WHEREAS, Evergreen Pacific Foundation, applicant, represented by Dan Pebbles,
a redesignation of President, has initiated a Comprehensive Plan Amendment, CA-04-00, requesting
property referred to as the Ross Point Plateau, as described in said petition, and
WHEREAS, the applicant is requesting a Comprehensive Plan Designation of Medium
Density Residential and Industrial to support submittal of a future RezonelMaster Plan Unit Development; and
WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five years
take action to review and, if needed, revise its Comprehensive Plan; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and
procedures of the Growth Management Act; and
WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of
the City of Port Orchard their findings and conclusions as stated in Resolution 314-00, (Attachment "A") that
the Comprehensive Plan Map be amended for the reasons stated therein;
WHEREAS, all legal requirements have been met; and
WHEREAS, the proposed Comprehensive Plan Map Amendment No. CA-0440 is found to
be consistent with the goals of the community. adopted Comprehensive Plan and general requirements of the
Growth Management Act (RCW 36.70A); now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN
AS FOLLOWS: That the City Council does hereby adopt Planning Commission Resolution No. 314-00, with
findings and conclusions, as it's own and does hereby designate certain properties on the Comprehensive
Plan Map Medium Density Residential, and Industrial, as illustrated on Attachment "B; subject to the
following conditions:
(1) As proposed, future development of the subject properties shall be reviewed as a
Master Planned Unit Development - Employment Based Planned Community, that
will exemplify the project benefits expressed by the applicant. (Attachment"D")
That residential dwelling types be limited to single family attached and detached.
That commercial uses be limited to professional office/ light manufacturing, with no
more than 10 % of the overall square footageallotted to retail.
Special considerationshould be applied to future development design to ensure that
the development is well-planned, and sensitive to the environmental concerns of the
area to include:
0 Presewation of the Ross Creek corridor as a significant fish and wildlife
habitat area;
0 Conservation of open space for public enjoyment;
0 Application of Best Management Practices in stormwatercontrol &design;
0 Stabilizationof the steep slopes adjacent to Ross Creek and Bay Street;
0 Coordinated access between properties with safe access onto Bay Street;
0 Sustainable job development;
0 Furtherance of City long-term goals for quality site development that is
attractively designed.

A RESOLUTION BY THE CITY OF PORT ORCHARD PLANNING COMMISSION
RECOMMENDING THE APPROVAL OF A COMPREHENSIVE PLAN
PROPOSES THE COMPREHENSIVE CLASSIFICATION OF MEDIUM DENSITY
AND INDUSTRIAL ON APPROXIMATELY 104 ACRES OF LAND.
AMENDMENT, CA-04-00, LOCATED ON THE ROSS POINT PLATEAU WHICH
WHEREAS, the Planning Commission held a Public Meeting for the
Comprehensive Plan Amendment, CA-04-00; and
WHEREAS, the City and the applicants are proposing that the Comprehensive
Plan designation of the Ross Point Plateau be designated as Medium Density and
Industrial; and
WHEREAS, the City ofPort Orchard following State Law RCW 36.70A.130
which dictates that the cities shall at least every five years take action to review and, if
needed, revise its Comprehensive Plan; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals,
policies, and procedures of the Growth Management Act; and
WE THEREFORE FIND Comprehensive Plan Amendment, CA-04-00, is not
detrimental to the health, safety, and welfare of the community and is proposed to be
within the character of the Growth Management Act, Comprehensive Plan, and the
community.
CONCLUSION: Based upon the facts, testimony, and the materials presented at
the Meeting, we therefore conclude that the Comprehensive Plan Amendment, CA-04-00,
is consistent with the health, safety, and welfare of the City of Port Orchard.

PROJECT DESCRIPTION
PROJECT BACKGROUND:
The Ross Pointe Master Plan project site is located within the incorporated limits of the
City. of Port Orchard, abutting SR 166.to the north and west, at Ross Point. The project
site is situate in Sections 27 and 34, Township 24 North, Range 1 East, W.M., City of
Port Orchard, Kitsap County, Washington (See Figure 1 attached in Appendix A).
The’f 104-acre undeveloped property takes up the majority ofthe Ross Point Peninsula
which juts out into Sinclair Inlet. The site for the proposed Ross Pointe Master Plan is
comprised of 48..3 acres of developable land located primarily on the plateau of the Ross
Point peninsula. The majority of the land is compriseii of second growth forest and
includes five (5) separate wetlands, steep sloped bluff areas and a 15004. section of the ,
Ross Creek canyon. Please note that two (2) of the wetlands iKill need to be filled in
compliance with Department of Ecology/Army Corps of Engineers standards and
mitigated at a ratio of 1 :5: 1. The site breaks down into the following land categorizations

The Ross Pointe property is currently zoned “R-4.5” with a Comprehensive Plan
Designation of Low Density Residential (LDR). Water and sanitary sewer services are
available to the project site from the City of Port Orchard. Utility extensions are
anticipated along SR 166 from Wilh Distributing to Ross Pointe. Storm water runoff
from the project site will discharge directly either to Sinclair Inlet or into Ross Creek.
PROJECT PROPOSAL:
The Ross Pointe Master Plan proposes to develop a dual element “Employment Based
Community”, which will require a Comprehensive Plan Amendment to the current 1995
City of Port Orchard Comprehensive Plan. The proposed dual element community will
combine both single and multi-family living with on-site employment opportunities.

