09/25/1989 - Regular - MinutesPort Orchard, Washington September 25, 1989 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson, Childress, Wilson, Geiger, Powers, Smith and Grable. Staff present:.City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Councilman Wilson led the audience and Council in the Pledge of Allegiance. Councilman Grable moved to approve the minutes of the August 11, 1989 meeting, seconded by Councilman Clauson and carried. Rich Medved requested a one year extension of the Commercial General zone classification for the South Kitsap Plaza, 1800 Highway 150. On motion by Councilman Wilson, seconded by Councilman Clauson, Council granted a one year extension for the Commercial General zone classification for the South Kitsap Plaza Project, 1800 Hwy. 160. On motion by Councilman Geiger, seconded by Councilman Wilson, Council unanimously adopted Resolution No. 1518, allowing for the waiver of monthly sewer fees of City owned and operated facilities when the water is turned off. On motion by Councilman Wilson, seconded by Councilman Grable, Council unanimously adopted Resolution No. 1519, repealing Resolution No. 1488 and establishing regulations and fees related to parking, stopping or standing in certain areas of the City. On motion by Councilman Wilson, seconded by Councilman Clauson, Council authorized the City Engineer to negotiate with property owners to obtain a drainage easement in the 400 block of Dekalb. Mayor Weatherill addressed letter from Dr. David Muga, Port Orchard Peace Committee, requesting permission to place directional signs along City right-of-way for their upcoming Community Peace Symposium to be held Saturday, October 14, 1989. On motion by Councilman Wilson, seconded by Councilman Geiger, Council authorized placement of directional signs in City right-of-way for the Community Peace Symposium to be held Saturday, October 14, 1989 at the South Kitsap High School Preforming Arts Center as requested by Dr. David Muga, Port Orchard Peace Committee. September 25, 1989 Page Two Mayor Weatherill opened Public Hearing scheduled for 7:45 PM regarding a Petition to Vacate a portion of Short Avenue. LEGAL DESCRIPTION: That portion of the west half of Short Avenue abutting Lot 1, Block 3 of Sroufe's Addition to Sidney, recorded in Volume 1 of Plats at pages 26, 27 and 28 in Kitsap County, Washington; EXCEPT the south 70 feet thereof. Samuel Fleshman, legal counsel for the Gladys I. Theisen estate, briefed Council on motivation for this Petition to Vacate and answered questions from the Council and audience. Mayor Weatherill called for public input from the audience either for or against the Petition to Vacate a portion of Short Avenue. Susan Daniels requested all interested property owners be notified of any further discussion concerning this vacation. Alice Baer, 704 Grant Street, opposed the City vacating this portion of Short Avenue right-of-way and expressed concern about effect this action would have on future development. On motion by Councilman Powers, seconded by Councilman Wilson, Council continued Public Hearing relevant to Petition to Vacate a portion of Short Avenue to October 9, 1989 at 8:15 PM. Property owners who could be affected will be notified of continued hearing. Mayor Weatherill opened Public Hearing scheduled for 8:00 PM regarding a request for a zone reclassification from Residential -High to Multiple -Family 20, as submitted by Frank R. Haberlach, to add two living units and a four car garage onto an existing residence at 225 Sidney, Engineer Curles reviewed Planning Commission recommendations and further recommended a site plan be included as an integral part of this rezone if approved. Frank Haberlach, proponent, availed himself to answer questions from the Council and audience. Mayor Weatherill called for public input either for or against the proposed zone reclassification. As no response was received, Mayor Weatherill declared this Public Hearing closed and referred matter to Council for consideration. Councilman Powers moved to adopt Planning Commission Resolution No. 133-89 setting forth findings of fact, conclusion and conditions as their own and approved this zone reclassification from Residential -High to Multiple -Family 20 as submitted by Frank R. Haberlach in order to add two (2) living units and a four (4) car garage onto an existing residence at 225 Sidney, seconded by Councilman Smith and carried. September 25, 1989 Page Three Mayor Weatherill opened Public Hearing scheduled for 8:15 PM regarding a request for a zone reclassification from Residential -High and Commercial - General to Public Properties, as submitted by Kitsap County, (503, 507, 511 and 513 Austin). City Engineer Curles discussed Kitsap County's courthouse expansion plans, and recommended Council accept input from audience on the pros and cons of this issue and then continue Public Hearing to a date which will coincide with City's adoption of revised zoning ordinance. Mayor Weatherill requested testimony from anyone either for or against the proposed zone reclassification as requested by Kitsap County. Ralph Anderson, Project Manager for Kitsap County, requested approval of the zone reclassification and availed himself to answer questions from the Council. Howard Minor, 1400 Bay Street, spoke in favor of the Courthouse expansion and this rezone application. Mayor Weatherill called for further input either for or against the