April 8, 1985
Council of the City of Port Orchard, Washington, called to regular
session of Mayor Pro-tempore Gerald Grosso. Council members
present: Clauson, Childress, Wilson, Geiger, Miller and Grable.
Also present: Attorney McCluskey, Police Chief Mathews,
City Engineer Curles, Fire Chief Snow and City Clerk Hower.
Councilwoman Miller led the audience and Council in the Pledge of
Allegiance.
On motion by Council Grable, seconded by Councilwoman Miller,
Council approved the minutes of the March 25, 1985 meeting as
circulated.
Councilwoman Miller moved to approve Addendum to Real Property
Lease Agreement between City of Port Orchard and Pony/Colt
League, Inc. seconded by Councilman Grable and carried.
Arnie Norem and Norman McLoughlin outlined State,of Washington,
Department of Community Development"State Rental Rehabilita-
tion Grant" program as a potential source of funds to aid in
renovation of the Sidney Hotel. Mr. Norem explained the
grant application must be submitted by the local governmental
entity and requested the Council authorize the application to
be.submitted. Mr. McLoughlin indicated the City's obligation
would be minimal, in name only. Kitsap County Consolidated
Housing Authority has agreed to administrate the rental subsidy
program, upon completion of renovations.
On motion by Councilwoman Miller, Seconded by Councilman
Wilson, Council approved Resolution No. 1387 authorizing the
Mayor to sign the application for State of Washington Depart-
ment of Community development "State Rental Rehabilitation
Grant" program to aid in renovation of the Sidney Hotel.
Mayor Protem Grosso opened Public Hearing relative to application
for Zone Reclassification as submitted by Ron Ross, owner of
record, requesting his' property located in the Northwest
quadrant of the intersection of Sweany Street and Sidney Avenue
be reclassified from Residential High to Commercial General
allowing construction of a two story building for a deli/rest
aurant and office complex. Legal description: Lots 6, 7 & 8,
Block 2, Sweany's Addition to Sidney as recorded in Vol. l of
Plats, Page 55, Records of Kitsap County, Washington.
Councilman Childress who was not present at Public Hearing held
March 11, 1985, listened to tape recording of that Public Hearing
on Monday, April 8, 1985; witnessed by Councilman Wilson.
Planning Commission Resolution No..52-85 recommending Council
approve Zone Reclassification as submitted by Ron Ross with a
condition of Approval that the site plan attached as "Exhibit A"
be bound to this rezone was entered into record.
Mark Triplett described proposed project in detail, addressing
storm water drainage; ingress/egress; onsite parking; and
concerns of increased traffic in area.
MarkTriplett also presented petition ("Attachment A") signed by
persons in support of locating a restaurant near the Kitsap
County Courthouse.

Mayor Protem,Grosso called for public input from those persons
in favor of reclassifying Ron Ross property from Residential
High to Commercial General.
Ron Ross, proponent, availed himself for questions regarding the
matter and stated this is a convenient spot for office space for
courthouse related business.
Mayor Protem Grosso called for input from those persons in
opposition to reclassifying Ron Ross property from Residential
High to Commercial General.
Clarence Dahlke voiced concern of Kitsap County's future need
of this property for courthouse parking facilities.
Ann Sanborn, 511 Austin, spoke representing original petitioners
(petition presented at Public Hearing held March_11, 1985) in
opposition to approval of rezone, reiterating the planned
deli -restaurant, office space is not compatible with neighborhood.
Mayor Protem Grosso called for futher public input from those
persons in favor of or those opposed to approval of request for
Zone Reclassification as submitted by Ron Ross. No further
response.
Public Input portion of Public Hearing closed.
Councilman Wilson moved to approve Zone Reclassification as
submitted by Ron Ross for property located in the Northwest
quadrant of the intersection of Sweany Street and Sidney Avenue
from Residential High to Commercial General. (Legal Description
Lots 6, 7 & 8, Block 2, Sweany's Addition to Sidney as recorded
in Vol. 1 of Plats, Page 55, Records of Kitsap County,Washington.)
Seconded by Councilman Clauson, and carried with four ayes and
two nays, (Councilman Geiger and Grable voting no.)
Mayor Protem Grosso declared Zone Reclassification approved and
Public Hearing closed.
Mayor Protem Grosso called for recess with meeting to reconvene
at 9:10 P.M.
,Mayor Protem Grosso opened Public Hearing relative.to application
for Zone Reclassification as submittedby.Steve Wallum, owner of
record requesting property located at_ 1870-1880 Bay Street be
rezoned from Residential High to Commercial General. (Legal
Description: That portion of Section 25, Township 24, North
Rangell East, W.M., described as follows: Lots 13, 14, and 15
together with the East 10 feet of Lot 12, Block 29, Annapolis
as per Plat Recorded in Vol. l of Plat Records of Kitsap County,
Washington.')
Mayor Protem Grosso recognized proponent Steve Wallum who
outlined proposed use of property as Commercial General.
Mayor Protem Grosso called for public input from those persons in
favor of requested Zone Reclassification as submitted by Steve
Wallum. No response.
Mayor Protem Grosso called for public input from those persons
opposed to Zone Reclassification as submitted by Steve Wallum.
No Response.

