The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held November 13, 2000.
ORDINANCE NO. 1802
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING 5 9.24.050(1)(h) OF ORDINANCE NO. 1724 RELATING TO
NOISE REGULATION.
Copies of Ordinance No. 1802 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1802 will be
provided at a nominal charge.

ORDINANCE NO. 1802
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING § 9.24.050(1)(h) OF ORDINANCE NO. 1724 RELATING TO
NOISE REGULATION.
WHEREAS, the City Council has assigned to a Council Committee responsibility for
doing a comprehensive review of the City's noise regulations; and
WHEREAS, a citizen has indicated that they believe use of the City chimes at City Hall
may violate the existing City Nuisance Ordinance; and
WHEREAS, the comprehensive review of the City's noise regulations may take a
substantial period of time and the Council wishes to eliminate any ambiguity with regards to the legality of
the City chimes so that they may be played during the holiday season, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1.

Ordinance No. 1724, Section 9.24.050(1)(h) is amended
The foregoing provisions shall not apply to regularly scheduled
events at recognized public places of assembly, nor to the electronic
chimes at Port Orchard City Hall. "Recognized public places of assembly"
includes, but is not limited to, public parks, churches, and schools;
provided, that the foregoing enumeration of acts and noises shall not be
construed as excluding other acts and noises which offend the public
peace.
SECTION 2. If any section, subsection, paragraph, sentence, clause or phrase of this
ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or
effectiveness of the remaining portions of this ordinance.
SECTION 3 This Ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of the entire
Ordinance, as authorized by State law.
