10/23/1989 - Regular - MinutesPort Orchard, Washington October 23, 1989 Council of the City of Port Orchard, Washington called to regular session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers present: Clauson, Childress, Wilson, Geiger, Powers, Smith and Grable. Staff present: City Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Councilman Geiger led the audience and Council in the Pledge of Allegiance. Councilman Grable moved to approve the minutes of the October 9, 1989 meeting, seconded by Councilman Geiger and carried. Robert Ojima, Port Orchard Bay Street Association, discussed 1990 Budget requests for Christmas decorations, plants, etc. He also rescinded their original request for 75% of Hotel/Motel Tax monies from the 1990 Budget. The Bay Street Association is supporting the proposal of the South Kitsap Chamber of Commerce Tourism Marketing Program to share Hotel/Motel funds with Bremerton Kitsap County Visitor and Convention Bureau. Ron Henshaw, representing the Mosquito Fleet Days, requested $1,000.00 allocation from the 1990 budget. Council thanked Mr. Henshaw and Mr. Ojima for Budget request presentations and took matter under advisement. Mayor Weatherill reopened continued Public Hearing scheduled for 7:45 PM regarding a request for a zone reclassification from Residential Low and Commercial General to Public Properties, as submitted by Kitsap County in order to bring the area into conformance with the City's Zoning Ordinance, located at 611, 613, 614, 617, 619 Division; 704; 712, 716 Sidney; 651 and 707 Taylor. All properties are within one (1) block of and including the Kitsap County courthouse. Ralph Anderson, Project Manager for Kitsap County, availed himself to answer questions from the Council and audience. Mayor Weatherill called for public input on application for a rezone of Kitsap County properties located on Division Street, Sidney Avenue and Taylor Street. As no response was received, Mayor Weatherill declared this Public Hearing closed and referred matter to Council for consideration. Councilman Geiger moved to adopt Planning Commission Resolution No. 129-89 setting forth findings of fact, conclusion and conditions as their own and approved this zone reclassification from Residential Low and Commercial General to Public Properties as submitted by Kitsap County, in order to bring the area into conformance with the City's Zoning Ordinance, located at 611, 613, 614, 617, 619 Division; 704; 712, 716 Sidney; 651 and 707 Taylor. October 23, 1989 Page Two Councilman Powers moved to amend motion to prohibit any additional ingress or egress on Sidney Avenue, seconded by Councilman Geiger. On motion by Councilman Wilson, seconded by Councilman Geiger, Council set November 131 1989 at 7:45 PM as date and time for a meeting with property owners relevant to Notice of Intent to Annex, as submitted by Vine Street Corp., First National Bank of Port Orchard and American Savings Bank (approximate location east of Retsil Road to theatre complex - north of SR160 to 4th Street and Orlando Street). On motion by Councilman Wilson, seconded by Councilman Geiger, Council adopted Resolution No. 1521, authorizing segregation of properties with ULID#1 (Account #46090000080603 Parcel Number 2446B - Hegegada). Councilman Wilson moved to adopt Ordinance No. 1474 approving the zone reclassification from Residential -Low to Commercial General as submitted by Greg and Deborah Meakin in order to construct a 4040 sq. ft. single story/retail building with accessory parking at 2431 Bethel Avenue, seconded by Councilman Grable and carried. LEGAL DESCRIPTION: That portion of the southwest quarter of the northwest quarter of Section 36, Township 24 North, Range 1 East W.M., in Kitsap County, Washington, described as follows: Beginning at the point of intersection of the south line of said southwest quarter of the northwest quarter with the east margin of State Highway Number 14; thence N 3*20'30" E 100 feet; thence S 89*19'00" E to the west margin of Mitchell Road; thence south along said west margin of Mitchell Road; thence south along said west margin of Mitchell Road to the south line of said southwest quarter of the northwest quarter; thence west along the south line thereof to the point of beginning. Except the East 225 feet thereof. Mayor Weatherill reopened continued 8:00 PM Public Hearing regarding a request for a zone reclassification from Residential -High and Commercial -General to Public Properties, as submitted by Kitsap County for properties located at 503, 507, 511 and 513 Austin. October 23, 1989 Page Three Mayor Weatherill called for public input on the application for zone reclassification for Kitsap County properties located on Austin Avenue. Ralph Anderson, Project Manager for Kitsap County, discussed Kitsap County's courthouse expansion plan and answered questions from the Council and audience. Mayor Weatherill requested testimony from anyone either for or against the proposed zone reclassification of Austin Street properties as requested by Kitsap County. As no response was received, Mayor Weatherill declared this Public Hearing closed and referred matter to Council for consideration. On motion by