03/09/1987 - Regular - MinutesPort Orchard, Washington March 9, 1987 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Childress, Wilson, Geiger, Lloyd, Grosso and Grable. Also present: City Attorney Haberly, Police Chief Mathews, City Engineer Curles, Fire Chief Snow, Administrative Assistant Thomas, and City Clerk Hower. Councilman Wilson led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Grable, Council approved the minutes of the February 23, 1987 as distributed. Carol Rank, 515 Perry Avenue, spoke concerning fire hydrant in front of her property. Motion as presented at February 23, 1987 Council meeting by Councilman Wilson, to authorize the City Engineer to move the fire hydrant located in front of 515 Perry Avenue, south to the property line carried unanimously. On motion by Councilman Grosso, seconded by Councilman Clauson, Council adopted Ordinance No. 1375 relating to dog license requirements and fees and violations thereof and repealing certain sections of Ordinance Nos. 693, 802, and 907. Councilman Geiger moved to approve Ordinance No. 1376 adopting Flood Damage Prevention Plan, authorizing Findings of Fact, Purpose and Objectives, seconded by Councilman Grable and carried. Motion carried with 6 ayes and 1 nay. Councilman Wilson voting nay. Councilman Grosso moved to approve contract with Kitsap County regarding incarceration of City prisoners in County Jail contingent upon City Attorney's review and approval as to form, and authorized Mayor Weatherill to sign contract document. On motion by Councilman Wilson, seconded by Councilman Clauson, Council approved Resolution No. 1446 approving the issuance of a Special Use Permit to the South Kitsap Family Worship Center to allow a religious facility on property located north of Tremont and east of Canyon Court with the condition that a privacy fence be placed on the western boundary of subject property. Councilman Geiger moved to remove from the table motion to approve Proposed Ordinance No. 1371, seconded by Councilmen Clauson and Grosso and carried. Motion to approve Ordinance No. 1371 presented at the January 12, 1987 council meeting by Councilman Geiger, seconded by Councilman Grosso was unanimously approved authorizing a sewer billing adjustment when vacancies occur in Class I, Class II or Class V units. Councilman Wilson moved to establish a speed limit designation of 35 MPH on Primary SR160 beginning at the west city limits to a point 0.29 miles west of the intersection of West Street and SR160 (Ordinance No. 1377), seconded by Councilman Grosso and carried. March 9, 1987 Page 2 Mayor Weatherill opened Public Nearing scheduled for 8:00 P.M. relevant to City of Port Orchard's intent to create Local Improvement District No. 67 to extend Municipal Sewer Collection System from the vicinity of 1110 Bethel to the vicinity of the southerly city limits on Lincoln Avenue. Councilman Clauson requested to be excused from Council action on this matter due to his affiliation with one of the property owners. Mayor Weatherill excused Councilman Clauson due to his conflict of interest. Attorney Haberly outlined purpose of Public Hearing and instructed audience on procedure to give testimony. Councilman, Grosso informed Council and audience he is related to one of the property owners within the boundaries of proposed L.I.D. No. 67. However, he has no bias for or against the creation of this Local Improvement District and can act without prejudice on this matter. Attorney Haberly asked if anyone objected to Councilman Grosso sitting on Council during the Public Hearing. No objections were voiced by those present. Mayor Weatherill call for Public Input for or against the City's intent to create Local Improvement District No. 67. Doug Clem, Pastor of the Church of the Nazarene, read letter protesting preliminary assessment levied against church property located at 2100 and 2200 Bethel Avenue stating method of assessment is unfair. Richard Capps, 1200 Bethel Avenue, spoke in favor of creation of L.I.D No. 67 but stated cost should be shared equally by all adjacent property owners. Victor Barsay, 2431/2451 Bethel Avenue, submitted testimony supporting creation of L.I.D. No. 67 with property owners sharing expense. Doug Eide, owner of 2475 Bethel Avenue, stated assessments should be concurrent with useable property. Clerk read written protests submitted by Maxine and Worthie Doyle, 1120 Bethel Avenue; Ruby A Roller, 1140 Bethel Avenue; and Karl A Kirn, property owner on Bethel Avenue. Carolyn Mayfield of the Port Orchard Church of the Nazarene, questioned disposition of in -lieu -of assessment fees for future sewer hook ups if sewer main is installed. Mayor Weatherill called for further input in favor of or against proposed Local Improvement District No. 67. No additional public input was heard. Mayor Weatherill closed public input portion of Public Hearing. At the request of Councilman Grosso, City Engineer Curles described properties within boundaries of L.I.D. No. 67 on a topographical map. On motion by Councilman Grosso, seconded by Councilman Grable, Council moved to instruct City staff to review and revise formula for assessments and readvertise City's intent to create L.I.D. No. 67. March 9, 1987 Page 3 Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 8354-8485 in the amount of $66,432.59. Meeting adjourned at 8:50 P.M. Mayor Weatherill reconvened meeting at 8:55 P.M. to discuss Ordinance No. 1375 relating to dog licenses. Councilman Grosso moved to strike the wording "and the calendar year in which it is issued."from Section 3, Line 11 of Ordinance No. 1375; seconded by Councilman Clauson and carried.
