September 11, 1989
Council of the City of Port Orchard, Washington was called to regular session
by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson,
Wilson, Geiger, Powers, Smith and Grable. Councilman Childress absent.
Staff present: City Attorney McCluskey, Police Chief Mathews, City Engineer
Curles, Fire Chief Snow and City Clerk Hower.
Councilman Powers led the audience and Council in the Pledge of Allegiance.
On motion by Councilman Clauson, seconded by Councilman Wilson, Council
excused Councilman Childress from this meeting.
On motion by Councilman Grable, seconded by Councilmen Wilson and Clauson,
Council approved the minutes of the August 28, 1989 meeting as circulated.
Darryl Piercy, Port of Bremerton Operations Officer updated Council on the
Port's current activities and plans for future, highlighting development at
Bremerton National Airport and the Port Orchard Marina.
Dean E. Rappleye, 1224 West Street, requested Council consider installing
practice board(s) at City tennis courts. Mr. Rappleye offered his time and
efforts to help install the practice board(s) if City would provide
materials. Mayor Weatherill referred matter to Parks Committee.
The proposed zoning ordinance was presented for Council consideration.
Councilman Geiger moved to table the proposed zoning ordinance and ask that
each Councilmember be provided with a copy of the written summary delineating
major revisions to this ordinance, seconded by Councilman Wilson and carried.
Mayor Weatherill reopened continued Public Hearing scheduled to receive
testimony on a Zone Reclassification application submitted by Kitsap County.
This rezone has been requested to bring the area into conformance with the
City's zoning ordinance. Subject properties are located at 611, 613, 614,
617, 619 Division; 704, 712, 716 Sidney; 651 and 707 Taylor. All properties
are within one (1) block of and including the Kitsap County Courthouse.
LEGAL DESCRIPTION: Section 26, Township 24 N, Range 1 E., W.M., Sidney S.M.
Stevens' Addition, Block 5, Lot 2, 3, 6, 7 & 10 and Sweany's Addition to
Sidney Lots I to 12 Block 1; also Lots 1 to 5, Block 2; also Lots I to 5 &
the N 10 ft Lot 9 and all Lot 10 Block 3; also Lots 2 to 9 Block 4, including
all vacated roads; also Lot 1 & Lots 10 to 12 Block 4; also Lot 7, 8 and the
south 40 feet of Lot 9, Block 3; Kitsap County, Washington.
Councilman Geiger moved to continue the Zone Reclassification Public Hearing
as submitted by Kitsap County to October 9, 1989 at 7:45 PM., seconded and
carried.

Mayor Weatherill reopened continued public hearing scheduled for 8:00 PM
regarding Petition to Vacate an unnamed alley in Block 18 of the plat of S.M
Stevens' Town Plat of Sidney as submitted by Kitsap County. LEGAL
DESCRIPTION: That portion of an unnamed alley in Block 18 of the Plat of
S.M. Stevens' Town Plat of Sidney, as recorded in Vol. 1 of Page 1 of Plats,
Records of Kitsap County, Washington, more particularly described as
follows: Beginning at the southeast corner of Block 18, Lot 2 of said Plat,
being the point of beginning of this description: thence east along the south
line common to Lots 2 and 7 of said Block 18, 170 feet more or less, to the
bottom of an unnamed ravine; thence following the bottom of said ravine south
16 feet more or less, to a point on the north line common to Lots 3 and 6 of
said Block 8; thence west along said north line, 160 feet more or less to the
northwest corner of Lot 3 of said Block 18; thence north along the east right
of way line of Austin Avenue as depicted on said Plat, 16 feet to the point
of beginning.
Engineer Curles reviewed status of communications with the County staff on
this petition and recommended continuation of the public hearing.
On motion by Councilman Geiger, seconded by Councilman Smith, Council
continued public hearing regarding Petition to Vacate an unnamed alley in
Block 18 of the Plat of S.M. Stevens' Town Plat of Sidney to October 9, 1989
at 8:00 PM.
Mayor Weatherill presented proclamation declaring September 17 through 23 as
Constitution Week and urged all citizens to pay special attention to the
advantage of American Citizenship.
Councilman Wilson moved to concur with Mayor Weatherill's proclamation of
Constitution Week, seconded by Councilman Grable and carried.
Councilman Wilson, Chairman of Street/Alley Committee reviewed request
submitted by Lute McDuffy that a handicapped parking space be established in
the vicinity of 919 Kitsap Street. Mr. McDuffy asked for the special parking
designation because during community events and on some holiday's he has
occasionally found it difficult to park directly in front of his home. The
Committee recommended delay or denial because on street parking demands are
minimal at this time and Mr. McDuffy does have the availability of on site
parking.
On motion by Councilman Geiger, seconded by Councilman Wilson, Council denied
request that a handicapped parking space by established in the vicinity of
919 Kitsap Street.

