Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Powers, Smith and
Grable. Staff present: City Attorney McCluskey, Deputy Clerk
Thomas, Police Chief Mathews, City Engineer Curles, Fire Chief Snow
and City Clerk Hower.
At the request of Mayor Weatherill, Clyde Stricklin led the
audience and Council in the Pledge of Allegiance.
On motion by Councilman Grable, seconded by Councilman Powers,
Council approved the minutes of the December 10, 1990 meeting as
circulated.
Clyde Stricklin, Division Head Zoning, Kitsap County, requested
Council approval of the Kitsap Regional Planning Council Interlocal
Agreement and availed himself for questions.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council authorized the Mayor to sign the Kitsap Regional Planning
Council Interlocal Agreement.
On motion by Councilman Clauson, seconded by Councilman Morrison,
Council authorized the Mayor to submit a letter to the Kitsap
Regional Planning Council indicating the City's intent to withdraw
in 6 months if various issues, which are concerns expressed by the
City, have not been resolved.
Ron Ross requested a time extension of Commercial General zone
classification for his property located at 616 Sidney Avenue.
On motion by Councilman Geiger, seconded by Councilman Childress,
Council authorized a 12 month extension for Commercial General zone
classification for property owned by Ron Ross which is located at
616 Sidney Avenue.
Mayor Weatherill advised Council and audience the Public Hearing
scheduled for 7:45 PM has been rescheduled to January 14, 1991 at
8:00 PM due to clerical error in the notification process. This
Public Hearing is in regards to an application for a Comprehensive
Plan Designation Change and Zone Reclassification from Residential
High to Commercial General as petitioned by the Port of Bremerton
to allow for a metered parking lot at the intersection of Lawrence
and Arnold Streets.
Mayor Weatherill advised Council and audience the Public Hearing
scheduled for 8:00 PM has been rescheduled to January 14, 1991 at
7:45 PM due to clerical error in the notification process. This
Public Hearing is in regards to an application for a Comprehensive
Plan Designation Change and Zone Reclassification from Public
Property to Industrial as petitioned by the City of Port Orchard to

allow for light industrial uses in the vicinity of 1265 Old Clifton
Road (former solid waste landfill).
At 8:15 PM Mayor Weatherill opened Public Hearing to receive
testimony and input on Petition for Annexation as submitted by the
Church of the Nazarene for property located on Sidney Road owned by
the Church of the Nazarene and Kitsap County (baseball field).
Mayor Weatherill called for input from those present in favor of or
opposed to the proposed annexation.
Councilman Clauson advised Council and audience he is member of the
Church of the Nazarene and ask if anyone had an objection to his
participation in public hearing process. An objection was heard
and Councilman Clauson stepped down from the Council table and
refrained from participating.
City Engineer Curles updated Council on the location and status of
the water needed for fire flow by the Church of the Nazarene.
Pastor Kevin O'Connor of the Church of the Nazarene, availed
himself to answer questions from the Council and audience.
Edie Wood, 4577 Sidney, questioned boundaries of the proposed
annexation and voiced concern about water retention pond located on
Church of the Nazarene property.
Walter Young, member of the Church of the Nazarene, assured Council
and Mrs. Wood everything possible has been done to secure the water
retention pond.
Mayor Weatherill called for further input in favor of or against
the City approving the Petition for Annexation as submitted by the
Church of the Nazarene. As no response was received, Mayor
Weatherill declared this Public Hearing closed and referred matter
to the City Council for consideration.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council approved the Church of the Nazarene Petition for Annexation
and adopted Ordinance No. 1501 providing for the Annexation of
territory into the City of Port Orchard. LEGAL DESCRIPTION:

At 8:25 PM Mayor Weatherill called for a 5 minute recess.
On motion by Councilman Geiger, seconded by Councilman Powers,
Council approved Public Defender Services Contract for 1991 between
Case & Lind, Inc., P.S. and the City.

On motion by Councilman Grable, seconded by Councilman Geiger,
Council approved Ordinance No. 1502 amending the budget for the
year 1990 and ordering appropriation of funds and authorizing a
budgetary transfer.
Councilman Geiger moved to adopt a proposed resolution prohibiting
smoking in City owned or operated facilities and vehicles except in
designated smoking areas, seconded by Councilman Clauson.
Councilman Grable moved to table motion to adopt a resolution
prohibiting smoking in City owned or operated facilities and
vehicles except in designated smoking areas, seconded by Councilman
Morrison. Motion failed with 3 ayes and 4 nays. Councilmen
Clauson, Childress, Geiger and Powers voting nay.
After much discussion, Councilman Geiger moved to table motion to
adopt a proposed resolution prohibiting smoking in City owned or
operated facilities and vehicles except in designated smoking
areas, seconded by Councilman Grable. Motion passed with 4 ayes
and 3 nays. Councilmen Clauson, Childress and Smith voting nay.
Mayor Weatherill referenced letter from Richard Netzel, C.P.A.
representing South Sound Sanitation, Inc. regarding 1991 rate
increase (5.839%) in accordance with contract.
Mayor Weatherill requested Water/Sewer Committee review South Sound
Sanitation, Inc. contract.
Councilman Geiger moved to remove from table, proposed agreement
requesting City of Port Orchard participation in the Household
Hazardous Waste Collection Event for 1990 and 1991, seconded and
carried. After much discussion, Mayor Weatherill requested City
Attorney, City Engineer and Fire Chief research this matter.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council unanimously approved payment of vouchers as follows:
Claims Warrant No. 14316-14377 in the amount of $69,073.15.
On motion by Councilman Smith, seconded by Councilman Grable,
Council moved to notify the insurance pool of the damage to the
garage door at Fire Station No. 3.
