08/24/1987 - Regular - MinutesPort Orchard, Washington August 24, 1987 Council of the City of Port Orchard, Washington called to regular session by Mayor Protem Grosso. Councilmembers present: Clauson, Childress, Wilson, Geiger, Grosso, Lloyd, and Grable. Also present: City Attorney McCluskey, Police Chief Mathews, City Engineer Curles, Fire Marshall Wernet,- and Deputy Clerk Thomas. Chief Mathews led the audience and Council in the Pledge of Allegiance. On motion by Councilman Geiger, seconded by Councilman Lloyd, Council approved the minutes of the August 10, 1987 meeting as distributed with the following corrections: Page four, paragraph two, line 3, deleting "auspicious" inserting "auspices"; page four, paragraph 12, line three deleting "Sidney Log Museum" inserting "Sidney Museum and Arts Association"; page four, paragraph 12, line 3, deleting "Chairman of the Board for the Sidney Log Museum", inserting "Director of Museums for Sidney Museum and Arts Association". Larry Vogeltanz, Utilities Manager for Kitsap County, gave an outline of the studies and future plans for solid waste disposal in Kitsap County. Mayor Protem Grosso reopened Public Hearing (continued from August 10, 1987) regarding proposed amendments to Port Orchard Zoning Ordinance. Mayor Protem Grosso called for public input. As no input was received Mayor Protem Grosso closed public input portion of Public Hearing. Councilman Geiger moved to make corrections to the proposed amendments to the Port Orchard Zoning Ordinance by deleting "Religious Facility" and inserting "Church" on page six, sections 3, subsection A(2)d and section 4, subsection A(2)d and page seven, section b, subsection A(2)f, seconded by Councilman Wilson and carried. Councilman Clauson moved to adopt Ordinance No. 1393, amendments to the Port Orchard Zoning Ordinance, seconded by Councilman Lloyd and carried. George Lucus, 304 Farragut, spoke against the Council's action at the August 10, 1987 meeting regarding the mandatory garbage collection system, also referring to the household that presently utilizes one small garbage can and increase in rates. Blanche Fein, Ill Perry Avenue, stated the Council was making the mandatory garbage collection system a hardship on the senior citizens and those on a fixed income. Virginia LaFevre, 147 Perry Avenue, objected to the large garbage cans as being difficult to handle. Mayor Protem Grosso instructed City Attorney to contact Don Lindgren from South Sound Sanitation and discuss with him the problems regarding the new mandatory garbage collection system and to place this matter on the agenda for the next Council meeting for further discussion. Diane Slezak, 1233 Garrison, addressed Council regarding a $75.00 waiver for a one year dog license for breeding her dog. August 24, 1987 Page two Mayor Protem Grosso referred matter to Councilman Geiger, Chairman of Animal Control committee for research on this matter. Mayor Protem Grosso called for recess and reconvened meeting at 9:55 PM. Councilman Clauson moved to approve Ordinance No. 1390 amending the budget for the year 1987 and ordering appropriation of funds and authorizing a budgetary transfer. of funds for the construction of the Public Works Building and the Wilkins Water Main, seconded by Councilman Wilson and carried. Councilman Wilson moved to approve Ordinance No. 1391 repealing ordinances relating to parking regulations and parking meters, seconded by Councilman Clauson and carried. Councilman Clauson moved to adopt Resolution No. 1464, establishing regulations related to parking, stopping or standing in certain areas of the City, seconded by Councilman Grable and carried. Councilman Geiger moved to amend motion to add to Section 5 "Bay Street from Orchard Street to Harrison Avenue on both sides. There will be two hour parking from eight A.M. to five P.M., Monday through Saturday, except Sunday and federal holidays" and "Morton Street from Rockwell Avenue going westerly to the end of Morton Street on both sides There will be four hour parking from eight A.M. to five P.M., Monday through Friday, except Saturday and Sunday and federal holidays", seconded by Councilman Clauson and carried. Original motion as amended to adopt Resolution No. 1464, establishing regulations related to parking, stopping or standing in certain areas of the City and to add to Section 5 "Bay Street from Orchard Street to Harrison Avenue on both sides. Councilman Wilson moved to approve Ordinance No. 1392 establishing policies to determine the fees in lieu of assessment for wastewater treatment facilities, seconded by Councilman Childress and carried. Councilman Clauson moved to set September 14, 1987 at 7:45 PM as date and time of Public Hearing on proposed budget for Federal Shared Revenue Funds received in excess of anticipated amounts, seconded and carried. Mayor Protem Grosso requested the removal from agenda Item No. 2 of Unfinished Business regarding preliminary slope design for 823 Bethel Avenue - Gary Kucinski and Norm Olson. On motion by Councilman Clauson, seconded by Councilman Wilson Council unanimously approved the removal from the table consideration of Item No. one - three additional drawings, $7,534.00, and Item No. four, rebidding charges of $2,000.00, until completion of KCM professional services contract to see if the Sludge Dewatering Facility can be done within the original budgeted amount. August 24, 1987 Page three On motion by Councilman Clauson, seconded by Councilman Geiger, Council unanimously approved the removal from agenda consideration of Item No. one - three additional drawings, $7,534.00, and item No. four, rebidding charges of $2,000.00, until completion of KCM professional services contract to -see if the Sludge Dewatering Facility can be done within the original budgeted amount. Vouchers audited and certified by the auditing officer (Deputy City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Clauson, Council unanimously approved payment of those vouchers as follows: Claim Warrant No. 9126-9161 in the total amount of $92,986.06. Councilman Wilson moved to allow the City crew to remove trees on City right-of-way on Sunset Lane under the direction of the City Engineer and to sell the wood, seconded by Councilman Geiger and carried. Councilman Childress moved to refer matter regarding reducing number of street lights to the fire committee for further research, seconded and carried. Councilman Wilson moved to allow the surplus of miscellaneous sports equipment from the Public Works Department and to dispose of in the best interest of the City, seconded by Councilman Grable. Motion failed with 2 aye and 6 nays. Councilmembers Clauson, Childress, Geiger, Grosso, and Grable voting nay. City Engineer reported on proposal to replace the marina curb. Five quotes were received in the office as follows: Tyee Concrete $ 5,700 RV Associates 6,462 Lee Sand & Gravel 7,250 Granquist Construction 8,150 Talakai Construction 13,446 Councilman Geiger moved to allow City Engineer to except Tyee Concrete quote in the amount of $5,700.00 for the replacement of the marina curb, seconded by Councilman Clauson and carried. Councilman Wilson moved to allow City Council to accept South Flower Road, seconded by Councilman Grable and carried. On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized the Mayor to sign amendment to Contract No. 1 for the South Flower Road construction. Councilman Wilson moved to accept Change Order for the telemetry modifications in the sewer treatment plant in the amount of $4,700.00, seconded by Councilman Clauson and carried. August 24, 1987 Page Four Councilman Geiger moved to negotiate a Change Order for Public forks Project for the removal of an oil tank, seconded by Councilman Clauson and carried.