A zoning reclassification to “R-8/R-12” plus “Employment Center” is needed. A
comprehensive plan designation of “Medium Density Residential” for the R-8R-12
uses and “Professional, Industrial, Manufacturing and limited Neighborhood
Commercial” for the Employment Centers is also anticipated (See Figure 2 Attached).
It is understood that the City of Port Orchard hopes to accomplish the Comprehensive
Plan Amendment (adoption) and modifications to the Zoning Ordinance by the end of
year 2000. In compliance with an anticipated SEPA determination of MDNS (possibly
running concurrent with the Comp Plan Amendment), Art Anderson Associates shall
identify project impacts and proposed mitigation for traf€ic, storm drainage, wetlands,
geotechnical issues and utilities.
ROSS PONE MASTER PLAN
COMMUNITY COMPATIBILITY STATEMENT
The Ross Pointe project site is the largest remaining undeveloped and privately wned
property within the incorporated limits of the City of Port Orchard. The owner, Evergreen
Pacific Foundation wants to achieve an environmentally compatible yet flexible land use
plan. The proposed Ross Pointe Master Plan, which requires an amendment to the City
of Port Orchard’s Comprehensive Plan, will address three (3) separate areas of
compatibility including, Perimeter, Internal and Environmental Compatibility as follows:
Perimeter Compatibility:
The adjoining properties (south and east) of the proposed Ross Pointe Master Plan project
site are typically undeveloped and zoned “R-4.5” with a Comprehensive Plan
Designation of Low Density Residential (LDR). The Ross Creek drainage basin east and
south of the Ross Point isolates the Plan area from these neighborhoods with their
associated land uses. To ensure additional perimeter compatibility for the proposed dual
element Employment Based Community, a single family detached residential buffer
could be included along the southerly project boundary where appropriate. The Master
Plan will then transition inward to more higher density type housing (duplex, triplex,
multi-family apartments/condominium and or senior housing) and finally to the
employment based “Professional, Industrial, Manufacturing and Neighborhood
Commercial” uses. Please note that the easterly project boundary is typically an
undisturbed Ross Creek setback and the north and west project boundaries are typically
steep sloped adjoining SR 166 (See Figure 2 in Appendix A). One can easily see that the
land uses that are proposed for Ross Pointe have little or no effect on land uses nearby
due to the environmental constraints surrounding the property.

Internal Compatibility:
Internal compatibility will be derived through the transition and placement of varying
densities of residential uses, in concert with proposed Employment Centers (Professional,
Industrial and Manufacturing) and site-specific community based neighborhood
commercial retail uses (See Figure 2 in Appendix A). Other features proposed to ensure
internal compatibility will include on-site Architectural Control Guidelines and alternate
forms of internal circulation (bus routes, bike routes, pedestrian routes).
Environmental Compatibility:
Environmental compatibility will be obtained through careful mitigation of
environmental elements associated with the Ross Pointe project site as follows:
6 Buffering of wetlands and creeks will be provided'. Currently, there are two (2)
low-value wetlands proposed to be filled, with the remaining three (3) to be
buffered (50-ft. minimum) and enhanced to provide increased wetlands area at a
1S:l ratio. Ross Creek is proposed to be protected with a 2004 typical buffer as
well. 5 . All steep slopes (30% or greater) have been field-located and provided with a 15-
ft. undisturbed setback and an additional 20-&.building setback, based on
geotechnical studies.
5 A field-located historical Eagle's Nest has been buffered with a 3504. protective
radius.
6 Traffic impacts will be mitigated through channelization and widening
improvements to SR 166.
6 Sanitary sewer and water services are available to the Ross Pointe project site via
main extensions along SR 166.
6 Storm drainage mitigation will be provided via implementation of Kitsap County
and DOE storm drainage requirements for .water qualitylquantity.

Project Benefits:
The Ross Pointe Master Plan has incorporated the Goals and Policies of the City of Port
Comprehensive Plan into this project proposal as follows:
Preserve and enhance environmentally sensitive open spaces. All steep slopes,
wetlands and creeks have been identified, buffered and/or mitigated.
Increase the size and number of parks and open space. Both passive and active
recreation facilities will be incorporated into the project.
Improve utility service provision. The project will extend via SR 166, municipal
utilities to the project site, being within the Urban Growth Boundary, operate within the
level of service established by the City and will encourage utility coordination.

Promote the expansion of transit opportunities. The project will provide bus shelters
to promote public transit to and from the site as well as internal uses. The project also
proposes to develop an Employment Based Community.
Promote pedestrian use. As mentioned, an.Employment Based Community provides
opportunity to encourage pedestrian amenities such as sidewalks, bike paths and trails
from the residential areas to the employmentlservice areas.
Provide access for the disabled. The project will adhere to all ADA requirements for
both site and building improvements.
Maintain affordable housing and increase variety of housing choices. The project
will provide various medium density residential housing alternatives to help create
affordable housing through choice.
Improve the usability of the available land supply within the City limits. The Ross
Pointe project site is the largest undeveloped property with the incorporated limits of Port
Orchard. As proposed, the Ross Pointe Master Plan will provide the mix of residential
and-employment components needed to maximize appropriate residential densities while
providing on-site employment opportunities.
Provide for a clean well maintained community. , Being isolated by steep slopes and
Ross Creek, the project is proposed to function as a campus community within the Port
Provide a balanced mixture and distribution of land uses. 'The design, the Ross
Pointe Master Plan strives to accommodate a mixture of land-uses and densities, as well
as allowing for much needed industriaVmanufacturing potentials.
Maintain an awareness of private properly rights. .Over the years, the owners of Ross
Pointe have worked cooperatively with the City of Port Orchard, Kitsap County and the
State Department of Transportation to identify and mitigate significant impacts associated
with the development of the project site. The Ross Pointe Master Plan as' submitted with
the Comprehensive Plan Amendment promotes a viable project that benefits both the
property owners and the City of Port Orcha'rd.
Strengthen the viability of Port Orchard as a place for people to. live, shop and
work, fostering a sense of community, security and civic pride. As proposed, the
Ross Pointe Master Plan exemplifies this goal and policy.
