The following is a summary of an Ordinance approved by the Port Orchard City Council at their
regular Council meeting held April 24, 2000.

AN ORDINANCE OF THE CITY OF PORT ORCHARD,
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1748;
BY AMENDING THE AREA AND USE MAPS THEREOF,
RECLASSIFYING PROPERTY BORDERED ON THE EAST BY
POTTERY AVENUE AND SOUTH KITSAP BOULEVARD TO THE
NORTH FROM RESIDENTIAL 4.5 AND R8 TO A MIXED ZONING
CLASSIFICATION FOR THE PURPOSE OF DEVELOPING
PROFESSIONAL OFFICES, COMMONLY KNOWN AS POlTERY

Clerk of the City of Port Orchard. Upon written request a statement of the full text
of the Ordinance will be mailed to any interested person without charge. Thirty

WHEREAS, Yoder/Morrison Partnership, owners of record, have petitioned a zoning
ordinance amendment, requesting a reclassification from Residential 4.5 and R8 to a Mixed Used Zoning
Classification for property bordered on the east by Pottery Avenue and South Kitsap Boulevard to the north,
and
WHEREAS, affected property owners may request a change in valuation for property tax
purposes notwithstanding any program of revaluation, and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council
of the City of Port Orchard, Washington their Resolution No. 308-00. recommending approval of said
petition, and
WHEREAS, the Council of the City of Port Orchard held a Public Hearing on April 10, 2000,
and
WHEREAS, at the public hearing the Council accepted, as part of its record, all testimony
and documents presented to the Planning Commission.
FINDINGS OF FACT: The proposed use, as conditioned, complies with existing
development standards.
The use requested is compatible with other uses in the area
The proposed use is a permitted use within a Mixed Used Zone Classification.
The proposed zone change is consistent with the city comprehensive plan designation
CONCLUSION: Based on testimony, materials presented and finds of fact, the Port
Orchard City Council does hereby conclude that granting this zone reclassification would not be detrimental
to the health, safety, morals and general welfare of the community, now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
THAT: The Council of the City of Port Orchard does hereby reclassify properly bordered
on the east by Pottery Avenue and South Kitsap Boulevard to the north from Residential 4.5 and R8 to a
Mixed Used Zoning Classification and further amends the city’s zoning map to reflect the change in the zone
reclassification and allow the development of professional offices, commonly known as Pottery Professional
Plaza subject to the following 11 conditions:

All water mains and services will meet city standards.
The Fire Marshall will determine fire hydrant assemblies and their locations.
All sewer mains and services will meet city standards.
Prior to issuance of the Certificate of Occupancy, the city will be provided the as-
built drawings for the water, sanitary sewer, and stormwater systems.
The stormwater system will be designed by a professional engineer and meet the
city standards.
The sidewalk and shoulder on the west side of Pottery Avenue shall be similar to
that on the east side of the road.
The stop bars, lane arrows, and painted islands shall be applied with thermoplastic
paint.
Crosswalks shall be at the entrance of the project and shall be the ladder design
and applied with thermoplastic paint.
Prior to issuance of any building permit, the City Engineer and Police Chief shall
approve the lighting plan for the entrances and site plan.
All on site utilities shall be underground.
A landscaping plan shall be submitted, reviewed, and implemented prior to the
issuance of a certificate of Occupancy.
