10/09/1989 - Regular - MinutesPort Orchard, Washington October 9, 1989 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. Councilmembers present: Childress, Wilson, Geiger, Powers and Grable. Councilman Smith excused and Councilman Clauson absent. Staff present: City Attorney McCiuskey, Deputy Clerk Thomas, City Treasurer Miller, Police Sergeant Duncan, City Engineer Curles, Fire Chief Snow and City Clerk Mower. Councilman Childress led the audience and Council in the Pledge of Allegiance. On motion by Councilman Powers, seconded by Councilman Grable, Council approved the minutes of the September 25, 1989 meeting with the following correction: Page 6 Paragraph 8 - Change 7:30 P.M. to 8:00 P.M. Sharon Newell, Librarian for the Port Orchard Branch of Kitsap Regional Library introduced herself and Library Board members Melody Sapp and Kay Morrison. Ms. Newell referenced progress report previously submitted and thanked the Mayor and City Council for their interest and support. Mayor Weatherill announced he has received notification from the Municipal Treasurers Association of United States and Canada that our City Treasurer Kristine L. Miller has been awarded the professional credential of Certified Municipal Finance Administrator (CMFA). Less than 300 Municipal Finance Officers in the United States and Canada have earned this honor. The Mayor and City Council congratulated Ms. Miller and voiced their pride and appreciation for her many achievements. Clyde Stricklin, President of the Bremerton/Kitsap County Visitors and Convention Bureau, and members of the South Kitsap Chamber of Commerce and Port Orchard Bay Street Merchants Association submitted requests for 1990 Budget allocations. Mayor Weatherill reopened continued Public Hearing scheduled for 7:45 PM regarding a request for a zone reclassification from Residential Low and Commercial General to Public Properties, as submitted by Kitsap County in order to bring the area into conformance with the City's Zoning Ordinance, located at 611, 613, 614, 617, 619 Division; 704; 712, 716 Sidney; 651 and 707 Taylor. All properties are within one (1) block of and including the Kitsap County Courthouse. LEGAL DESCRIPTION: Section 26, Township 24 N, Range 1E, W.M., Sidney S.M. Stevens' Addition, Block 5, Lot 2, 3, 6, 7 & 10 and Sweany's Addition to Sidney Lots 1 to 12 Block 1; also Lots 1 to 5, Block 2; also Lots 1 to 5 & the N 10 ft of Lot 9 and all Lot 10 Block 3; also Lots 2 to 9 Block 4, including all vacated roads; also Lot 1 & 10 to 12 Block 4; also Lot 7, 8 and the south 40 feet of Lot 9, Block 3; Kitsap County, Washington. Mayor Weatherill called for public input on application for zone reclassification for Kitsap County properties located on Division Street, Sidney Avenue and Taylor Street. Ralph Anderson, Project Manager for Kitsap County, requested Council proceed with action on this application and urged approval of this zone reclassification. October 9, 1989 Page Two On motion by Councilman Geiger, seconded by Councilman Wilson, Council continued Public Hearing to October 23, 1989 at 7:45 PM on an application for zone reclassification submitted by Kitsap County. Subject properties are located at 611, 613, 614, 617, 619 Division; 704, 712, 716 Sidney; 651 and 707 Taylor. On motion by Councilman Geiger, seconded by Councilman Grable, Council continued Public Hearing to October 23, 1989 at 8:15 PM regarding a Petition to Vacate a portion of an unnamed alley between Division and Dwight Streets (700 block) as submitted by Kitsap County. Councilman Geiger moved to accept proposed 1990 Animal Control Agreement with Kitsap Co. Humane Society and authorized the Mayor to sign Agreement documents, seconded by Councilman Wilson and carried. Mayor Weatherill submitted proclamation declaring week of October 15 through 21 as National Business Women's Week and urged all citizens and organization to join in this salute to working women by encouraging and promoting the celebration of the achievements of all business and professional women. Councilman Wilson moved to confirm designation of the week of October 15 through 21 as National Business Women's Week, seconded by Councilman Grable and carried. On motion by Councilman Powers, seconded by Councilmen Wilson and Grable, Council adopted Resolution No. 1520 authorizing the issuance of a Special Use Permit to Thomas Carlyle which allows construction of a 233 unit mini -storage facility, together with an office and a resident manager's apartment in the northwest corner of SR160 and the high school access road. LEGAL DESCRIPTION: The northerly 405 feet of that portion of the southeast quarter of the southwest quarter, Section 25, Township 24 North, Range I East, W.M., in Kitsap County, Washington, described as follows: Beginning at the southwest corner of the east half of the southeast quarter of said southwest quarter; thence north 660 feet; thence east 209 feet; thence south 627 feet; thence west 197 feet; thence south 33 feet; thence west to the point of beginning; except State Highway No. 14 along the south boundary. On motion by Councilman Grable, seconded by Councilman Wilson, Council approved Ordinance No. 1470 amending the Port Orchard Zoning Ordinance 1163 and the Area and Use Maps thereof to reclassify certain property located at 225 Sidney, Frank Haberlach, owner of record, from Residential -High to Multiple -Family 20 to allow construction of two (2) additional living units and a four (4) car garage onto an existing residence. LEGAL DESCRIPTION: Section 26, Township 24 N Range 1E, W.M., Sidney Ist Addition, Block 012, Lot 10. Councilman Wilson presented motion, which was seconded by Councilman Grable, to approve Ordinance No. 1471 amending the Port Orchard Zoning Ordinance 1163 and the Area and Use Maps thereof to reclassify certain property located on the northwest corner of Tremont Street, Alder