05/09/1988 - Regular - MinutesPort Orchard, Washington May 9, 1988 Council of the City of Port Orchard, Washington was called to regular session by Mayor Pro-Tem/Councilman Robert Geiger. Councilmembers present: Clauson, Childress, Powers, Smith and Grable. Councilman Wilson absent. Also present: Attorney McCluskey, Deputy Clerk Thomas, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Mayor Pro-Tem Geiger led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Clauson, Council approved the minutes of the April 25, 1988 meeting as distributed. On motion by Councilman Clauson, seconded by Councilman Grable, Council approved the minutes of the May 2, 1988 Special Council meeting as distributed. Councilman Geiger moved to excuse Councilman Wilson from the City Council meeting because he was not feeling well, seconded by Councilman Clauson and carried. On motion by Councilman Clauson, seconded by Councilman Grable, Council authorized the Mayor to sign the Kitsap County Youth Job Training Program Agreement, contingent upon the City Attorney's approval as to form of the Agreement. This Agreement is for the period April 1, 1988 through June 30, 1989 and provides for youth employment with the City through the County Youth Job Training Program. City Clerk reported on bid opening held May 9, 1988 at 4:30 P.M. regarding a Call for Bid for Plumbing-810 Bay Street. Bids were received with required bid bond as follows: Port Orchard Plumbing Altenberg Plumbing A -Plus Mechanical **Engineers Estimate $6,570.00 5,5507.00 (amount typed was intended to be $5,507.00) Bid sheet with price left out of bid package (bid bond was for bid of $4,842.00) **$9,000.00 After much discussion on validity of bids from Altenberg Plumbing and A -Plus Mechanical, Councilman Clauson moved to reject all bids, seconded by Councilman Grable and carried with five ayes and one no. Councilman Childress voting no. On motion by Councilman Clauson, seconded by Councilman Grable, Council authorized the City Engineer to obtain written quotes on the Plumbing-810 Bay Street Project and to proceed with the job, provided quotes conform to bid law limits. Councilman Grable moved to adopt Ordinance No. 1423 relating to the amount for the Faithful Performance Bonds for the officers and employees of the City of Port Orchard, seconded by Councilman Clauson and carried. May 9, 1988 Page Two Mayor Pro-Tem Geiger opened Public Hearing scheduled for 7:45 P.M., regarding an application for a Special Use Permit for property located at 1255 Pottery Ave., as submitted by Father Frederick R. Aylward. The applicant has requested a Special Use Permit to convert an existing residence into a church and parsonage. Mayor Pro-tem Geiger called for public input in favor of Council approving a Special Use Permit to allow a church and parsonage at 1255 Pottery Avenue. Father Fredrick R. Aylward briefly outlined phase 1 and phase 2 of project and responded to Council questions. Mayor Pro-tem Geiger called for input opposed to Council approving a Special Use Permit to allow a church and parsonage at 1255 Pottery Avenue. As no further testimony was received from public, Mayor Pro-tem Geiger closed Public Hearing and referred Special Use Permit application to Council for their consideration. On motion by Councilman Clauson, seconded by Councilman Grable, Council adopted Planning Commission Resolution No. 99-88, with Findings and Facts, Conclusions and Condition, as their own, a'nd approved the issuance of a Special Use Permit to allow a church and parsonage at 1255 Pottery Avenue, as submitted by Father Fredrick R. Aylward. LEGAL DESCRIPTION: Section 35, Township 24 North, Range 1 East, W.M., the West half of the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 35, Township 24 North, Range 1 East, W.M., in Kitsap County, Washington; Except the North 210 feet; Except the South 218 feet; and Except the West 15 feet from County Road No. 76.. On motion by Councilman Grable, seconded by Councilman Clauson, Council approved Ordinance No. 1424 vacating a portion of an alleyway in the 400 block between Dwight and DeKalb Street described as follows: Legal Description: Section 26, Township 24 North, Range 1 East, W.M., in Kitsap County. That alley parallel to DeKalb and Dwight Streets which originates on the East margin of Harrison and extends 85 feet eastward. City Clerk read letter submitted by Thomas Jeatran regarding enforcement of restricted parking. Councilman Clauson moved to refer letter from Thomas Jeatran to the Police Committee, seconded by Councilman Grable and carried. On motion by Councilman Grable, seconded by Councilman Childress, Council removed from the table, the motion as presented at April 25, 1988 Council meeting to establish a 40' loading zone on the West side of Sidney, North of the intersection of Sidney and Bay. Councilman Clauson moved to amend motion to restrict loading zone to passenger load/unload only, seconded by Councilman Grable and carried. Council unanimously approved the original motion as amended to establish a 40' passenger load/unload zone on the West side of Sidney, North of the intersection of Bay and Sidney. May 9, 1988 Page Three Councilman Childress move to authorize the City Engineer to spend approximately $3,000 from the Water/Sewer Equipment Replacement Fund to purchase a "crane hoist", seconded by Councilman Grable and carried. Fire Chief Snow reported the Volunteer Fire Department is holding practice burn at 409 Harrison Avenue on Saturday May 14, 1988 and invited City officials to observe or participate. On motion by Councilman Clauson, seconded by Councilman Childress, Council accepted Kitsap County Sewer District No. 5 Commissioners proposal to use the same treatment plant mainten- ance cost distribution formula for 1988 in 1987. The 1988 formula is 44% City and 56% District. The 1987 formula was 43% City and 57% District. In agreeing to this revision of cost distribution, the 7% deficit will be shared. Specifically, the City will pay an additional 1% ($4,500) and the District will pay 6%. Cost sharing is based on the ERU's from each entity as calculated from individual water meters. Vouchers audited and certified by the auditing officer (City Clerk) as required by R.C.W. 42.24.080, and those expense reimbursement claims certified as required by R.C.W. 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 10292-10386 in the total amount of $74,013.26 and April 1988 Payroll Warrant No. 108750-108916 in the amount of $148,090.40.