Councilman Wilson informed fellow Councilmembers that Bethany Lutheran Church
has requested a delay of action on their petition for a third handicapped
parking space in the vicinity of the 700 block of Sidney Avenue. Councilman
Wilson moved to removed unfinished business item #2 from the agenda, seconded
by Councilman Grable and carried.
Councilman Geiger moved to increase compensation for the position of Judge
Pro-tem from $30.00 an hour to $35.00, seconded and carried.
Mayor Weatherill adjourned the Council into executive session for 10 minutes
to discuss a personnel matter.
Mayor Weatherill reconvened Council at 9:00 pm.
City Engineer Curles reported discrepancy in the name of the Port Orchard
Library and how the name is specified in the library services contract with
the Kitsap Regional Library.
Councilman Geiger moved to request the Public Properties and Building
Committee pursue name change for the city library from Kitsap Regional
Library Port Orchard Branch to Port Orchard City Library as set forth in the
library services contract between the City and Kitsap Regional Library Board.
Engineer Curles outlined "Clean Up Week" proposed for the week of October
2-6. Southsound Sanitation would provide unlimited free pickup of
nonhazardous waste during this week.
On motion by Councilman Wilson, seconded by Councilman Clauson, Council
approved designating the week of October 2-6 as Clean Up Week for the City of
Port Orchard.
On motion by Councilman Wilson, seconded by Councilman Clauson, Council
authorized the City Engineer to install a chain link fence around the Melcher
Street Pump Station.
On motion by Councilman Wilson, seconded by Councilman Clauson, Council
authorized removing from the table, the motion to approve Lease Assignment
Agreement transferring interest for an established lease of City property
abutting Bay Ford, from Gordon L. Howe Estate, Kathleen Howe Schultheis and
Edwin Scott Howe, II to John R. Quisenberry and William M. Quisenberry.

Council unanimously approved motion to approve Lease Assignment Agreement
transferring interest for an established lease of City property abutting Bay
Ford, from Gordon L. Howe Estate, Kathleen Howe Schultheis and Edwin Scott
Howe, 1I to John R. Quisenberry and William M. Quisenberry. (motion
presented at the August 28, 1989 Council meeting by Councilman Wilson,
seconded by Councilman Powers)

Vouchers audited and certified by the auditing officer (City Clerk) as
required by RCW 42.24.080, and those expense reimbursement claims certified
as required by RCW 42.24.090, have been recorded on a listing and made
available to the Council.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council
unanimously approved payment of those vouchers as follows: Claims Warrant
No. 12305-12371 in the total amount of $60,014.97 and August Payroll Warrant
No. 110716-110834 in the amount of $110,074.96.
Councilman Wilson moved to establish a forty-eight (48) hour time limit for
parking at the Water Street Boat Launch, seconded by Councilman Geiger and
carried. -
Councilman Wilson moved to change parking time limit on the north side of
Kitsap Street, beginning one hundred forty five feet east of Sidney Avenue
and then continuing easterly two hundred forty feet from all day parking to a
four (4) hour parking time limit from eight A.M. to eight P.M. on any day
except Saturday, Sunday and federal holidays, seconded by Councilman Geiger
and carried.
On motion by Councilman Wilson, seconded by Councilman Geiger, Council
amended the parking time limit on the north side of Division Street from
Austin Avenue to Sidney Avenue from all day parking to a two (2) hour parking
time limit from eight A.M. to eight P.M. on any day except Saturday, Sunday
and federal holidays.
Councilman Smith moved to reconsider motion to establish a forty-eight (48)
hour time limit for parking at the Water Street Boat Launch, seconded by
Councilman Grable and carried.
Councilman Smith voiced concern that a forty-eight (48) hour time limit could
inhibit boaters during a three day weekend.
After much discussion, Council unanimously approved motion to establish a
forty-eight (48) hour time limit for parking at the Water Street Boat Launch.
Meeting adjourned at 10:54 PM.