Mayor Protem Grosso closed public input portion of.Public
Hearing.
On motion by Councilman Clauson, seconded by Councilman Wilson,
Council unanimously approved Zone Reclassification as requested
by Steve Wallum for property located at 1870-1880 Bay Street
from Residential High to Commercial General. (Legal Description:
That portion of Section 25, Township 24, North, Rangell East,
W.M. described as follows: Lots 13, 14 & 15 together with the
East 10 feet of Lot 12, Block 29, Annapolis as per Plat Recorded
in Vol. 1 of Plat Records of Kitsap County, Washington.)
Mayor Protem Grosso declared Zone Reclassification approved and
Public Hearing closed.
Councilman Grosso presented letter from United States Postal
Service, William G. Jackson MSC Manager Postmaster, relative
to City's request that a pedestrian walkway be installed
allowing pedestrians access to Port Orchard Post -Office from
Mitchell Avenue.
On motion by Councilman Grosso, seconded by Councilman Clauson,
Council by unanimous action directed Clerk to prepare letter
for Mayor's signature clarifying City's intent relative to
suggestion that the Post Office authorities provide a public
access from Mitchell Avenue past the Post Office secure area.
Councilman Clauson moved to allow Shriner's Circus advertising
sign be located in the Bethel "Y" until June 29, 1985, seconded
by Councilman Grable and carried.
Mayor Protem Grosso presented letter from Southsound Sanitation
announcing "Clean up week" will be held April 20-28. Their
drivers will pickup extra refuse at no cost to City residents
during this week.
Councilwoman Miller moved to approve Ordinance No. 1304 amending
Ordinance No. 1085 S1; Ordinance No. 92l S2; and Ordinance No.
614 S1 (Port Orchard Municipal Code Chapter 2.12.030) allowing
for reimbursement of expenses for Volunteer Firemen, seconded
by Councilman Grable and carried unanimously.
Councilman Clauson moved to adopt Resolution No. 1386 establishing
a predetermined rate for reimbursement of expenses incurred by
Port Orchard Volunteer Firemen, seconded by Councilman Grable.
Councilman Clauson moved to amend proposed motion to approve
Resolution No. 1386 to delete phrase "sleeper duty shift
seconded by Councilman Wilson and carried.
Original motion as amended to adopt Resolution No. 1386, deleting
phrase "a sleeper duty shift", carried unanimously.
On motion by Councilwoman Miller, seconded by Councilman Wilson
Council unanimously adopted Ordinance No. 1305 amending Ordinance
No. 1161 S.1; Ordinance No. 1152 S12 (Port Orchard Municipal
Code Chapter 10.12.020), prohibiting parking during certain
hours on certain streets.

Charles Slaughter, member of Disabled Persons Committee, discussed
the need of additional disabled/handicapped parking spaces in
the downtown area suggesting certain areas which could -be utilized.
Council designated the space at the extreme easterly end of
the southern 1st row of Lot 2 in the Downtown Waterfront parking
area for handicapped disabled parking.
Councilman Childress, Chairman Police Committee reported Resolu-
tion No. 1244 has been reviewed relative to request for Council
to delete that portion which requires storage yards to be manned
during specific working hours and the Committee recommends no
change be made.
Ralph Anderson, Kitsap County, presented site plans depicting
proposed parking configuration on Taylor Street.
Councilman Clauson moved to direct Clerk to notify Taylor
Street property owners that proposed parking plans will be
discussed at the April 22, 1985 council meeting and request
public input, seconded by Councilman.Geiger and carried.
On motion by Councilman Geiger, seconded by Councilwoman Miller,
Council approved payment of the bills in the amount of $278,723.06
Warrant No. 5317-05407) and the March payroll in the amount of
$104,607.13 (Warrant No. 104302-104408).
City Engineer Curles reported on bids received in response to
Call for Bids to remove rubbish and trash from 806 Bay Street.
Bids were publicly opened and read aloud April 5, 1985 at
4:30 P.M. as follows:
1. Merit Systems $5,158.62 + Bid Bond
2. Stan Palmer Construction 3,489.00 + Bid Bond
3. Engineers estimate 5,000.00
Councilman Clauson moved to accept the bidding and award to
lower bidder, Stan Palmer Construction for $3,489.00, seconded
by Councilman Grable.
City Attorney McCluskey recommended property owners be notified
of pending City action prior to letting of bid contract.
Councilman Wilson moved to amend motion to authorize acceptance
of the bidding with awarding of bid contract to be contingent
upon property owners being notified of City's impending action
thus giving them the opportunity to remove debris and rubbish
as required, seconded by Councilman Clauson and carried.
Original motion as amended carried.
On motion by Councilwoman Miller, seconded by Councilman Clauson,
Council authorized the Mayor to accept proposal from State of
Washington Department of Transportation to purchase City property
lying in the planned Tremont/SR16 interchange for the consider-
ation of Thirty Eight Thousand, Four Hundred and Sixty Dollars
and no cents ($38,460.00).
