04/27/1987 - Regular - MinutesPort Orchard, Washington April 27, 1987 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Wilson, Geiger, Lloyd, Grosso and Grable. Councilman Childress absent. Also present: City Attorney Sells, Police Chief Mathews, City Engineer Curles, Fire Chief Snow, City Clerk Hower and Administrative Assistant Thomas. Councilman Geiger led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Grable, Council approved the minutes of the March 13, 1987 meeting. Tom Jeatran, 903 Kitsap, submitted petition from concerned citizens (Kitsap Street residents) requesting revision of parking regulations in residential areas. Councilman Wilson moved to proceed with the establishment of a residential parking permit program, seconded by Councilman Grable and carried. Chief Mathews representing residents from 1400 block of Dwight Street and Dennis Goin, Principal, South Kitsap High School, addressed Council regarding request for no parking 9:00 AM - 10:00 AM on Dwight Street (1400 Block across from high school). Mayor Weatherill advised matter could be discussed during consideration of proposed Ordinance No. 1380, prohibiting parking during certain hours on certain streets. Doug Wright, spoke regarding proposed LID for construction of a road on South Flower Street. Henry Lakey, 2498 S. Flower, expressed concern for fixed income residents and how the formation of a LID on South Flower Street would effect them financially. ?� r- ­I-/,ILLt' j Councilman Geiger requested City Engineer meet with ater/Se'•'er Committee and residents of South Flower Street to discuss proposed formation of a LID on South Flower Street, seconded by Councilman Grosso and carried. Richard Gehring, South Kitsap Mall, addressed Council regarding South Kitsap Mall sewer and water bill. Mayor Weatherill requested City Attorney research the water rate ordinance to define "customer". Councilman Wilson moved to approve Ron Ross's request for extension of Commercial General zoning for property at Sidney and Sweany. Extension to be for a period of 18 months, seconded by Councilman Grable. Councilman Geiger moved to table motion to allow zoning ordinance to be amended to include standards for granting time extensions of zoning reclassifications, seconded by Councilman Grable. Motion tied with 3 ayes and 3 nays. Councilmen Grable, Geiger and Lloyd voting aye. Councilmen Grosso, Wilson, Clauson voting nay. Mayor Weatherill voting as chairperson voted nay. Motion failed with 4 nays and 3 ayes. April 27, 1987 Page Two Councilman Geiger moved to approve request submitted by Roland and Roland for extension of Commercial General Zoning for Sedgwick Mall - southwest corner of Sedgwick interchange. Extension to be for a period of 18 months, seconded by Councilman Wilson and carried. Doug Eide addressed Council requesting an extension of Multiple Family Zoning for property located in the northwest corner of Kitsap Street and Harrison Avenue. Councilman Grosso moved to approve Doug Eide's request for an extension of Multiple Family Zoning for property located in the northwest corner of Kitsap Street and Harrison Avenue. Extension to be for a period of eighteen months, seconded by Councilman Grable and carried. Mayor Weatherill called for recess and reconvened meeting at 8:55 PM. Councilman Clauson moved to approve" -Ordinance No. 1378 repealing Ordinance No. 1355 and designating parking areas for certain waterfront parking lots (Lots 1, 2, 3 & 4),seconded by Councilman Grable and carried. Councilman Wilson moved to approve Resolution. No. 1450 designating time and fees for certain waterfront parking lots (Lots 1, 2, 3 & 4) as defined by Ordinance No. 1378, seconded by Councilman Clauson. Councilman Wilson moved to amend motion to delay implementation of Resolution No. 1450, to coincide with establishment of a residential parking permit program, seconded by Councilman Geiger. Original motion as amended to delay implementation of Resolution No 1450 to coincide with establishment of a residential parking permit program, seconded and carried. Councilman Clauson moved to reconsider motion to approve Ordinance No. 1378 repealing Ordinance No. 1355 and designating parking areas for certain water front parking lots, seconded by Councilman Grable and carried. Councilman Grosso moved to amend motion to include provision that Ordinance No. 1378 not be effective until a residential parking permit program is adopted, seconded by Councilman Clauson and carried. Original motion to approve Ordinance No. 1378 with the provision that it will not be effective until a residential parking permit program is adopted, approved unanimously. Councilman Grosso moved to approve Ordinance No. 1379 providing for modification of building and plumbing fees as specified in the Uniform Codes for owner/occupant - 60 years or older with a maximum annual income, together with all persons in the household below the poverty line as established by the Office of Management and Budget in Washington, D.C., seconded by Councilman Lloyd and carried. Councilman Grosso moved to approve Ordinance No. 1380, -amending Port Orchard Municipal Code Section 10.12.020 prohibiting parking during certain hours on certain streets with the following addition "(h) 1400 block of Dwight Street from nine a.m. to ten a.m.", seconded by Councilman Geiger and carried. April 27, 1987 Page Three Councilman Clauson moved to approve Resolution No. 1451 declaring City of Port Orchard's intent to create Local Improvement District to extend municipal sewer collection system from the vicinity of 1110 Bethel to the southerly City limits on Lincoln Avenue for a distance of approximately 3,050 feet, seconded by Councilman Geiger and carried. Councilman Clauson moved to approve Resolution No. 1447 authorizing an interfund transfer loan for the By -Pass Fund, seconded by Councilman Geiger and carried. Councilman Grosso moved to approve Resolution No. 1448, authorizing issuance of Special Use Permit to Joan Case for a specific use of a parcel of property located at 904 Dwight which is in harmony with the various elements or objectives of the comprehensive plan and is not detrimental to existing uses permitted in that particular zone, seconded by Councilman Clauson. Motion passed with 4 ayes and 2 nays. Councilmen Wilson and Grable voting nay. Councilman Wilson moved to approve Resolution No. 1449, setting forth a policy for providing secondary treatment of wastewater to properties outside the original U.L.I.D. No. 1 boundaries, seconded by Councilman Clauson and carried. On motion by Councilman Wilson, seconded by Councilman Grable, Council unanimously approved issuance of Fireworks Stand Permits to the following organizations: Jim Strode - Plisko Lane SE & Hwy. 160 Port Orchard Rotary - Safeway Shopping Center Parents Booster Organization - Port Orchard Armory Port Orchard Lions Club - Coast To Coast Parking Lot S.K. Little league - 1700 SE State Hwy. 160 Councilman Geiger moved to initiate proceedings to amend Port Orchard Zoning Ordinance No. 1163, Chapter 8(b) to include "Council may grant extensions of 18 months", seconded by Councilman Grable and carried. Fire Chief Snow outlined proposal to place a $250,000 special levy on the general ballot in September to provide for the expansion of Fire Station No 2 facilities and establishment of a volunteer firefighter residency program. Councilman Geiger moved to remove from table motion to deny Claim for Damages submitted by Luella Patterson, seconded by Councilman Clauson and carried. Motion passed with 5 ayes and 1 nay. Councilman Grosso voting nay. Councilman Clauson moved to remove from table contract with Kitsap County Work Release Detention Facility, seconded by Councilman Grable and carried. Councilman Clauson moved to approve contract with Kitsap County to allow the City's use of the County Work Release Detention Facility for city prisoners, and authorize Mayor Weatherill to sign document contingent upon City Attorney approval, seconded by Councilman Wilson and carried. Councilman Lloyd moved to approve Kitsap County Woodcarvers request to store a portable library cabinet at the Active Club Building, seconded by Councilman Grosso and carried. April 27, 1987 Page Four Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Grable, seconded by Councilman Clauson, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 8614-8645 in the total amount of $13,121.99. Councilman Grosso moved to close a portion of the east City Parking Lot No. 4 from Harrison Avenue to the Port Orchard Marina Waterfront Park on May 15, 1987 from 7:00 AM to 1:00 PM for a Peace Officer's Memorial Service as requested by Police Chief Mathews, seconded by Councilman Clauson and carried. Councilman Wilson moved to authorize the Mayor to sign Supplement 1 to the City/County Agreement with Washington State Department of Transportation to allow for the purchase of additional right-of-way along Tremont, seconded by Councilman Clauson and carried. Councilman Clauson moved to ask Howard Minor to represent the City of Port Orchard on the Solid Waste and Advisory Committee and report to the Council, seconded by Councilman Grable and carried. Councilman Clauson moved to declare an oscillascope, gas meter and miscellaneous old school signs as surplus and authorize the City Engineer to donate to the Sidney. Museum old school signs and dispose of the remaining items in the best interest of the City, seconded by Councilman Geiger and carried. Councilman Grosso refrained from voting due to being a member of the Sidney Museum. Meeting adjourned at 10:58 P.M. CLERK MAYOR
