09/09/1985 - Regular - Minutesr September 9, 1985 Port Orchard, Washington Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Council - members present: Clauson, Childress, Wilson, Geiger, Miller, Grosso and Grable. Also present: Attorney Haberly, Police Chief Mathews, City Engineer Curles, Fire Chief Snow,. City Clerk Hower and Administrative Assistant Thomas. Police Chief Mathews led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Geiger, Council approved the minutes of the August 26, 1985 meeting as circulated. John Kleinback representing Port Orchard Library Board gave a brief progress report on increased circulation and services provided through the local library. An invitation to the Port Orchard Library's first anniversary celebration, September 24, 1985; 2:30 P.M. was extended to all Councilmembers and citizens. Mr. Kleinback also thanked the Mayor, Councilmembers and city staff for making the new library facility a reality. Councilwoman Miller moved to have ordinance drafted for Council approval which would amend Port Orchard Municipal Code Chapter 7.12.100 (Dog licenses -Ownership restrictions) to allow the Council to waive restriction of number of animals in a dwelling unit, on an individual case basis, seconded by Council- man Clauson and carried. Mayor Weatherill reported on meeting held with Kitsap County Commissioner Bill Mahan to review citizen concerns relative to construction of parking at County Courthouse Parking Lot on Division Street. Councilman Grosso moved to reaffirm approval of Ordinance No. 1310 which amended Zoning Ordinance No. 1163 reclassifying property known as Cedar Canyon Estates Division 2 and 3 (Frank Christen) with conditions of approval as set forth at Public Hearings held June 10, 1985 and July 22, 1985, seconded by Councilwoman Miller and carried with six ayes and no nays. (Councilman Childress removed h•imsel.f from Council table due to conflict in interest.) Councilman Grable moved to adopt Ordinance No. 1319 establishing procedures for the regulation and control of use of water during an emergency and establishing penalties for violation of such regulations and controls, seconded by Councilman Geiger. Councilman Wilson moved to amend motion to state that the Mayor be designated as the City Official.to declare an emergency, seconded by Councilman Clauson and carried. Mayor Weatherill commented that many citizens in the City of Port Orchard do follow directions from City Government, however there are some that will not and the City should take this opportunity to see that the citizens who are doing their very best are "backed -up by the City and yes, the City will go after the abuser if necessary." Councilman Grosso voting nay. Councilman Wilson moved to approve Resolution No. 1406 authorizing a segregation of U.L.I.D. No. 1 properties in accordance with Section 35.44.410 RCW (State of Washington DOT/George Tweeter), seconded by Councilman Grosso and carried. Councilman Clauson moved to approve Resolution No. 1407 authorizing a segregation of U.L.I.D. No. 1 properties in accordance with Section 35.44.410 RCW (State of Washington DOT/George Tweeter), seconded by Councilman Grable and carried. Councilman Geiger requested the City Engineer investigate availability of surplus waterfront floats. Councilman Grabie moved to adopt Ordinance No. 1320 establishing charges for inmates who are incarcerated in certain cells of the Kitsap County Correctional Facility and providing for credits in certain circumstances and providing criminal penalties for providing false information in applications for jail fee credit, seconded by Councilman Grosso and carried. Councilman Clauson moved to authorize the Mayor to sign a contract with the County Commissioners to provide two beds in the County Jail for use by City of Port Orchard prisoners at a cost of $30.00 per day, seconded by Councilman Grosso and carried. Councilwoman Miller moved to authorize Councilman Grosso to attend the National Preservation Council with a registration fee of $125.00, plus transportation costs, seconded by Council- man Geiger and carried. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimburse- ment claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, Seconded by Councilwoman Miller, Council unanimously approved payment of those vouchers as follows: (Claims) Warrant Nos. 5994-6074, in the total amount of $231,809.71 and August Payroll Nos. 104895-105008 in the amount of $93,980.08. Mayor Weatherill adjourned Council into executive session for 10 minutes to discuss a legal matter. Councilman Geiger reported on the meeting between Sewer District No. 5, Kramer, Chin and Mayo and City Sewer Advisory Committee. Discussed at the meeting was the installation of another aeration system for the Treatment Facility. September 9, 1985 Page Three Councilman Wilson moved to have the City Attorney prepare Ordinance designating east side of Sidney Avenue between 719 Sidney and Ada Street as a Loading Zone, seconded by Councilman Clauson and carried. Councilman Grosso moved to approve Councilman Clauson's request to be excused from September 23, 1985 meeting, seconded by Councilman Grable and carried. Councilman Grosso moved to approve Councilman Wilson's request to be excused from October 14, 1985 Council meeting, seconded by Councilman Clauson.and carried. Councilman Grosso moved to authorize the Mayor to sign agree- ment creating the Kitsap County Regional Sludge Board, contingent upon the City Attorney's approval of agreement, seconded by Councilwoman Miller and carried.