proposed zone reclassification. As no further input was received Mayor Weatherill closed public input portion of Public Hearing and referred matter to Council for their consideration. On motion by Councilman Geiger, seconded by Councilman Grable, Council continued the Public Hearing relevant to Kitsap County Zone Reclassification Application to October 23, 1989 at 8:00 PM (503, 507, 511 and 513 Austin). LEGAL DESCRIPTION: Section 26, Township 24 North, Range I East, W.M., Plat of Sidney S.M. Stevens', Block 18, Lots 1, 2, 3 and 4. Located within Kitsap County, Washington. At 9:05 PM Mayor Weatherill declared a 5 minute recess. Mayor Weatherill opened Public Hearing scheduled for 8:30 PM regarding an application for a zone reclassification from Residential -Low and Residential -High to Multiple -Family 20, as submitted by Group Health, Gary Gartin, agent, in order to construct a medical facility located on the northwest corner of Tremont, Alder and Pottery. City Engineer Curles reviewed the three phases of the proposed Group Health development. Gary Gartin, representing Group Health, spoke concerning the proposed development and answered questions. Mayor Weatherill called for public input either for or against the proposed zone reclassification as submitted by Group Health. September 25, 1989 Page Four Don Miller, 312 Alder Lane W., requested Council consider vacating and blocking off a portion of Alder Lane to alleviate some of the traffic concerns in the area. Samuel Huff, 321 Tremont Street W., voiced concern about increased traffic on Tremont Street. David Simpson, 362 Sunset Lane W., opposed the rezone citing a precedent will be established which could bring additional commercial growth to the area. Mr. Simpson stated this is not a suitable area for a medical facility. Mayor Weatheriil called for additional input regarding this rezone. As no further input was received, Mayor Weatheriil closed public input portion of Public Hearing and referred matter to Council for their consideration. After considerable discussion by Councilmembers, Councilman Clauson moved to reopen Public Hearing for further discussion, seconded by Councilman Wilson and carried. Jeff West, Supervisor of Operations, Brem-Air Disposal, expressed concerns about proposed right-in/right-out only turns onto Tremont street. Don Miller, 312 Alder Lane W, repeated request for consideration of blocking Alder Lane to through traffic when a traffic signal is installed at Pottery and Tremont. Receiving no additional public input, Mayor Weatherill closed public input portion of hearing. On motion by Councilman Clauson, seconded by Councilman Powers, Council adopted, as their own, Planning Commission Resolution No. 134-89, setting forth findings of fact, conclusion and conditions and approved this zone reclassification from Residential -Low and Residential -High to Multiple -Family 20, as submitted by Group Health, Gary Gartin, agent, with the following additional conditions 1) ingress and egress on Pottery Avenue; 2) at appropriate time the developer agrees to participate in a percentage of the costs for installing a traffic signal at Pottery and Tremont. This will allow construction of a medical facility located on the northwest corner of Tremont, Alder and Pottery. Motion passed with 6 ayes and I nay. Councilman Geiger voting nay. LEGAL DESCRIPTION: That portion of the northeast quarter of the southeast quarter of Section 34, Township 24 North, Range 1 East, W.M., in Kitsap County, Washington, described as follows: Beginning at the northeast corner of said northeast quarter of the southeast quarter; thence west along the north line thereof west 786 feet; thence south 839.2 feet to the northerly margin of Tremont Street; thence northeasterly along the northerly margins of Tremont Street and Alder Lane and its projection easterly to the east line of said section; thence north along the east line of said section to the true point of beginning; except Pottery Hill Road; situated in Kitsap County, Washington. September 25, 1989 Page Five Mayor Weatherill opened Public Hearing scheduled for 8:45 PM regarding an application for a Special Use Permit, as submitted by Thomas G. Carlyle, to allow the construction of a 233 unit mini -storage facility, together with an office and a resident manager's apartment located on the northwest corner of SR160 and the high school access road. City Engineer Curles gave staff report discussing zoning, access and topography details relevant to this Special Use Permit application. Mark Kulhman, Pac-Tech, presented a proposed plot plan and advised Council at the present time there is no access onto the high school road; there would be stream relocation and enhancement for the project; and that a maximum of 230 mini storage unit available on the site. Tom Jeatran, 903 Kitsap Street, co-owner of subject property spoke concerning the high school road access and the stream relocation project. Bud Buckley, agent for proponent, informed Council the proposed plot plan is flexible enough to allow access from Plisko Lane. Mr. Buckley availed himself to answer questions from the Council. Dick Jacobsen, co-owner of adjacent property, supported concept of extending Plisko Lane but he could not commit without discussing matter with partner. Ken Davis, 1071 Plisko Lane, advocated approval of granting the Special Use Permit and the concept of extending Plisko Lane east to the proposed