03/25/1985 - Regular - MinutesMarch 25, 1985 Port Orchard, Washington Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill. Council members present: Clauson, Wilson, Childress, Geiger, Miller, Grosso and Grable. Also present: Attorney McCluskey, Police Chief Mathews, City Engineer Curles, Fire Chief Snow, City Clerk Hower and Administrative Assistant Kernan. Police Chief Mathews led the audience and Council in the Pledge of Allegiance. On motion by Councilman Clauson, seconded by Councilman Grable, Council approved the minutes of the March 11, 1985 Council meeting as circulated. Councilman Wilson moved to adopt Resolution No. 1385 authorizing transmittal of Sewer Revenue Funds to Kitsap County Operational Fund providing for City's share of maintenance for the'Joint Waste- water Treatment Facility, seconded by Councilman Clauson and carried. Mayor Weatherill informed Council of resignation of Tom Wong from the Port Orchard Planning Commission. At request of the Mayor, Clerk read letter appointing Vern Hoskins to the Planning Commission to complete the unexpired term vacated by resignation of Tom Wong. Term expires on.December 31, 1988; seconded by Councilman Grable and carried. Councilman Clauson moved to reject Claim for Damages submitted by Paula Hull for damages to her minor daughter's vehicle and referred matter to insurance carrier.; seconded by Councilman Wilson and carried. Councilman Wilson moved to draft an ordinance authorizing "no parking" time limits be established on Frederick Street between Bay Street and waterfront parking area on Saturday; 8:00 AM to 1:00 PM during Farmer's Market; seconded by Councilman Grosso and carried. Paul Hedrick of Ron Kasprisin Design Groups gave presentation on Coastal Zone Managment Grant/Waterfront Walkway Project, outlining short and long-term goals for the project, emphasizing the need for cooperation between governmental entities and private property owners of area involved to make proposed project,a reality. Herb Stump, Director of Washington State Veterans Home at Retsil spoke relaying his willingness to cooperate in the proposed water- front walkway project. Mayor Weatherill opened Public Hearing on Petition for Vacation of a Portion of Perry Avenue as submitted by Perry K. Wilson. (The Easterly half of Perry Avenue lying West of Lot 1, Block 29, Annapolis). Mayor Weatherill called for public input in favor of Petition for Vacation of a portion of Perry Avenue. Perry K. Wilson, petitioner, spoke in favor of approval of request and outlined proposed condominium project for this site. Page Two March 25, 1985 Mayor Weatherill called for further input from those persons in favor of approval of Petition for Vacation of a portion of Perry Avenue. No response. Mayor Weatherill called for public input from those persons in opposition of Petition for Vacation of a.portion. of Perry Avenue. Rene Riedel, 127 Perry Avenue North, spoke against approval of Vacation citing potential hazard of increased traffic to,area. Ken Vennes, 251 Perry Avenue North, voiced opinion that area is already too congested with condominium, duplexes and apartment buildings. Mayor Weatherill called for additional public input from those in opposition of Petition for Vacation of a portion of Perry Avenue. No response. Mayor Weatherill requested Council input on matter -of Petition for Vacation of a portion of Perry Avenue. Councilman Grosso questioned size of Mr. P.K. Wilson property and side yard set back requirements. City Engineer gave.building code requirement relative to side yard set backs. Councilman Geiger questioned as to whether property described in Petition has been appraised. Mr. P.K. Wilson stated an appraisal has not been obtained as of this date. Councilman Wilson stated vacating this property would not be in the best interest of the City and moved to deny Petition for Vacation of a portion of Perry Avenue as submitted by Perry K. Wilson; seconded by Councilman Clauson and carried. (Legal description: The easterly half of Perry Avenue lying westerly of Lot 1, Block 29, Annapolis) Mayor Weatherill closed Pubic Hearing. Mayor Weatherill called recess with meeting to reconvene at 8:50 P.M. Councilman Geiger requested Street & Alley Committee review condition of alleyway located between Taylor and Smith Street as to need for repairs. Councilman Grosso moved to direct Clerk to draft an ordinance, for Council consideration, relative to reimbursement of expenses for Volunteer Firemen; seconded by Councilman Clauson and carried. Councilman Wilson moved to set date of April 8, 1985; 8:00 P.M. as date and time for Public Hearing on application