August 25, 1986
Council of the City of Port Orchard, Washington, called to
regular session by Mayor Leslie J. Weatherill. Councilmembers
present: Clauson, Wilson, Childress, Geiger, Grable and Grosso.
Councilman Lloyd excused. Also present: City Attorney
McCluskey, Fire Marshall Wernet, City Engineer Curles, City Clerk
Hower and Administrative Assistant Thomas. Police Chief Mathews
and Fire Chief Snow excused.
Councilman Childress led the audience and Council in the Pledge
of Allegiance.
On motion by Councilman Grosso, seconded by Councilman Clauson,
Council approved the minutes of the August 11, 1986 meeting as
distributed.
Councilman Grosso moved to excuse Councilman Lloyd from City
Council meeting, seconded by Councilman Clauson and carried.
Roger Jensen, President, Wilkins Distributing Company, and
Council discussed proposal to annex property into City. (Legal
description - Attachment #A) Items discussed were (1)
acceptance of proposed annexation; (2) require simultaneous
adoption of a Comprehensive Plan and establish zoning
designation; (3) require the assumption of all or any part of
existing City indebtedness by area to be annexed, and also fire
protection, police protection, deeding of artesian well to City,
and potential of hooking into City sewer system.
Councilman Geiger moved to authorize the City Attorney and City
Engineer to prepare an agreement between the City of Port Orchard
and Wilkins Distributing to deed private artesian well to City,
seconded by Councilman Wilson and carried.
Councilman Grosso moved to accept proposed Wilkins Distributing
annexation, seconded by Councilman.Clauson and carried.
Councilman Grosso moved to require adoption of Comprehensive Plan
and zoning designation for Wilkins Distributing property and
surrounding residential property, seconded by Councilman Geiger
and carried.
Councilman Grosso moved to require assumption of all or any part
of existing city indebtedness by area to be annexed, seconded by
Councilman Clauson and carried.
Mayor Weatherill informed Council he is appointing Marven F.
Parks to the Planning Commission effective September 1, 1986 to
fill vacancy created by resignation of Vern Hoskins.
Councilman Wilson moved to concur with Mayor Weatherill's
appointment of Marven F. Parks to the Planning Commission
effective September 1, 1986, seconded by Councilman Clauson and
carried.
Councilman Grosso moved to approve Ordinance No. 1358 granting a
30 year Puget Power & Light Company Franchise, seconded by
Councilman Grable and carried.

Mayor Weatherill opened Public Hearing scheduled for 8:00 p.m.,
regarding proposed revision of City of Port Orchard subdivision
ordinance establishing new rules, regulations and procedures.
City Engineer Curles gave a brief outline regarding the proposed
revisions to the subdivision ordinance.
Mayor Weatherill called for further public input. No response.
Councilman Wilson moved to have an ordinance drafted for Council
consideration regarding proposed revisions to the of City of Port
Orchard subdivision ordinance establishing new rules, regulations
and procedures, seconded by Councilman Grosso and carried.
Henry Lakey, 2498 S. Flower, addressed Council concerning the
question of the South Flower right of way and the location of the
existing gravel road. Mr. Lakey was concerned that the City was
going to trade or sell the right of way without input from the
neighborhood. The Council assured Mr. Lakey, that no such
transaction was anticipated and no such action would take place
without public notification and input.
Councilman Wilson moved to approve Ordinance No. 1358,
Prohibiting parking during certain hours on certain streets, with
noted changes of: changing public holidays to federal holidays
and adding "to parking lot" in Section 12(c), seconded by
Councilman Grosso and carried.
Councilman Wilson moved to approve Ordinance No. 1359, amending
the budget for the year 1986 and ordering appropriation of
unreserved funds to allow the purchase of a Sewer Cleaner,
seconded by Councilman Clauson and carried.
Councilman Wilson moved to approve Ordinance No. 1360,
prohibiting parking at all times on certain streets, seconded by
Councilman Clauson.
Councilman Wilson moved to amend motion to change (1) Section
1(f) to read "Bay Street from traffic signal on SR 160 (Bay/Maple
Street) to Two Hundred Fifty feet north of Guy Wetzel Street,
both sides;" and (2) change Section 1(h) to read as "...
intersection with Wharf Street, ... seconded by Councilman
Clauson and carried.
Original motion as amended to approve Ordinance No. 1360,
(prohibiting parking at all times on certain streets) with the
following changes (1) Section 1(f) to read "Bay Street from
traffic signal on SR 160 (Bay/Maple Street) to Two Hundred Fifty
Feet north of Guy Wetzel Street, both sides;" and (2) Section
1(h) to read as " intersection with Wharf Street, ...",
seconded and carried.
Councilman Grosso requested to be excused from Council action
regarding Claim for Damages submitted by Mrs. Walter Lundberg due
to conflict of interest
Councilman Wilson moved to approve Claim for Damages as submitted
by Mrs. Walter Lundberg and investigate the possibility of
obtaining grant additional funding, seconded by Councilman
Geiger. Motion failed with 1 aye and 4 nayes. Councilman Wilson
voting aye.

