Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill. Councilmembers present:
Clauson, Wilson, Geiger, Powers, Smith and Grable. Councilman
Childress absent. Staff present: City Attorney McCluskey, Deputy
Clerk Thomas, Police Chief Mathews, City Engineer Curles, Fire
Chief Snow and City Clerk Hower.
Councilman Geiger led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Geiger,
Council approved the minutes of the August 8, 1988 meeting as
circulated.
On motion by Councilman Wilson, seconded by Councilman Smith,
Council moved to excuse Councilman Childress from the City
Council meeting.
Mayor Weatherill presented a Civic Service Award to Robert G.
Lloyd for his 20+ years of dedicated community service as City
Clerk and City Councilman.
Susan Caulkins introduced herself to the Mayor and City Council
members as a new attorney from the office of Shiers, Kamps and
Chrey.
Melvin Herr protested the City's action to place a four hour
parking restriction in the 400 block of Bay Street.
On motion by Councilman Geiger, seconded by Councilman Smith,
Council moved to delay action on proposed Resolution No. 1493
(placing a four hour parking restriction in the 400 block of Bay
Street) to allow further review by the Street/Alley Committee.
Councilman Smith, Public Property Committee, reported Decee Parks
has withdrawn her request to use Waterfront Parking Lot No. 4 for
a Halloween Promotion. Ms. Parks has obtained another location
for this event.
Mayor Weatherill requested Street/Alley Committee review
complaints submitted by Dwight Street residences relevant to
lighting and vegetation barrier of Kitsap County Parking Lot on
north side of Division Street.
Vouchers audited and certified by the auditing officer (City
Clerk) as required by RCW 42.24.080 and those expense
reimbursement claims certified as required by RCW 42.24.090 have
been recorded on a listing and made available to the Council.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of those vouchers as
follows: Claim Warrant No. 10771-10835 in the total amount of
$51,655.99.
On motion by Councilman Geiger, seconded by Councilman Clauson
Councilman Jesse Smith was excused from the next three City
Council meetings because he is scheduled for surgery.
Mayor Weatherill opened Public Hearing scheduled for 7:45 PM.
This is the first of two Public Hearings to establish a
Comprehensive Plan Map designation submitted by Brian Horch/David
Herbold Co., Inc. The owners have requested a Comprehensive Plan
Map Designation of Commercial General for property located on
Mitchell Avenue. Legal Description: Attachment "A".

City Engineer briefed Council on location of Horch/Herbold
property and outlined the Planning Commission's recommendation to
establish a Commercial General Designation.
Mayor Weatherill called for public input either for or against
the City establishing a Comprehensive Plan Map Designation of
Commercial General as submitted by Brian Horch/David Herbold Co.,
Inc.
Brian Horch applicant, briefly outlined the proposed uses of the
property and answered questions from the Council.
No testimony was received in opposition to designating subject
property Commercial General.
Mayor Weatherill closed the first Public Hearing to consider
establishing a Comprehensive Plan Map Designation of Commercial
General as submitted by Brian Horch/David Herbold Co., Inc., for
property located on Mitchell Avenue. The second and final
hearing will be September 12, 1988 at 7:45 PM.
Mayor Weatherill opened Public Hearing scheduled for 8:00 PM
regarding request for Zone Reclassification from Green Belt to
Public Property as submitted by City of Port Orchard for property
located on Old Clifton Road. Legal Description - Attachment "B".
City Engineer Curles, spoke on behalf of the City stating the
Zone Reclassification from Green Belt to Public Property will
better reflect the uses of the property.
Mayor Weatherill called for public input in favor of or against
the Zone Reclassification from Green Belt to Public Property.
Errol Dow, property owner adjacent to City property on Old
Clifton Road, spoke in opposition to the Zone Reclassification
from Green Belt to Public Property and requested the gun range be
shut down or steps to be taken to eliminate the sound problems.
Mayor Weatherill called for further public input either in favor
of or opposed to the zone reclassification from Green Belt to
Public Property. As no response was received from the public,
Mayor Weatherill closed Public Hearing and referred rezone
proposal to Council for their consideration.
On motion by Councilman Wilson, seconded by Councilman Powers,
Council moved to adopt Planning Commission Resolution No. 101-88
with Findings and Facts as their own (deleting condition that any
changes in the use of the property be subject to a Public Hearing
before both Planning Commission and the City Council) and
approved rezone application as submitted by the City of Port
Orchard, reclassifying property located on 0ld Clifton Road from
Green Belt to Public Property,
Councilman Clauson moved to authorize an expenditure allowing the
City Engineer to reroof, paint and install gutters on 810 Bay
Street and further authorized the City Enigneer to negotiate with
neighboring property owners to acquire access to the rear of 810
Bay Street building, seconded by Councilman Powers and carried.

Councilman Clauson moved to table motion authorizing an
expenditure which will allow the City Engineer to reroof, paint
and install gutters on 810 Bay Street and also negotiate with
neighboring property owners to gain access to the rear of 810 Bay
Street building, seconded by Councilman Powers and carried.
Mayor Weatherill adjourned Council into Executive Session for 10
minutes to discuss City property.
Meeting adjourned at 9:37 P.M.
