October 22, 1984
Council of the City of Port Orchard, Washington, called to regular session
by Mayor Leslie J. Weatherill. Council members present.: Clauson, Wilson,
Geioer, Miller, Grosso and Grable. Councilman Childress was excused.
Also present: Attorney McCluskey, Police Chief Mathews, City Engineer
Curles, Fire Chief Snow, City Clerk Hower and City Administrative Assistant
Kernan.
Councilman Clauson led the audience and the Council in the Pledge of
Allegiance.
On motion by Councilman Clauson, seconded by Councilman Wilson, Council
unanimously approved the minutes of October 8, 1984 meeting as circulated.
Mayor Weatherill requested Mr. Dean Robinson, Principal of Givens Elementary
School give report on South Kitsap School District Facility Review Committee
and Advisory Council Progress Committee regarding Givens Elementary School.
Mr. Robinson gave extensive background on the condition of the only elementary
school in Port Orchard and concluded his report with the Citizens Committee's
recommendation to replace existing facility with a new structure.
City Clerk read letter from Police Chief Mathews informing David Loflin of
his appointment to the position of Police Sergeant for the Port Orchard
Police Department.
Mayor Weatherill called Officer Loflin forward and directed City Clerk to
administer the Oath of Police Sergeant to Sergeant Loflin. Following the
Oath, there were congradulations and hand shakes from the Council and
City Department heads.
At 7:45 p.m., City Clerk opened and read aloud bids received in response
to call for bids regarding Sidney Avenue Watermain. There were 6 bids as
follows:

Councilman Wilson moved to refer
bids received in response

At 8:00 p.m. Mayor Weatherill in
the Appearness of Fairness,
relinquished the
chair to Mayor Protem Grosso for
continuation of tabled
Public Hearing
relative to application for Special Use Permit submitted
by David Card
requesting to be allowed to construct a mini-storage/warehouse
facility south
of and adjacent to 1661 Sidney.
Mayor Protem Grosso requested City Attorney's advise on definition of "mini -
storage facilities". City Attorney McCluskey informed Council case law
indicates mini -storage facilities are defined within scope of warehouse
facilities (place to store goods) and this use is covered by City Industrial
and Commercial General Zoning regulations, therefore, this would be an
inappropriate use within Residential Low zoning.
Mayor Protem Grosso called for public input in favor of, against and comments
on matter of request for Special Use Permit; no response.

Councilman Clauson moved to deny application for Special Use Permit submitted
by David Card requesting to be allowed to construct mini-storage/warehouse
facility south of and adjacent to 1661 Sidney, seconded by Councilwoman Miller
and carried.
On motion by Councilman Wilson, seconded by Councilman Grable, Council
unanimously agreed to deviate from standard practices and refund filing fees
paid by David Card for Special Use Permit application.
At 8:20 p.m. Mayor Protem Grosso declared recess until 8:30 p.m.
At 8:30 p.m. Mayor Leslie J. Weatherill brought the meeting back to order.
Mayor Weatherill brought up the letter from L. William Rill in regards to their
interest in purchasing the City -owned old library bldg - 736 Prospect St.
Councilman Geiger moved, Councilman Wilson seconded, to have Mr. Rill meet
with the City Parks, Playground, Planning, Public Building and Properties
Committee for discussion. After discussion, motion unanimously carried.
Councilman Grosso reminded the Council that other parties were interested in
purchasing City -owned property located at 736 Prospect for museum purposes.
Betty Pilling, a member of the local National Business and Professional Women's
Organization, shared information about the organization and also reminded the
Council that this is National Business and Professional Women's Week.
On motion by Councilwoman Miller, seconded by Councilman Grosso, Council
unanimously approved Ordinance No. 1292 amending Ordinances No. 1242 Sl
and 1125 S2 (Chapter 9.02 - General Provisions - Criminal Code) and adding
a new chapter under Title 9 entitled Domestic Violence Protection.
Councilman Grosso moved to table proposed Ordinance No. 1293 which would amend
Port Orchard Municipal Code Section 7.08.020 Impounding Authority - Duties,
Official Animal Shelter, seconded by Councilman Wilson and carried.
Councilman Grosso moved to approve Resolution No. 1366, authorizing segregation
of properties with ULID #1 in accordance with Section 35.44.410 Revised Code
of Washington (Holly Terrace), seconded by Councilwoman Miller and carried.
Mayor Weatherill addressed letter from Marven Parks, CSM, Armor, WashARNG
requesting that court assigned community service personnel be authorized to
assist in the maintenance and upkeep of the Port Orchard National Guard Armory.
Attorney McCluskey advised that community service personnel be utilized
exclusively on City property under the supervision of City personnel due to
the City's liability for these persons.
On motion by Councilman Wilson, seconded by Councilwoman Miller, Council
unanimously denied request submitted by Marven Parks to utilize court
assigned community service personnel at the Port Orchard National Guard
Armory.
Councilman Grosso moved to change the date of'the next regular Council meeting
(which falls on a legal holiday) to Tuesday, November 13, 1984 at 7:30 p.m.,
seconded by Councilman Geiger and carried.
At 8:56 p.m. Mayor Weatherill recessed the meeting to Executive Session to
discuss a legal matter. He requested Judge Dolan and Police Chief Mathews to
accompany the Council.
At 9:34 p.m. Mayor Weatherill called the meeting back to regular session.
Councilman Wilson moved, Councilwoman Miller seconded, to refer the claim for
damages submitted by Patricia S. Cameron to the City's insurance carrier..
Motion carried unanimously.'

Councilman Geiger moved to instruct Clerk to prepare, for the Council's
approval, an ordinance which will amend Ordinance No. 1250 changing effective
date of increase in sewer rates from January 1, 1985 to March 1, 1985,
seconded by Councilman Clauson and carried.
Councilman Wilson moved to reconsider Council action of 2/13/84 establishing
an allocation of $4,000.00 for the library furniture. Motion died for lack
of second.
At the request of City Engineer Curles, Councilman Clauson moved to allow the
Mayor to accept the Department of Ecology Coastal Zone Management Grant to
further develop the City's waterfront; seconded by Councilwoman Miller
and carried.
On motion by Councilwoman Miller, seconded by Councilman Grable, Council
authorized the Mayor to implement the CERB loan for the Port Orchard Bypass
as the funds are required.
At the request of Chief of Police Mathews, Councilwoman Miller moved to
declare surplus Police Department Copier supplies (Nashua) and authorized
disposal in the best interest of the City, seconded by Councilman Grosso
and carried.
Councilman Geiger moved to authorize payment of the bills in the amount of
$749,059.19 (Warrant No. 4,452 - 4,504). Councilman Clauson seconded and the
Council carried unanimously.
At 10:16 p.m. meeting was adjourned.
