10/13/1986 - Regular - MinutesPort Orchard, Washington October 13, 1985 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Councilmembers present: Clauson, Wilson, Childress, Geiger, Grosso and Grable. Councilman Lloyd excused. Also present: City Attorney McCluskey, Fire Chief Snow, Police Chief Mathews, City Engineer Curles, City Treasurer Miller, City Clerk Hower, and Administrative Assistant Thomas. Councilman Childress led the audience and Council in the'Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Grable, Council approved the minutes of the September 22, 1986 meeting as distributed. Council addressed letter from Ben Flores requesting permission to place a sign in City right-of-way, on the corner of Pottery and Tremont. Councilman Grosso moved to approve Ben Flores request to locate a sign in City right-of-way (Pottery and Tremont), contingent upon (1) City Engineer approving sign and (2) the City retain the right to remove the sign at any time in the future, seconded Councilman Clauson and carried. Ken Grieve, HUD area manager, addressed Council regarding water department turn off procedures. Councilman Grosso moved to authorize reinstatment of water services at 2525 Stetson Lane, property owned by Federal Government (HUD), seconded by Councilman Geiger and carried. Councilman Grosso stated a complaint was received concerning police department personnel. For the record he further reported the situation has been addressed and appropriate action taken. On motion by Councilman Wilson, seconded by Councilman Grosso, Council confirmed Mayor Weatherill's Proclamation declaring the month of October, 1986 as "Crime Prevention Month", Councilman Wilson moved to authorize the Police Department to solicit donations from civic organizations for the "McGruff Crime Prevention Program", seconded by Councilman Clauson and carried. Mayor Weatherill opened Public Hearing sched�,:led for 7:45 p.m. regarding Planning Commission recommendation Fora Comprehensive Plan Designation of "Industrial" for land w;thin rroposed "Wilkins Annexation". Legal Description - Ai-tac.hient "A" Mayor Weatherill called for public input for and Ior against proposed Comprehensive Plan Designation of Industrial. No response. Councilman Clauson moved to establish a Comprehensive Plan Designation of Industrial for proposed "Wilkins Annexation" area, seconded by Councilman Wilson and carried. *10/27/86Councilman Grosso requested Pr000sais be solicited for the irrection Positions of City Attorney and Pub1ic Defender for the 1087 Budget Year. October 13, '1986 Page Two Councilman Clauson moved to accept Plannning Commission Resolution No. 72-86, as an integral part of Council action to set a Comprehensive Plan Designation of "Industrial" for proposed "Wilkins Annexation" area, seconded by Councilman Wilson and carried. Legal Description - Attachment "A". Council discussed Claim for Damage submitted by Ellen Mae White (Martinez) revelent to U.L.I.D. Assessment No. 45360060060006. Councilman Geiger moved to table Claim for Damages, submitted by Ellen Mae White (Martinez) for further investigation, seconded by Councilman Grable and carried. Tim Arnold, Manager Rockwell Condominiums, addressed Council regarding Claim for Damages which was submitted by Rockwell Condominium homeowners' Association for U.L.I.D Assessment No. 80070000000006. Councilman Grosso moved to continue Claim for Damages, as submitted by Rockwell Condominium Homeowners' Association, for further investigation, seconded by Councilman Wilson and carried. Mayor Weatherill opened Public Hearing scheduled for 6:00 p.m., regarding application for Special Use Permit submitted by Paragon, Inc. Paragon is requesting to be allou.!ed to use building at 817 Sidney as a church and office type facility. Mayor Weatherill called for public input for and/or against Paragon's Inc., application for Special Use Permit. Stan Morris, Pastor, Family Worship Center, answered questions pertaining to Special Use Permit proposal to utilize a portion of facilities at 817 Sidney as a church. Councilman Wilson moved to approve issuance of a Special Use Permit to Paragon, Inc., allowing property at at 817 Sidney to be used as a church and office type facility, seconded by Councilman Grosso and carried. LEGAL DESCRIPTION: Parcel B of Short Plat #80110050142, per records of Kitsap County, Washington. Councilman Clauson moved to