development. Mayor Weatherill called for further public input concerning this Special Use Permit application. As no response was received from the audience, Mayor Weatherill closed public input portion and referred matter to Council for consideration. On motion by Councilman Geiger, seconded by Councilman Wilson, Council adopted Planning Commission Resolution No. 135-89 as their own and approved issuance of a Special Use Permit to Thomas Carlyle allowing the construction of a 233 unit mini -storage facility, together with an office and a resident managers apartment located on the northwest corner of SR160 and the high school access road. LEGAL DESCRIPTION: The northerly 405 feet of that portion of the southeast quarter of the southwest quarter, Section 25, Township 24 North, Range 1 East, W.M., in Kitsap County, Washington, described as follows: Beginning at the southwest corner of the east half of the southeast quarter of said southwest quarter; thence north 660 feet; thence east 209 feet; thence south 627 feet; thence west 197 feet; thence south 33 feet; thence west to the point of beginning; except State Highway No. 14 along the south boundary. September 25, 1989 Page Six Mayor Weatherill declared a 5 minute recess at 10:50 PM. Jeff West, Supervisor of Operations, Brem-Air Disposal, Inc., informed Council that the Recycling Program Grant (Bremerton lead agency) was denied, unfortunately this will result in the termination of the pilot recycling program in the City of Port Orchard in the near future. Jeff West, Brem-Air Disposal, Inc., requested permission to lease a portion of City property on Old Clifton Road for siting large containers. On motion by Councilman Wilson, seconded by Councilman Grable, Council authorized the City Engineer to allow storage of Brem-Air Disposal containers on City property on Old Clifton Road, on a 30 day trial basis. Mayor Weatherill notified Council he had reluctantly accepted the resignation of Marven Parks from the Port Orchard Planning Commission and announced his intent to appoint Kenneth Davis, 1071 Plisko Lane to the Planning Commission to fill this vacancy. On motion by Councilman Clauson, seconded by Councilman Wilson, Council concurred with Mayor Weatherill and confirmed the appointment of Kenneth Davis to fill the unexpired term of Marven Parks to the Port Orchard Planning Commission. On motion by Councilman Grable, seconded by Councilman Smith, Council authorized the placement of one practice board at each City tennis court. On motion by Councilman Geiger, seconded by Councilman Wilson, Council set October 3, 1989 ate-34—PM as date and time for a study session for proposed Zoning Ordinance No. 146T.—J'3!c Dt�j rr ; .+�rrPeflo Councilman Geiger moved to remove from table Unfinished Agenda Item Number 5; Kitsap Transit regarding bench placement in the City, seconded by Councilman Grable and carried. John Clauson of Kitsap Transit, advised Council of the status of proposal to place benches along City bus routes. Kitsap Transit will furnish additional information concerning the bus benches. (Councilman Clauson had stepped down from Council table due to conflict of interest.) Mayor Weatherill adjourned Council into Executive Session to discuss proposed fire service contract with Fire District No. 7 for 30 minutes. On motion by Councilman Powers, seconded by Councilman Grable, Council authorized Police Chief Mathews to accept $200.00 from the Port Orchard Rotary Club for portable radio crystals. September 25, 1989 Page Seven Councilman Clauson authorized the City Engineer and Police Chief to secure and repair the evidence room door, seconded and carried. Councilman Powers moved to authorize the Mayor to discuss, with the Kitsap County Commissioners, Kitsap County's Concept Master Plan which covers all of the County courthouse expansion plans, seconded by Councilman Clauson and carried. The City Council requested the City Engineer prepare a draft Ordinance to adopt the BPA Energy Codes. On motion by Councilman Clauson, seconded by Councilman Grable, Council excused Councilman Smith from the October 9, 1989, City Council meeting. Councilman Smith moved to (1) stop fire service contract negotiations with Kitsap County Fire District No. 7; and (2) to adopt the Five Year Master Plan as presented by Fire Chief Snow, seconded by Councilman Grable, and carried. Motion passed with 4 ayes and 3 nays. Councilmen Geiger, Wilson and Clauson voting nay. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. Councilman Geiger moved to approve payment of those vouchers presented by the City Clerk, seconded by Councilman Grable. Councilman Geiger moved to amend motion to deny claim to Thompson Publishing Group in the amount of $194.25, seconded by Councilman Powers and carried. Original motion as amended to approve payment of Claim Warrant No. 12372-12413 in the amount of $25,513.90 with claim voucher to Thompson Publishing Group in the amount of $194.25 denied, seconded and carried. On motion by Councilman Clauson, seconded by Councilman Grable, Council amended the policy which authorizes reimbursement of the cost of meals purchased by City officials and/or employees while conducting City business, to include cost of meals inside the City limits. On motion by Councilman Wilson, seconded by Councilman Geiger, Council authorized the placement of two handicap parking spaces, in the 700 block of Sidney Avenue, as requested by the Bethany Lutheran Church.
