05/22/1989 - Regular - MinutesPort Orchard, Washington May 22, 1989 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Wilson, Geiger, Powers, Smith and Grable. Councilman Childress absent. Staff present: City Attorney J. Sells, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Eire Chief Snow and City Clerk Hower. Councilman Clauson led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the minutes of the May 8, 1989 meeting as circulated. Councilman Grable moved to excuse Councilman Childress from this meeting, seconded by Councilman Wilson and carried. Jesse Robinette, an Eagle Scout, petitioned Council for a Temporary Use Permit to install a sign at 712 Sidney for the South Kitsap Parks & Recreation District. The sign, which is a scouting project, is larger than allowed by Residential -High Zoning for Public Buildings. On motion by Councilman Wilson, seconded by Councilman Grable, Council approved issuance of a Temporary Use Permit to install a sign at 712 Sidney for the South Kitsap Parks and Recreation District under the supervision of the City Engineer and with the understanding that the Council will be advised of any complications. Jeff West, Southsound Sanitation, updated Council on the Curbside Recycling Test Program, which was authorized on September 26, 1988 and also discussed recent state legislation mandating local jurisdictions to establish a Solid Waste Recycling Program. Councilman Wilson moved to adopt Resolution No. 1510 lending moral support only for the Kitsap County Preimplementation Program Design Grant Application for waste reduction and/or recycling program, seconded by Councilman Clauson. Councilman Clauson moved to amend motion to insert into paragraph 10, item 2, "for consideration by the City of Port Orchard", seconded by Councilman Powers and carried. Council unanimously approved, original motion as amended, to adopt Resolution No. 1510 lending moral support only for the Kitsap County Preimplementation Program Design Grant Application for waste reduction and/or recycling program with the insertion of "for consideration by" in paragraph 10, item 2, seconded and carried. Larry Fankell, General Manager, Kitsap Snack Time Vending Co., requested permission to place soft drink and snack/candy vending machines in the Active Club Building on Tacoma Avenue. Councilman Clauson moved to table matter for City Engineer to determine if there is sufficient room at the Active Club for a vending machine and also for the City Attorney to review any bid requirements, seconded by Councilman Wilson and carried. May 22, 1989 Page Two Mayor Weatherill referred to letter from Gerald D. Carpenter, regarding sidewalk on undeveloped City Street between Perry Avenue and Bay Street to Street/Alley Committee, for review. On motion by Councilman Clauson, seconded by Councilman Geiger, Council adopted Resolution No. 1511 encouraging the use of recycling as a means of reducing solid waste burdens on public and private resources. On motion by Councilman Geiger, seconded by Councilman Grabie, Council removed from the agenda, New Business Item No. 9, proposed Ordinance prohibiting the use of non -biodegradable packaging materials. The State Legislature has passed a bill prohibiting any ban on disposable use items. On motion by Councilman Wilson, seconded by Councilman Clauson, Council rejected request submitted by Gary Chrey, Attorney representing Alfred and Virginia Collins, Vista Motel, seeking refund or credit on utility hook up fees paid in early 1980's for construction of additional motel units. Mayor Weatherill introduced two letters from the South Kitsap Family Worship Center requesting (1) an extension of a Special Use Permit and (2) a Temporary Use Permit, for property located at 451 Tremont Street. On motion by Councilman Wilson, seconded by Councilman Smith, Council approved a one year extension of a Special Use Permit for the South Kitsap Family Worship Center at 451 Tremont. Councilman Wilson moved to approve a request by the South Kitsap Family Worship Center for a one year Temporary Use Permit allowing a mobile home at 451 Tremont Street for use as an office during construction, seconded and carried. Letter from Richard Capps requesting an 18 month extension on Commercial Zoning at 1200 Bethel Avenue was presented for Council consideration. On motion by Councilman Geiger, seconded by Councilman Wilson, Council granted Richard Capps an additional 6 month extension on Commercial Zoning at 1200 Bethel Avenue. Mayor Weatherill submitted letter from Rich Medved, Allegre, Mitzel Partnership, requesting an extension of a Sign Variance at the South Kitsap Plaza, 1800 SR 160. On motion by Councilman Geiger, seconded by Councilman Smith, Council granted an additional 6 month extension on a Sign Variance at the South Kitsap Plaza, 1800 SR 160. May 22, 1989 Page Three On motion