City of Port Orchard City Council Deliberation Regarding the Downtown Overlay District July 25, 2007 PRESENT: Kim E. Abel, Mayor Council Members: Chang, Dilenno, Geiger, Powers, Putaansuu and Wyatt. Absent: Council Members John Clauson and Rita Dilenno ALSO PRESENT: Cit y Clerk Merlino, Planning Director Long -Woods, Public Works Abed, and Assistant City Attorney Greg Jacoby. Mayor Abel referred to the new draft Downtown Overlay District Ordinance, dated July 25, 2007, and asked for Council's consensus on the following sections: 18.96.010 — No changes :•.! ! • •- 18.96.030 — City Attorney Jacoby clarified and the Council concurred that all new construction and remodeling of structures are limited to those types of businesses as allowed within the Permitted Use section. 18.96.040 — Council concurred on the following revision: ➢ Remove from the Permitted Uses (1)(a) and (2)(a) Single family detached J dwellings. ➢ Clarify and add to Section .040(3) an additional section relating to "Existing Residential Uses". ➢ Subsection (2)(w) — allow boat dealers within the Central DOD, however no inventory on site. ➢ Subsection (3) — No Change, except as above ➢ Subsection (4) — No Change 18.96.050 — Council concurred to restore the original Conditional Uses provision. 18.96.050 — No Change I to •• tiallm L, roym•- July 25, 2007 Page 2of2 18.96.070 — No Change 18.96.090 — Subsections 1(b), 2(a), and 2(b) Council concurred that the value of the special amenity will be 1% of the combined land and building values. Subsection .090(3) — Council concurred to have Assistant City Attorney clarify that impacts to be reviewed under a CUP will include all impacts attributable to the building not just the impacts due to increased height.. Subsection 4 — Council will discuss this section at the next meeting in light of the impact of the View Protection Ordinance. Subsection 5 — No Change At 8:31 pm Mayor Abel called for a 5-minute recess. Meeting reconvened at 8:36 pm. 18.96.100(1) Council requested more clarification on the dimension ratios of not more than 5:1. Planning Director Long -Woods will provide clarifying language. Subsection 100 (in general) Assistant City Attorney Jacoby suggested adding to the amenity list atriums and public restrooms. Council concurred. Subsections (3) through (10) — Council made no changes The Council set the following next two meetings, August 6, 2007 and August 9, 2007 at 7:00 pm, City Hall.
