02/08/1988 - Regular - MinutesPort Orchard, Washington February 8, 1988 Council of the City of Port Orchard, Washington was called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Childress, Wilson, Geiger, Powers and Grable. Also present: Attorney McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. On motion by Councilman Grable, seconded by Councilman Clauson, Council approved the minutes of the January 25, 1988 meeting as distributed. Mayor Weatherill requested nominations for the position of Mayor Pro-tem. This position is vacant due to the death of Councilman/ Mayor Pro-tem Gerald H. Grosso on February 4, 1988. Two nominations were received and accepted as follows: Councilman Clauson nominated Councilman Geiger and Councilman Geiger nominated Councilman Wilson. Voting by a show of hands, Council elected Councilman Geiger to the position of Mayor Pro-tem. Mayor Weatherill informed those present that proposed Ordinance No. 1412 (Buckley Zone Reclassification) has been held over until a later date at the request of the property owners. George Buckley, AMB Joint Ventures has reopened negotiations with the adjoining property owner (South Kitsap Mall) to resolve mutual concerns. On motion by Councilman Wilson, seconded by Councilman Grable, Council approved Ordinance No. 1413 vacating a portion of Taylor Street Right -of -Way to Dr. Robert Browning. (Public Hearing was held December 14, 1987. Vacation was authorized with compensation set at Seven Thousand One Hundred Ninety -Eight Dollars and Twenty Cents for Dr. Browning's portion of this vacation. Compensation has been paid on Treasurers Receipt No. 15299) LEGAL DESCRIPTION: The north half of Taylor (Central) Street abutting the southerly property line of Lot 15, Block 1, Tom Clines Addition to Sidney, recorded in Volume 1 of Plats, Page 29, records of Kitsap County, Washington. Mayor Weatherill addressed Claim for Damages received from Myrle J. Howell, Jr. for damages to windshield of vehicle. After much discussion by Councilmembers, Councilman Wilson moved to accept Claim for Damages and pay low bid of One Hundred Seventy -Six Dollars and Seventy Six Cents, seconded by Councilman Clauson and carried. Councilman Clauson moved to approve Ordinance No. 1414 vacating a portion of Taylor Street Right -of -Way to Gary Kucinski, HMI., seconded by Councilman Grable and carried. (Public Hearing was held December 14, 1987. Vacation was authorized with compensation set a Seven Thousand One Hundred Ninety -Eight Dollars and Twenty Cents for Mr. Kucinski's, (HMI) portion of this Vacation. Compensation has been paid on Treasurer Receipt No. 15300). On motion by Councilman Wilson, seconded by Councilman Clauson, Council approved Ordinance No. 1415 repealing Ordinance No. 1380; Ordinance No. 1356; Ordinance No. 1355; Ordinance No. 1152, Section 14; Ordinance No. 1054, Section 2 relating to parking regulations and parking meters. February 8, 1988 Page Two Councilman Geiger moved to adopt Resolution No. 1475 repealing Resolution No. 1473 and Resolution No. 1465 and establishing new regulations and fees relating to parking, stopping or standing in certain areas in the City, seconded by Councilman Grable. Councilman Geiger moved to amend motion to add provision for Van Pool/Car Pool Vehicle Prepaid Parking Passes at 50% of cost of monthly fee for City Parking Lot No. 4, seconded by Councilman Clauson and carried. Council unanimously approved original motion as amended to adopt Resolution No. 1475 repealing Resolution No. 1473 and Resolution No 1465 and establishing regulations and fees related to parking, stopping or standing in certain areas in the City with provision for Lot 4 Van Pool/Car Pool Parking Pass at 50% of cost of regular monthly parking pass. On motion by Councilman Geiger, seconded by Councilman Clauson, Council excused Councilwoman Powers from the February 22, 1988 meeting to allow her to attend a meeting in Washington, DC. Mayor Weatherill appointed Councilmembers Clauson, Geiger and Childress as Screening Committee to review current applications for Council position and make recommendation for Council consideration to fill unexpired term of Councilman Grosso. Councilman Clauson moved to accept additional applications for vacant Council position until February 22, 1988, seconded by Councilman Geiger and carried. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 09726-09880 in the total amount of $77,043.93 and January 1988 Payroll Warrant No. 108421-108529 in the amount of $101,546.10. On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized removal of penalties from 810 Bay Street ULID Account No. 40530120030000 in the amount of $19.84, On motion by Councilman Geiger, seconded by Councilman Clauson, Council approved removal of penalties from 810 Bay Street LID 65 Account No. 15 in the amount of $25.42. Councilman Geiger moved to remove penalties in the amount of $1,632,10 from Water/Sewer Utility Account No. 0003018000 (810 Bay. Street), seconded by Councilman Clauson and carried. City Attorney McCluskey reported that the City has been dismissed from the Georgia and William Minick vs. City of Port Orchard & State of Washington litigation without prejudice. Engineer Curles informed Council that proposals to reroof 810 Bay Street building have been received in the amounts of $4,400 and $3,650. He has accepted the proposal from Jerry Reynolds in the amount of $3,650.
