09/23/1985 - Regular - MinutesW September 23, 1985 Port Orchard, Washington Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill. Council - members present Wilson, Geiger, Miller, Grosso and Grable. Councilmembers Childress and Clauson excused. Also present: Attorney Sells, Police Chief Mathews, City Engineer Curles, Fire Chief Snow, City Clerk Hower and Administrative Assistant Thomas. Councilman Geiger led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso and seconded by Councilman Grable, Council approved the minutes of tKe September 9, 1985 meeting as circulated. Elizabeth Jackson, 614 Dwight, addressed the Council regarding Kitsap County Division Street parking area. Nelson Eddy, 627 DeKalb, requested permission of the Council to top trees on City property.adjacent to his property. Councilman Grosso moved to allow Mr. Eddy hire a professional service to top the trees and provide adequate insurance coverage with City as named insured, contingent upon City Attorney's approval, seconded by Councilman Wilson and carried. Todd Skinner, director of Fathoms 0' Fun, presented a petition for an appropriation from Community Events Funds in the 1986 Budget to be used for the purpose of building and operating the 1986 Fathoms 0' Fun community float and promoting the Port Orchard area. Mayor Weatherill opened Public Hearing scheduled for 7:45 P.M. regarding proposed amendment to Ordinance No. 1163 which would allow day care facilities in Commercial zoned areas. Mayor Weatherill called for public input. No response from the public received. Councilman Grosso moved to approve Ordinance No. 1323 amending Ordinance No. 1163 providing for day care facilities in Commercial zoned areas, seconded by Councilwoman Miller and carried. Councilman Grosso moved to approve two (2) reserved parking spaces on Division Street in front of Kitsap County Public Works Department. Motion failed with 5 nays. Mayor Weatherill called for recess, and Councilman Grosso invited Councilmembers and audience to view the new fire apparatus which was parked in front of City Hall. Councilman Geiger moved to approve Resolution No. 1408 authorizing a budgetary transfer within Federal Shared Revenue Fund, from telephone system (199-594.28.64) to new fire truck (199-594.22.64), seconded by Councilman Grable and carried. September 23, 1985 Page Two City Cleric Hower reported on bid opening held September 19, 1985 at 4:30 P.M. relative to Call for Bid for DeKalb Pier Extension project as follows: Treenail Construction $16,983.00 } bid bond Thompson Pile Driving Co. 18,600.00 + bid bond Sea & Shore Pile Driving Co. 24,361.00 + bid bond Engineer's Estimate 13,200.00 Councilwoman Miller moved to accept bids as received and award bid to Treenail Construction in the amount of $16,983.00 with City Engineer's approval of bid as to conformance to specifications, seconded by Councilman Grosso. .. Councilman Geiger moved to amend motion to fund amount in excess of budget appropriation by a transfer from the telephone fund, (199-594.28.64), seconded by Councilman Grosso and carried. Council unanimously approved original motion as amended to accept bids as received and award bid to Treenail Construction in the amount of $16,983.00 with City Engineer's approval of bid as to conformance and specifications and to fund'the excess amount by a transfer from the telephone system fund (199-594.28.64). Councilman Grosso moved to approve Ordinance No. 1321 fixing the amount of Ad Valorem taxes to be raised for the year of 1986, seconded by Councilwoman Miller and carried. Councilwoman Miller moved to approve Ordinance No. 1322 amending Ordinance No. 1059 Section 1, to establish a procedure to allow exceptions to ownership restrictions for dogs and cats, seconded by Councilman Grosso and carried. Councilman Wilson moved to approve Resolution No.. 1409 declaring that adding the capacity to process sludge is a modification of the Wastewater Treatment and discharge facilities, plans and specifications which does not substantially alter the purpose of the sewerage general plan, seconded by Councilman Grosso and carried. Councilman Wilson moved to approve proposed addendum to Refuse Collection and Disposal Contract authorizing Southsound Sanitation to increase rates 3.529% to distribute refuse collection excise tax imposed by state legislature with the request South - sound Sanitation notify customers this is a tax and not an increase in their rates, seconded by Councilman Grosso and carried. Councilman Grosso moved to authorize the Mayor to sign addendum to Southsound Sanitation Contract, seconded by Councilman Wilson and carried. Councilman Filson moved to authorize the closure of Frederick Street from Bay Street north to waterfront parking lot on Sunday, October 6, 1985, noon to 5:00 P.M., as requested by Jordan Cohen to celebrate Jordan's Department Stords 76th Anniversary, seconded by Councilman Grosso and carried. K September 23, 1985 Page Three Date of Public Hearing regarding application for change to Comprehensive Plan Map Designation and a Zone Reclassification, for property located in the Southwest quadrant of Sedgewick/SR 16 interchange as requested by Howard Roland and Robert Roland, scheduled for October 14, 1985 at 7:45 P.M. On motion by Councilman Grosso, seconded by Councilman Wilson City Council set October 28, 1985 at 7:45 P.M. as date of Public Nearing on appeal (filed by William F. Havens, representing SKRAM), to Planning Commission's recommendation to the City Council on a proposed change in the Comprehensive Plan Map, as requested by Errol Dow, et al. Vouchers audited and certified by the auditing officer (City Clerk) as required by RCW 42.24.080, and those expense reimburse- ment claims certified as required by RCW 42.24.090, have been recorded on a listing and made available to the Council. On motion by Councilman Geiger, seconded by Councilwoman Miller, Council unanimously approved payment of those vouchers as follows: (claims) Warrant No. 6075--6116 in the total amount of $137,773.26. Councilman Wilson moved to put the City's plans for a public restroom at sewage pump station site "on hold" until the Port of Bremerton completes their plans for marina public restrooms. Motion died for lack of second. Councilman Grosso moved to authorize acceptance and payment of the new Lance Pierce fire apparatus upon completion of funding package with Kitsap County Bank, seconded by Councilman Grable and carried. Councilman Grosso moved to authorize the Fire Chief to purchase a new part for truck #77 at a cost of approximately $500.00, seconded by Councilwoman Miller and carried. Councilman Wilson moved to approve the Port Orchard Police Department's request to purchase a used motorcycle from the City of Tukwila, contingent upon inspection by Chief Mathews, seconded by Councilman Grable and carried. Councilman Grosso moved to approve the Port Orchard Police Department's request to purchase a used Motorola radio for the motorcycle, from the City of Tukwila, contingent upon inspection by Chief Mathews, seconded by Councilman Grable and carried. Councilman Wilson moved to authorize Chief Mathews, Fire Chief Snow and City Attorney to pursue an ordinance on Fire Lane Control, seconded by Councilman Grable and carried. Councilman Grable authorized Chief Mathews and City Attorney to revise the "bad check" ordinance, seconded by Councilman Grosso and carried. Councilman Wilson authorized the Mayor to sign Change Order No. 11, Schedule C for the Wastewater Treatment Facility in the amount of $57,091.00, seconded by Councilman Grosso and carried. W W September 23, 1985 Page Four Councilman Geiger moved to hold Public Hearing regarding Community Development Block Grant for rehabilitating homes on Arnold Street, October 28, 1985 at 9:00 P.M.,, seconded by Councilman Wilson and carried. Councilman Geiger moved to authorize City Engineer to obtain informal appraisal of Kendall Street water tank property, seconded by Councilwoman Miller and carried.