by Councilman Wilson, seconded by Councilman Clauson, Council approved Ordinance No. 1461 establishing a Comprehensive Plan Map Designation for property located north of SR160 between Mitchell and Retsil Roads to Commercial General, Richard Jacobsen and Michael Dick, owners of record. LEGAL DESCRIPTION: Situated in Kitsap County, Section 25, Township 24 North, Range 1 East. Beginning at the southwest corner of the NE 1/4, SE 1/4, SW 1/4; thence north 90 feet; thence west 295 feet; thence north 150 feet; thence west to the east margin of Mitchell Avenue; thence southerly along said east margin to the centerline of State Road 160; thence east along said centerline to extended centerline to vacated right-of-way CJ 14-320; thence south to south margin of State Road 160; thence east along said south margin to the east margin of Karcher Road; thence north to the east margin of Retsil Road, thence north along east margin of Retsil Road to the north boundary of the SW 1/4, SW 1/4, SE 1/4; thence west along said north line of the SW 1/4, SE 1/4, to the west boundary of Retsil Road; thence south along west boundary of Retsil Road to the north line of the SW 1/4, SW 1/4, SE 1/4 thence west along said north boundary to the point of beginning. On motion by Councilman Geiger, seconded by Councilman Grable, Council approved Ordinance No. 1462 vacating a portion of Hull Avenue as requested in petition submitted by James E. Stanton. LEGAL DESCRIPTION: Situated in Section 26, Township 24N, Range 1 East Kitsap County, Washington. That portion of Hull Avenue, which abuts the north margin of Division Street, the west line of lot 13, central Addition to Sidney Replat, the south line of J.H. Cline's Addition to Sidney and the east line of Government Lot 2. Councilman Wilson, Chairman Street/Alley Committee, moved to approve and implement revised parking configuaration for the north end of Sidney Avenue, in the area of the Totem Pole as shown on Attachment "A", seconded by Councilman Clauson and carried. Patty Olson, Street Fair Coordinator for the Port Orchard Bay Street Association, requested the City close Say Street, on August 6, 1989 from 619 Bay Street (Kitsap County Bank) to 839 Bay Street (Top Auto) from 7:00 AM to 5:30 PM for the 8th Annual Street Fair. Chief Mathews urged Council to deny request and suggested the Annual Street Fair utilize the waterfront parking lot and also Prospect Street. Closure of Bay Street means additional overtime expense for Police Department. After much discussion, Councilman Clauson moved to approve the Port Orchard Bay Street Association request to close Bay Street, August 6, 1989 from 10:00 AM to 5:30 PM from 619 Bay Street (Kitsap County Bank) to 839 Bay Street (Top Auto) and waived Vendor Permits for participants, seconded by Councilman Grable. Motion passed with 4 ayes and 2 nays. Councilmen Smith and Geiger voting nay. Mayor Weatherili declared recess for 10 minutes. Meeting reconvened at 9:50 PM. May 22, 1989 Page Four Clarence DahTke, 1309 Warner SE, presented a proposed traffic revision for the Bethel "Y" intersection. Mayor Weatherill advised Mr. Dahlke the Bethel "Y" intersection is under the jurisdiction of the State Highway Department. Mayor Weatherill requested Street/Alley Committee review the problem of rubbish being disposed of in various vacant lots and alleys in the City. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. Councilman Geiger moved to approve payment of those vouchers as follows: Claim Warrant No. 11894-11946 in the total amount of $71,866.06, seconded by Councilman Clauson and carried. On motion by Councilman Clauson, seconded by Councilman Grable, Council declared as surplus miscellaneous clothing items obtained through court actions and authorized the Police Department to donate items to the South Kitsap Helpline. On motion by Councilman Wilson, seconded by Councilman Grable, Council declared as surplus miscellaneous items of no real value, which were awarded to the City by court action and authorized the Police Department to dispose of in the best interest of the City. On motion by Councilman Wilson, seconded by Councilman Geiger, Council authorized the City Engineer to commence process of reviewing and updating the City Zoning Ordinance. City Engineer Curles requested a Public Hearing be scheduled for July 10, 1989 at 7:45 PM to obtain input and testimony on proposed Poplar Street Water Extension Agreement. On motion by Councilman Wilson, seconded by Councilman Smith, Council authorized the City Engineer to contact the Port of Bremerton regarding the placement of stairs and an observation deck on the Marina Pump Station. On motion by Councilman Wilson, seconded by Councilman Geiger, Council approved setting a Public Hearing for June 26, 1989 at 8:15 PM to receive public input and testimony on the Water Comprehensive Plan.