Councilman Clauson moved to reject Claim for Damages as submitted
by Mrs. Walter Lundberg and requested the City Attorney to write
a letter to Mrs. Lundberg explaining City's position, seconded by
Councilman Childress and carried with 4 ayes and 1 nay.
Councilman Wilson voting nay.
Mayor Weatherill called for recess and reconvened meeting at 9:00
p.m
Councilman Geiger moved to change wording on proposed Ordinance
No. 1356 , regulating parking time limits on certain city streets
and parking lots, to read "... any day except Saturday, Sunday,
and Federal Holidays .", seconded by Councilman Grosso and
carried with 4 ayes and 2 nays. Councilmembers Wilson and
Childress voting nay. (Proposed Ordinance No. 1356 to be
presented for Council consideration at future meeting.)
S.S. Linn and Paul Lio, Kramer, Chin & Mayo addressed Council
requesting an amendment to the Sludge Dewatering Facility
Professional Services Agreement, adding the following
1. 3 additional drawings $ 7,534.00
2. 5 alternatives 2,480.00
3. printing of bid documents 1,000.00
4. Rebidding charges 2,000.00
TOTALING $13,014.00
Councilman Geiger moved to allow the payment for item No. 2 - 5
alternatives, $2,480.00 and item No. 3 - printing of bid
documents, $1,000.00, seconded by Councilman Grosso , and
carried.
Councilman Geiger moved to pay only $1,000 on Kramer, Chin & Mayo
request for item No. 4 - rebidding charges, seconded by
Councilman Wilson. Motion failed with 2 ayes and 4 nayes.
Councilman Geiger and Wilson voting aye.
Councilman Clauson moved to table consideration of item No. 1 -
3 additional drawings, $7,534.00 and item No. 4 - rebidding
charges of $2,000.00 until completion of contract to see if the
Sludge Dewatering Facility can be done within the original
budgeted amount, seconded by Councilman Grosso and carried.
Councilman Grosso stepped down from Council table and addressed
Council, as boardmember of Sidney Museum and Arts Association,
regarding request for reallocation of Federal Shared Revenue from
Sidney Museum to renovation of the Sidney Art Gallery.
Councilman Geiger moved to allow the reallocation of Federal
Shared Revenue from Sidney Museum to Sidney Art Gallery for the
purpose of renovation of a portion of the Sidney Art Gallery to
store and display museum items, seconded by Councilman Clauson
and carried.
Councilman Grosso moved to approve Dave Selbig (Forest Park
Grocery) request to locate two signs on City right of way
(Tremont at Garrison) (Sidney at South Street) indicating
direction to Forest Park Grocery, seconded by Councilman Grable
and carried.

Councilman Clauson moved to amend motion to include City retain
right to remove sign at any time in future, seconded by
Councilman Grosso and carried.
Original motion as amended to approve Dave Selbig (Forest Park
Grocery) request to locate two signs on City right of way
(Tremont at Garrison) (Sidney at South Street) indicating
direction to Forest Park Grocery with the City retaining right to
remove sign at any time in future, carried unanimously.
Vouchers audited and certified by the auditing officer (City
Clerk) as required by RCW 42.24.080, and those expense
reimbursement claims certified as required by RCW 42.24.090,
have been recorded on a listing and made available to the
Council.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of those vouchers as
follows: Claims Warrant No. 7572-7612 in the total amount of
$70,956.57.
Councilman Clauson moved reject Claim for Damages as submitted by
Port Of Bremerton, relevant to Utility Local Improvement District
No. 1, seconded and carried.
Engineer Curles informed Council, Association of Washington
Cities is supporting State Department of Transportation proposal
to redesigning Sedgwick Road as SR 160
Councilman Geiger moved to communicate to Association of
Washington Cities and state DOT the City of Port Orchard is
opposed to State DOT's proposal to redesigning Sedgwick Road as
Highway 160, seconded by Councilman Clauson and carried.