for Zone Reclassi- fication as submitted by Steve Walum (Legal Description: That portion of Section 25, Township 24 North, Range 1 East, W.M. described as follows: Lots 13, 14, & 15 together with the East 10'feet of Lot 12 Block 29, Annapolis as per Plat recorded in Volume l of Plat Records of Kitsap County, Washington) Page Three March 25, 1985 Dale Renko and Paul Buettgenbach renewed request that Council amend City Tow Regulation to delete requirement that storage yards be manned during specified regular working hours. Police Committee recommended no change be made to Resolution 1244 which sets forth city towing company regulations. Paul Buettgenbach questioned possible "conflict of interest" concerning certain city employees and officials. Mayor referred matter to Police Committee for further investigation and review. James Tracy representing RV Associates, Inc. requested an easement across City property situated in the SW 4 Section 34, Township 24 North, Range 1 East, W.M. Kitsap County. Councilman Childress excused himself from Council table during matter of RV Associates request for easement across City property, due to conflict of interest. After much discussion of intended use of easement by RV Associates, Inc-. and minimal impact to surrounding area, Councilwoman Miller moved to allow RV Associates, Inc. easement across city property situated in the SW4 Section 34, Township 24 North, Range 1 East, W.M., Kitsap County, with conditions as set for in attachment A excluding second line of Condition No. 9 as indicated; seconded by Councilman Grosso and carried. Councilman Geiger moved to authorize payment of the bills in the amount of $.246,708.39 (Warrant No. 0526.4-05316); seconded by Councilman Wilson and carried. Letter from L'Kab Enterprises, Inc. dba Arrow Cab was referred to Police Committee and City Attorney for review and recommendation. Councilman Grosso moved to allow City Attorney McCiuskey to retain Attorney Jim Gruntz to represent the City of Port Orchard in the Mathew Haynes case in the event Attorney McCluskey is summoned to appear as a witness on this case; seconded by Councilwoman Miller and carried. Councilman Wilson moved to allow City Engineer to research potential for matching funds to provide financial aid to owners of South Kitsap Mall for required installation of traffic signal at entrance to Mall;. seconded by Councilman Grable and carried. Councilwoman Miller moved to authorize City Engineer to send Notice to Proceed with up to 75% funding regarding Kramer, Chin and Mayo; follow up services; seconded by Councilman Grable and carried. Councilman Glauson moved to authorize Police Chief Mathews to sign working agreement with Kitsap County Coroner's Office; seconded by Councilman Grosso and carried. Meeting adjourned at 9:55 P.M. - `"' CLER t �t "ATTACHMENT A�� 25 MARCH 1985 PORT ORCHARD CITY COUNCIL- MARCH 25, 1935 TO: Par�::s Committee FM: City Engineer RE: Easement For the Sand and Gr.avel Fit Reference is made to the letter from Norm Olson and Associates, dated 7 March 1985, which requests the City grant an easement to, RV Associates, Inc. to allow them t.o excavate sand and gravel from the Boulevard property, by the City dump. The offer was made that RV and Associates would do the following items in exchange for an easement: 1. Share in the maintenance of the access property. 2. Modify the approach of the access to Old Clifton Road to., provide better traffic visibility. 3. Eliminate the existing bank by sloping it. As per the Committee's discussions, granting an easement to this firm would be acceptable. However, in return for the easement, the following items should be provided: 1. This would not be a non-exclusive easement. Any other party, with City permission, can travel on and across the accet area. 2. RV and Associates would perform all maintenance on the access road to maintain the standards that their operatic requires. 3. Widen the access road to 22 feet. 4. Modify the approach of the access road to Old Clifton Road to provide better traffic visibility. 5. Eliminate the 60 foot vertical bang on the City's property by sloping it on from the top of the bank. 6. City property will not be logged by RV and Associates. 7. RV and Associates will mark: the property line and will not excavate City material. a. When RV and Associates excavate the sand and gravel, they will name the City as an additional insured on their insuranc and provide the City a copy of the certificate of insurance. The insurance 'will be at least $500,000 propert damage and $500,0 0 liability. 9. This easement will be for a duration of 5 years.--T--tHe t 1