Councilman Geiger, seconded by Councilman Wilson, Council moved to adopt Planning Commission Resolution No. 132-89 setting forth findings of fact, conclusion and conditions as their own and approved this zone reclassification from Residential -High and Commercial -General to Public Properties, as submitted by Kitsap County, located at 503, 507, 511 and 513 Austin, with the following additional conditions: 1) The rezone be site plan specific; 2) The County install an 8 inch water main on Division Street from Sidney Avenue to Cline Avenue and one hydrant with storz coupling to provide adequate fireflow; 3) Fifteen parking spaces of off street parking be designated for public parking to exclude employee parking; 4) Concrete sidewalks on both sides of Division Street from Sidney to Austin and along both sides of Austin and Dwight Street be constructed; 5) The height of the building can exceed 33 feet if adequate fire fighting provisions are included and approved by the City Fire Chief. Mayor Weatherill reopened continued Public Hearing scheduled for 8:15 PM regarding a Petition to Vacate a portion of an unnamed alley between Division and Dwight Streets (700 block) as submitted by Kitsap County. Ralph Anderson, Project Manager for Kitsap County, updated Council on development planned between Division and Dwight Streets. Mayor Weatherill called for public input either for or against the proposed Petition to Vacate a portion of an unnamed alley between Division and Dwight Street. As no response was received, Mayor Weatherill closed Public Hearing portion and referred matter to Council for their consideration. Councilman Wilson moved to approve Petition to Vacate a portion of an unnamed alley between Division and Dwight Streets (700 block) as submitted by Kitsap County, seconded by Councilman Geiger. Councilman Powers moved to amend motion to authorize compensation from the vacated portion of an unnamed alley between Division and Dwight Street be redistributed from Street Fund to the Designated Unreserved Fund Balance for Parks, seconded by Councilman Smith and carried. October 23, 1989 Page Four Council unanimously approved the original motion as amended to approve Petition to Vacate a portion of an unnamed alley between Division and Dwight Streets (700 block) as submitted by Kitsap County with compensation from the street vacation to be redistributed from Street Fund to the Designated Unreserved Fund Balance for Parks. LEGAL DESCRIPTION: That portion of an unnamed alley in Block 18 of the plat of S.M. Stevens' Town Plat of Sidney, as recorded in vol. 1 page 1 of Plats, records of Kitsap County, Washington, more particularly described as follows: Beginning at the southwest corner of Block 18, Lot 2 of said plat, being the point of beginning of this description; thence east along the south line of said Lot 2, 150 feet to the southeast corner thereof; thence south 16 feet to the northeast corner of Block 18, Lot 3 of said plat; thence west along the north line of said Lot 3, of said plat; thence west along the north line of said Lot 3, 150 feet to the northwest corner of thereof; thence north along the east right of way line of Austin Avenue as depicted on said plat, 16 feet to the point of beginning. On motion by Councilman Clauson, seconded by Councilman Childress, Council authorized the City to accept five (5) firearms valued at approximately $2,900.00. This was a court ordered restitution from a fraud investigation. On motion by Councilman Geiger, seconded by Councilman Clauson, Council concurred on the adoption of the 1990 budget for the Joint Wastewater Sewer Treatment Plant. Lorraine Davidson and George Wagner, addressed Council concerning City right-of-way abutting her property and requested information on street vacation procedures. At 8:50 PM Mayor Weatherill declared a 5 minute recess. On motion by Councilman Geiger, seconded by Councilman Clauson, Council removed from the Unfinished Business Agenda item number 1, proposed Zoning Ordinance No. 1469. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. Councilman Geiger moved to approve payment of those vouchers as follows: Claim Warrant No. 12500-12527 in the total amount of $19,848.04, seconded by Councilman Clauson and carried. Mayor Weatherill announced the appointment of Martin Mittet to a four year term as the Municipal Court Judge to expire on December 31, 1993. On motion by Councilman Wilson, seconded by Councilman Grable, Council concurred with Mayor Weatherill's appointment of Martin Mittet to a four year term as the City of Port Orchard Municipal Court Judge to expire on December 31, 1993. October 23, 1989 Page Five On motion by Councilman Powers, seconded by Councilman Smith, Council authorized Councilman Powers to be excused from the November 13, 1989 Council meeting. On motion by Councilman Geiger, seconded by Councilman Wilson, Council set November 13, 1989 at 8:00 PM as date and time for Public Hearing to discuss proposed Zoning Ordinance No. 1469. On motion by Councilman Clauson, seconded by Councilman Wilson, Council authorized the City Engineer to negotiate a contract with Olson and Associates for the design plans of the Annapolis Water Reservoir.
