04/14/1986 - Regular - MinutesPort Orchard, Washington April 14, 1986 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Childress, Wilson, Geiger, Lloyd, Grosso and Grable. Also present: City Attorney McCloskey, Police Chief Mathews, City Engineer Curies, Fire Chief Snow, City Clerk Hower and Administrative Assistant Thomas. Councilman Geiger led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso and seconded by Councilman Clauson, Council approved the minutes of the March 24, 1986 meeting as distributed with the following correction: Page One, Paragraph 10, should read "Councilman Grosso moved to approve ...". On motion by Councilman Grosso, seconded by Councilman Geiger, Council approved Proclamation declaring April 23, 1986, "Retired Senior Citizens Day". On motion by Councilman Grosso, seconded by Councilman Geiger, Council approved Proclamation declaring the month of April, 1986 "Child Abuse Prevention". On motion by Councilman Grosso, seconded by Councilman Geiger Council approved.Proclamation for the week of April 6-12, 1986 "Earthquake Awareness Week". Councilman Grosso moved to instruct the Port Orchard Police Department to patrol the parking area at Van Zee Park Tennis Courts for a period of one month and place notes on windshields of cars, stating these parking spaces are for park users only, seconded by Councilman Wilson and carried. Mayor Weatherill opened Public Hearing scheduled for 7:45 P.M. on a petition for vacation of a portion of Maple Street submitted by Knights of Phythias. Mayor Weatherill called for public input concerning petition for vacation of a portion of Maple Street. Bill Ralph, Knights of Phythias, addressed council regarding access to the Knights of Phythias Cemetary. Councilman Geiger moved to continue Public Hearing to next Council meeting, seconded by Councilman Lloyd. Motion failed with 4 nays and 3 ayes. Councilmembers Clauson, Childress, Grosso and Wilson voting nay. Mayor Weatherill declared public input portion of Public Hearing closed. Councilman Wilson moved to deny petition for vacation of a portion of Maple Street submitted by Knights of Phythias, seconded by Councilman Childress and carried. April 14, 1986 Page Two Mayor Weatherill opened Public Hearing scheduled for 8:00 P.M. on a request for a change to the Comprehensive Plan Map as submitted by Marshall D. and Grenda Beach (Hovde Road - Residential Low to Commercial General). Mayor Weatherill called for public input concerning this request for change to the Comprehensive Plan Map. Dave Beach, owner of subject property, addressed Council requesting the change to Commercial General. Mayor Weatherill declared public input portion of Public Hearing closed. Councilman Wilson moved to approve the change to the Comprehensive Plan Map from Residential Low to Commercial General, as submitted by Marshall D. and Grenda Beach, (Hovde Road), seconded by Council- man Grosso and carried. Legal description: The West 12 rods of the North 10 acres of the East half of the Northwest quarter of the Northwest quarter of Section 11, Township 23 North, Range 1 East, W.M.; EXCEPT road; AND EXCEPT that portion thereof, if any, lying within the Southeast quarter of the Northwest quarter of the Northwest quarter of said Section 11; Kitsap County, Washington. City Clerk reported on bid opening held April 14, 1986 at 4:30 P.M. relative to Call for Bids for Retrofitting four police vehicles. One bid received as follows: Financial Consultants International, Inc. + bid bond Base Bid - $10,205.00 Optional Bid - $ 4,140.00 Councilman Grosso moved to award bid for retrofitting four police vehicles to Financial Consultants International, Inc. in the amount of $10,205.00 with optional items as Chief Mathews deems necessary not exceeding $4,140.00, seconded by Councilman Grable and carried. Mayor Weatherill called for recess and reconvened meeting at 9:00 P.M. Councilman Geiger moved to approve Ordinance No. 1342, relating to control of dogs and other animals and repealing Section 13 of Ordinance No. 682 and adding a new section to Ordinance No. 682 relating to violations and abatement, seconded by Councilman Grosso and carried. Councilman Geiger moved to approve Ordinance No. 1343, adopting the 1985 Uniform Plumbing Code and repealing Ordinances number 1316 and 1052, seconded by Councilman Grable and carried. Councilman Wilson moved to reject Claim for Damages as submitted by H.M. Stoll for Melissa N. Stoll and turn over to insurance company, seconded by Councilman Grable. Motion failed with 7 nays. April 14, 1986 Page Three Councilman Wilson moved to table Claim for Damages as submitted by H.M. Stoll until additional information can be obtained, seconded by Councilman Grosso and carried. On motion by Councilman Wilson, seconded by Councilman Clauson, Council unanimously approved issuance of Fireworks Stand Permits to the following organizations: Port Orchard Rotary - 1039 Bethel (Safeway Shopping Center) Parent Booster Organization - Port Orchard Armory (Boy Scout Troop 1251) Boy Scout Troop 523 - South Kitsap Mall Port Orchard Lions Club - Coast To Coast Parking Lot Councilman Grosso moved to allow the repair to Fire Apparatus #77 as requested by Chief Snow, seconded by Councilman Grable and carried. Mayor Weatherill adjourned Council into executive session regarding legal matters for 15 minutes. Meeting to reconvene at 9:40 P.M. Councilman Geiger moved to approve Ordinance No. 1344, authorizing a budgetary transfer of $1,000.00 from Local Improvement Guaranty Fund to the Current Expense Fund, to provide for painting portions of Bay Street Marquee, seconded by Councilman Clauson, and carried. Vouchers audited and certified by the auditing officer (City Clerk) as required by RC'W 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilman Clauson, Council unanimously approved payment of those vouchers as follows: (Claims) Warrant No. 6,946-7,052 in the total amount of $111,955.48 and March, 1986 Payroll No. 105738-105852 in the total amount of $101,733.85. Councilman Wilson moved to allow the City Attorney to settle the Jana Hodgen legal matter on the basis of negotiated settlement, seconded by Councilman Grable and carried. Councilman Wilson moved to authorize the City Attorney to accept the offer submitted by Bloomquist-Joslin to settle litigation, seconded by Councilman Grable and carried. Councilman Wilson moved to delay the decision regarding the status of the secretarial pool until the next Council meeting, seconded by Councilman Grable. Motion failed with 7 nays. Ann Gordy, member of the Secretarial Pool, spoke regarding the effect of rotation on Secretarial Pool employees. Councilman Clauson moved to create permanent clerical positions in Police Department, Fire Department, Municipal Court with one "floater" position under the jurisdiction of the City Clerk, seconded by Councilman Grable and carried. April 14, 1986 Councilman Clauson moved to authorize the Mayor to write a letter to Police and Fire Civil Service Commissions strongly recommending the testing for the permanent positions be in-house, seconded by Councilman Grable and carried. Councilman Grosso moved to approve change order adjusting pipe size for the Municipal Well, seconded by Councilman Wilson and carried. Councilman Grosso moved to close the RV dump on Mitchell road and post a sign directing citizens to the sewer treatment plant for RV dumping, seconded by Councilman Grable and carried. Councilman Grosso moved to surplus the old sludge truck, old pumps and miscellaneous motors as requested by the City Engineer and authorized disposal of these items in the best interest to the City, seconded by Councilman Clauson and carried.
