion by Councilman Clauson, seconded by Councilman Morrison,
Council accepted the bidding and awarded the bid for the wood
stockpile to William E. King in the amount of 5318.00.
Charles J. Stone, President Sedgwick Texaco Food Mart requested
fees associated with water connection for the Sedgwick Texaco Food
Mart be waived due to their $85,000 investment to extend the water
main improvements in the area.
On motion by Councilman Geiger, seconded by Councilman Powers,
Council moved to waive the Sedgwick Texaco Food Mart Fees In Lieu
of Assessments in the amount of S6,496.12 due to their $85,000
investment in extending water mains.
Dr. David Muga, Chairperson, Port Orchard Peace Committee,
requested permission to install temporary directional signs for the
Community Peace Symposium on Saturday, October 27, 1990. The signs
will be placed at (1) Bay and Beach intersection; (2) Bethel and
Mitchell intersection; {3) Mitchell and Beach Drive intersection;
(4) on Mitchell in front of the South Kitsap High School north
entrance parking lot.

On motion by Councilman Clauson, seconded by Councilman Smith,
Council allowed the Port Orchard Peace Committee to install
temporary directional signs for the Community Peace Symposium on
Saturday, October 27, 1990. The signs will be placed at (1) Bay
and Beach intersection; (2) Bethel and Mitchell intersection; (3)
Mitchell and Beach Drive intersection; (4) on Mitchell in front of
the South Kitsap High School north entrance parking lot.
Rene LaMarche, representing Bethany Lutheran Church, requested a
temporary occupancy permit to allow the Kitsap County Child Support
Division to utilize the building located at 715/717 Sidney Avenue.
Required parking spaces to be installed within 30 days.
Lacretia Fishburn, Kitsap County Prosecuting Attorney, voiced
concern for the needed office space and urged Council for approval
of the temporary occupancy permit.
On motion by Councilman Smith, seconded by Councilman Powers,
Council authorized the issuance of a temporary occupancy permit to
the Bethany Lutheran Church, located at 715/717 Sidney Avenue, to
allow the Kitsap County Child Support Division to utilize the
building. Required parking spaces to be installed within 30 days.
City Clerk Hower read proclamation declaring October 21-27 as
National Business Women's Week.
On motion by Councilman Powers, seconded by Councilman Morrison,
Council concurred with Mayor Weatherill proclaiming October 21-27
as National Business Women's Week.
City Clerk Hower read proclamation declaring November 11-27 as
American Education Week.
On motion by Councilman Geiger, seconded by Councilman Smith,
Council concurred with Mayor Weatherill proclaiming November 11-27
as American Education Week.
On motion by Councilman Clauson, seconded by Councilman Geiger,
Council approved Ordinznce No. 1494 fixing the amount of Ad Valorem
taxes to be raised for the year 1991.
On motion by Councilman Clauson, seconded by Councilman Morrison,
Council adopted Resolution No. 1557 authorizing the City of port
Orchard employees to participate in the State of Washington
Deferred Compensation Plan.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of vouchers as follows:
Claims Warrant No. 14039-14094 in the amount of S39,321.70.

On motion by Councilman Powers, seconded by Councilman Morrison,
Council excused Councilmen Grable and Childress from the Council
meeting.
Mayor Weatherill adjourned Council into Executive Session for 30
minutes to discuss liability issue and union negotiations.
On motion by Councilman Morrison, seconded by Councilman Geiger,
Council authorized an emergency expenditure of 525,000 to the Fire
Department to proceed with repowering and reconditioning of Fire
Engine No. 2.
On motion by Councilman Powers, seconded by Councilman Smith,
Council set aside and removed from Unfinished Business Agenda Item
No. 1 - Steve Davis, R.U. Associates request to purchase a parcel
of City property on Old Clifton Road.
On motion by Councilman Smith, seconded by Councilman Morrison,
Council denied request by David Nelson to purchase a parcel of City
property located on corner of Kitsap and Seattle Avenue.
On motion by Councilman Powers, seconded by Councilman Morrison,
Council set aside and removed from Unfinished Business Agenda Item
No. 3 - Howard Minor's request to lease City property on Old
Clifton Road.
Councilman Geiger moved to deny request for installati❑n of a spot
light on the Library Building Centennial Mural, seconded by
Councilman Powers. After some discussion, Councilman Powers moved
to table motion to deny request for City to install a spot light on
the Library Building Centennial Mural for further review, seconded
by Councilman Clauson and carried.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council concurred with the adjusted Class 14 sewer rates.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council authorized the City Engineer to proceed with the paving of
the Morton Street Reservoir driveway by Ace Paving in the
approximate amount of S2,500.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council approved Group Health's delay in installing sidewalk§ on
Tremont contingent upon posting of a performance bond assuring the
City the sidewalks on Tremont will be installed.