amend motion to include adoption of Planning Commission Resolution No. 71-86, as an integral part of approval of Special Use Permit issued to Paragon, Inc., allowing building at 817 Sidney to be used as a church and office type facility, seconded by Councilman Grosso and carried. Council unanimously approved original motion as amended to approve the Special Use Permit to Paragon, Inc., allowing building at 817 Sidney to be utilized as a church and office type facility and adopt Planning Commission Resolution No. 7136, as an integral part of approval of Special Use Permit. Mayor Weatherill opened Public Hearing scheduled for 8:15 p.m., regarding application for Special Use Permit submitted by Lloyd Trail requesting to use his residence located at 1883 Bay Street for retail sales of miscellaneous new and used merchandise. October 13, 1986 Page Three Mayor Weatherill called for public input for and/or against request for Special Use Permit for 1883 Bay Street. Lloyd Trail, proponent spoke in favor of issuance of Special Use Permit which would allow retail sales of miscellaneous new and used merchandise at 1883 Bay Street. LEGAL DESCRIPTION: Lots 13, 14, & 15 Block 34 Annapolis, recorded in volume 1 of Plats, pages 64 & 65, as per records of Kitsap County, Washington. Councilman Grosso moved to accept proposed 1987 consolidated Animal Control Services Agreement, seconded by Councilman Grable. Councilman Clauson moved to table motion to accept proposed 1987 Consolidated Animal Services Control Agreement to allow review by City Attorney, seconded by Councilman Wilson and carried. Mayor Weatherill recessed Council into executive session for 10 minutes to discuss legal matter. Meeting to reconvene at 8:35 p.m. Councilman Grosso moved to continue Public Hearing ;continued from 9/22/86 Council meeting) regarding proposed revision to City of Port Orchard Subdivision Ordinance establishing new rules, regulations and procedures, seconded by Councilman Grable and carried. Bernice Lundberg Mayo requested to address Council on matter of Claim for Damages submitted by Mrs. Walter Lundberg at August 25, 1986 Council meeting. Councilman Grosso requested to be excused from Council action regarding Claim for Damages submitted by Mrs. Walter L..indberg due to conflict of interest. Bernice Lundberg Mayo presented additional docunments and requested further consideration on Claim for Damages Assessment No. 3624-013-014-2003. Councilman Clauson moved to table Mrs. Walter Lundberg's Claim for Damages for further research, seconded,by Councilman Grable and carried. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. October 13, 1986 Page Four On motion by Councilman Geiger, seconded by Councilman Clauson, Council unanimously approved payment of those vouchers as follows: Claims Warrant No. 7746-7847 in the total amount of $87,430.73 and September, 1986 Payroll Warrant No. 106468-106576 in the total amount of $98,628.87. Councilman Geiger moved to authorize purchase of a "Giant Size Wall Map of Kitsap County" at a cost $110.00, seconded by Councilman Grosso and carried. Councilman Wilson moved to approve Resolution No. 1429, adopting Roadway Standards, seconded by Councilman Clauson and carried. Councilman Grosso moved that a letter be written to our Senators and Congressmen, urging the Federal Shared Revenue Program be restored, emphasizing this program gave the best return to the people with the least overhead, seconded by Councilman Clauson and carried. On motion by Councilman Grosso, seconded by Councilman Clauson, Council unanimously authorized the City Engineer to draft standards for signs, including the City's right to remove any sign in the future. Councilman Grable moved to approve the proposed 1987 Budget for the Wastewater Treatment Facility, seconded by Councilman Geiger and carried. On motion by Councilman Grosso, seconded by Councilman Clauson, Council authorized the City Engineer to proceed on repair to building foundation drainage (One Stop Cleaner) at a cost of approximately $750.00. Damaged caused by Perry Avenue wall grout seepage into foundation drain. Owner of building has agreed to sign a Hold Harmless Agreement if City repairs drainage system. Councilman Wilson moved to extend contract with Entranco Engineers for the Bypass Slide Stablization to allow work to be completed in Spring of 1987, seconded by Councilman Grosso and carried.
