12/28/1987 - Regular - Minutes:lr, hard. Washington Dec.t-:aber• 28, 1987 Council of the City of Port Orchard, Washington called to re( lular session by Mayor Leslie J. Weatherill. Cnuncilmenibers present: Ciauson, Childress, Geiger, Grosso, Lloyd, and Grable. Councilman Wilson excused. Also present: City Attorney MCCluskey, Deputy Clerk Thomas, City Treasurer miller, Police Chief Mathews, City Engineer Curles, and City Clerk Hower. Councilman Grable led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Grable, Council approved the minutes of the December 14, 1987 ineeting as distributed. Dave Dein, representi►ig Olympic T.V. Cable, advised the Coijncil that in 1988 there will be a $2.00 per month rate increase for - basic television cable service. Mr. Dein answered questions from Council regarding the rate increase. John R. Naye, Orchard Trek, requested relief from penalties charged against U.L.I.D. No. I Account. Nos. 4684-002-010-0009 and 4684-002-004-0007 in the amount of $357.07. At the request of Councilman Grosso, Citv Treastrrc:r Miller reported it was discovered that in May of 1985 Orchard Trek purchased the property which has accrued late penalties on the ULID assessment. Orchard Trek has been making payments on the ULID assessment, unfortunately their payments were for an assessment on another property which they sold in May of 1925. Councilman Grosso moved to remove penalties in the amour,l of $357.07 from U.L.I.D. No. 1 Account No. 4684-002-010-0009 and 4684-002-004-0007 as requested by Orchard Trek, seconded by Councilman Clauson and carried. On motion by Councilman Geiger, seconded by Councilman Grosso Council authorized Mayor Weatherill to sign the 1988 Public Defender Services Contract with the firm of Case & dac�sun, ine P.S.. Mayor Weatherill introduced proposed Ordinance No. 1406 For Council consideration. Councilman Childress was excused from Council table due to conflict of interest. On motion by Councilman Grosso, seconded by Councilman Crable, Council approved Ordinance No. 1406 amending Port Orchard Comprehensive Plan Map to establish a designation of "Inc1i•tri3l" for W.E. Lumsden/Chuck Childress property. Courcilman Grosso moved to approve Ordinance No. t407 amt•ridiny the budget for the year 1987, ordering appropriation of fund. :,nd authorizing budgetary transfers, seconded by Councilman Grable- and carried. Council approved Ordinance No. 1408 amending City of Port; Or-ch,-,rd Zoning Ordinance No. 899; by amending the zoning map thereof, reclassifying certain property therein (Robert A. Gehring). December 28, 1987 Page Two On motion by Councilman Geiger, seconded by Councilman Grable, Council approved Ordinance No. 1409 relating to tow away zones. Councilman Grosso moved to adopt Resolution No. 1472 authorizing cancellation of Claim Fund Warrant No. 7046 and 7831 for a total of $24.92, seconded by Councilman Grable and carried. On motion by Councilman Grosso, seconded by Councilman Grable Council adopted Resolution No. 1473 with the following changes: page 7; item 34 and 35, delete Dwight Street insert DeKalb Street. John H. Dillon, 6180 SW Clifton Road, contested speed limit on Port Orchard Boulevard. Councilman Grosso stated the speed limit on the Port Orchard Boulevard is posted 30 MPH because of the condition of the roadway. Councilman Childress moved to excuse Councilman Wilson from the Council meeting, seconded by Councilman Clauson and carried. Mayor Weatherill recessed Council into executive session for 10 minutes to discuss 810 Bay Street. Meeting reconvened at 8:40 PM. On motion by Councilman Grosso, seconded by Councilman Clauson, Council moved to authorize the City Attorney to negotiate acquisition of 810 Bay Street with the amount to be ratified by the Council. On motion by Councilman Geiger, seconded by Councilman Clauson, Council ratified the Uniformed Employees Labor Agreement with Teamster Local No. 589 as presented by the Negotiating Committee (subject to City Attorney approval) noting, but not limited to the following changes: (1) 1.9% wage increase (2) revised effective date January 1, 1988-September 30, 1990. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Grable, Council unanimously approved payment of those vouchers as follows: Claim Warrant No. 09609-09649 in the total amount of $31,918.28. Councilman Grosso moved to authorize the City Engineer's attendance at an Earthquake Seminar to be held on January 11, 1988, seconded by Councilman Clauson and carried. Councilman Clauson moved to authorize the Mayor' to sign? Memorandum of understanding with Port of Bremerton regarding Maintenance of the Marina Pump Station Restroom, seconded by Councilman Grable and carried. On motion by Councilman Grosso, seconded and carried, Council set January 25, 1988 at 7:45 P.M. as date and time for Public Hearing to consider application submitted by George Buckley, A.M.B. Corporation requesting a Zone Reclassification from Residential Low to Commercial General for property located at 1800 SR160. Mayor Weatherill thanked Councilman R.G. Lloyd for his endeavors on the City Council and voiced appreciation for the time and support Mr. Lloyd has given his fellow councilmen and community. Meeting adjourned at 9:05 P.M.