Lane and Pottery Avenue from Residential -Low and Residential -High to Multiple -Family 20, as submitted by Group Health, Gary Gartin, agent, with conditions as set forth in Planning October 9, 1989 Page Three Commission Resolution No. 134-89 and the following additional conditions: 1) ingress and egress on Pottery Avenue; 2) at appropriate time the developer agrees to participate in a percentage of the costs for installing a traffic signal at Pottery and Tremont. Councilman Geiger moved to amend motion to change additional condition (#2) to state: the developer agrees to participate in a prorata percentage of the costs for installing a traffic signal at Pottery and Tremont, at the appropriate time. Prorata percentage to be based on traffic count. Also add condition that the site plan as presented with zone reclassification application be an integral part of this rezone approval, seconded by Councilman Powers and carried. Council unanimously approved the original motion as amended to approve Ordinance No. 1471 amending the Port Orchard Zoning Ordinance 1163 and the Area and Use Maps thereof to reclassify certain property located on the northwest corner of Tremont Street, Alder Lane and Pottery Avenue from Residential -Low and Residential -High to Multiple -Family 20, as submitted by Group Health, Gary Gartin, agent, with the following additional conditions 1) ingress and egress on Pottery Avenue; 2) to state the developer agrees to participate in a prorata percentage of the costs for installing a traffic signal at Pottery and Tremont, at the appropriate time. LEGAL DESCRIPTION: That portion of the northeast quarter of the southeast quarter of Section 34, Township 24 North, Range I East, W.M., in Kitsap County, Washington, described as follows: Beginning at the northeast corner of said northeast quarter of the southeast quarter; thence west along the north line thereof west 786 feet; thence south 839.2 feet to the northerly margin of Tremont Street; thence northeasterly along the northerly margins of Tremont Street and Alder Lane and its projection easterly to the east line of said section; thence north along the east line of said section to the true point of beginning; except Pottery Hill Road; situated in Kitsap County, Washington. Councilman Grable moved to adopt Ordinance No. 1472 amending Ordinance No. 1433 by amending the salary schedule for employees of the City of Port Orchard for the year 1989. This provides for a 4.3% cost of living increase as set forth by union contracts, seconded by Councilman Geiger and carried. Councilman Wilson moved to approve Ordinance No. 1473 fixing the amount of ad valorem taxes to be raised for the year 1990, seconded by Councilman Grable and carried. At this time, Mayor Weatherill reopened Public Hearing concerning Petition to Vacate a portion of Short Avenue as submitted by Samuel Fleshman, legal counsel for Mr. Ray E. Fraley, personal representative of the Gladys Theisen estate. City Engineer Curles gave staff report concerning Petition to Vacate a portion of Short Avenue. October 9, 1989 Page Four Mayor Weatherill called for public input on Petition to Vacate a portion of Short Avenue. Bill Kamps, Attorney for V.F.W. Trust, requested approval be granted so scholarship funds may become available for two South Kitsap High School students. Mary Hendrick, 100 Bay Street, spoke in favor of the vacation, but expressed concern about Short Avenue being an accessible road. City Engineer Curles advised Ms. Hendrick, the road would still be maintained and accessible. Mayor Weatherill called for further input either for or against the proposed street vacation. As no further input was received Mayor Weatherill closed Public Hearing and referred matter to Council for their consideration. Councilman Wilson moved to take no action at this time, until a survey was done on property in question, seconded by Councilman Childress. Motion failed with 4 nayes and 1 aye. Councilman Wilson voting aye. Councilman Powers moved to grant a vacation of that portion of Short Avenue which contains, if any, a present structure (J & J Printing, 118 Bay Street) on the right-of-way, to include that portion of the said west half of Short Avenue lying more than 4.11 feet east of the eastern most corner of the building, seconded by Councilman Grable and carried with 4 ayes and 1 nay. Councilman Wilson voting nay. The City Attorney shall prepare the proper legal description. At 9:05 PM Mayor Weatherill declared a 5 minute recess. On motion by Councilman Powers, seconded by Councilman Grable, Council authorized compensation from the vacated portion of Short Avenue right-of-way be redistributed from Street Fund to the Designated Unreserved Fund Balance for Parks. Councilman Grable excused Councilman Clauson from the Council meeting, seconded by Councilman Geiger and carried. Mayor Weatherill set October 11, 1989 at 8:00 PM as a study session for proposed Ordinance No. 1469 regarding City of Port Orchard Zoning Ordinance. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. October 9, 1989 Page Five On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 12414-12499 in the amount of $92,583.77 and September, 1989 Payroll Warrant No. 110835-110998 in the amount of $157,872.33. City Engineer Curles reported on "Clean -Up Week" which was coordinated with South Sound Sanitation and advised Council that 35 truck loads of garbage was hauled to the dump. This event was well received by the residents of the City. On motion by Councilman Wilson, seconded by Councilman Grable, Council authorized the Mayor to sign a Quit Claim Deed for an abandoned water utility easement across property located at 510 DeKalb. On motion by Councilman Wilson, seconded by Councilman Childress, Council authorized the City Attorney to prepare necessary papers for the City to have Alder Lane dedicated as a public road.
