CALL TO ORDER Former Council member Jack Grable Jed the audience and Council in the Pledge of Allegiance. On motion by Councilmember Clauson, seconded by Councilmember Wyatt, Council excused Council member Powers from this council meeting. PRESENTATIONS Mayor Abel presented the 2003 Holiday Lights Good Neighbor Awards for outstanding holiday decorations for the commercial and residential categories. These awards recognize the dedication of individuals and businesses that have exhibited vibrant holiday spirit. Stephen and Corrine Harris were the winners for the residential 2003 Holiday Good Neighbor Award and accepted their award from Mayor Abel, for their home located 945 Eaglecrest Place. Mayor Abel also presented the commercial category for the 2003 Holiday Good Neighbor Award to representatives of the Port Orchard Care Center located at 2031 Pottery Avenue. Mayor Abel also acknowledged the new Holiday Spirit Neighborhood Award for the residents located at 700 Pottery Avenue. APPROVAL OF AGENDA On motion by Councilmember Dilenno, seconded by Councilmember Clauson, Council removed from Consent Agenda item 6A., approval of the December 22, 2003 January 12, 2004 Page 2 of 5 and December 29, 2003, City Council minutes. Councilmember Dilenno was not a Councilmember at this time, therefore cannot cast a vote for this item. On motion by Councilman Clauson, seconded by Councilman Wyatt, Council approved the Agenda as revised. AUDIENCE COMMENTS Mayor Abel asked for audience comments for items not listed on this agenda. No audience comments were received at this time. REPORTS OF VISmNG OFFICIALS Kitsap County Commissioner, Patty Lent, welcomed newly elected Mayor Kim Abel and Councilmember Rita Dilenno to their newly appointed positions. Commissioner Lent assured Council the Kitsap County Commissioners are planning to work closely with the City of Port Orchard in all aspects of County-City government issues. CONSENT AGENDA On motion by Councilmember Clauson, seconded by Councilmember Geiger, Council approved the Consent Agenda as follows: B. Approval of Claim Warrants #40436-40549 in the amount of $296,321.69 and December 2003 Payroll Warrants #137879-137944 and Direct Deposits in the Amount of $318,143.81. C. Ordinance No. 1925 Regarding the 2003 Appropriation of Funds D. Resolution No. 2051 Regarding Bank Agreements E. Award Contract for Water System Leak Detection BUSINESS ITEMS On motion by Councilmember Clauson, seconded by Councilmember Geiger, Council approved the December 22, 2003 and December 29, 2003 City Council minutes. Motion passed with 5 ayes. Councilmember Dilenno abstained from voting. Discussion of Kitsap Countvwide Planning Policies-Resolution No. 2048 On motion by Councilmember Wyatt, seconded by Councilmember Cramer, Council moved to reconsider the vote on Resolution No. 2048 ratifying the revisions to the Kitsap Countywide Planning Policies. Councilmember Wyatt moved to amend Resolution No. 2048 by ratifying only Element B of the Countywide Planning Policies, seconded by Councilman Cramer. Motion passed with 4 affirmative votes and 2 dissenting votes. Councilmember's Clauson and Geiger casting the 2 dissenting votes. Commissioner Lent advised that the Puget Sound Regional Council has not taken any formal action recognizing the ratification of these planning policies, and that these planning policies have been in effect and under discussion for several years. January 12, 2004 Page 3 of 5 Mary McClure, KRCC Director, reaffirmed Commissioner Lent's comments regarding the planning policies being in effect and under discussion. Ms. McClure commented further, at this time, it is not known what will happen if the Countywide Planning Policies are not ratified and presented to Puget Sound Regional Council for final adoption. On motion by Councilmember Clauson, seconded by Councilmember Geiger, Council tabled Resolution No. 2048 ratifying only Element B of the Countywide Planning Policies, until the next Council meeting, to allow the Growth Management Committee time to review the revisions and bring this matter back to Council with recommendations. Motion passed with 4 assenting votes and 2 dissenting votes. Council members Clauson and Geiger cast the 2 dissenting votes. Appointment of Mayor Protem On motion by Councilmember Clauson, seconded by Councilmember Cramer, Council appointed Councilmember Wyatt as Mayor Protem for 2004. Proposed Ordinance No. 1928 Regarding Residential Parking Permits Councilmember Clauson moved to approve Ordinance No. 1928 amending Port Orchard Municipal Code Sections 10.14.020, 10.14.030, 10.13.040 and 10.13.070 regarding Residential Parking Permits, seconded by Councilmember Wyatt. Councilmember Dilenno amended motion to strike "recreational vehicles" from Section 3, subsection 10.14.040(1) to read as follows: Guest parking permits shall not be issued for commercial vehicles, boats, or trailers. ,eF FeeFeatienal 'J<ehieles •• seconded by Councilmember Rider. Councilmember Dilenno, seconded by Councilmember Rider, further amended motion as follows: •!• To include wording in Section 4, subsection 10.14.070(2) to read as follows: To revoke the permit, the City Clerk shall send by first class mail a notice to the permit holder stating that the permit has been revoked and the reason or reasons why the permit is revoked, along with the aopeal process as outlined in subsection (3 J below. •!• To change the wording in Section 3, subsection 10.14.040(2) to read as follows: No vehicle can be issued more than ene two temporary parking passes in a seven consecutive day period, and not more than twiee four times in a 30-day period. Appointment of Citizen's Advisory Group. Downtown Economic Redevelopment Study Councilmember Clauson moved to approve the selection of citizens for the Citizen's Advisory Group, as recommended by the Council Economic Development Committee, seconded by Councilmember Wyatt. Councilmember Diienno moved to further amend the motion to include all 22 interested business and property owners, a representative from the Chamber of Commerce and a representative from the Port of Bremerton. Councilmember Clauson seconded motion. Motion tied with 3 assenting votes and 3 dissenting votes. Mayor Abel broke the tie vote by voting affirmative. Councilmembers Clauson, Wyatt and Geiger cast the dissenting vote. Councilmembers Diienno, Cramer and Rider cast the assenting vote. Councilmember Diienno moved to further amend motion to add from the interested citizens list two citizens, with the other four citizens to be chosen by lot. Council moved to approve the selection of citizens for the Citizen's Advisory Group, as recommended by the Council Economic Development Committee, with the following amendments: •!• Adding a representative from the Port of Bremerton •!• Adding a representative from the Port Orchard Chamber of Commerce •!• Include all 22 interested business owners and property owners •!• Add two interested citizens •:• Select by lot four additional citizens from the group of interested citizens At 9:25p.m., Mayor Abel called for a 5-minute recess, with the meeting reconvening at 9:30p.m. Award Contract for Stormwater Pond Maintenance On motion by Councilmember Clauson, seconded by Councilmember Wyatt, Council authorized the City Engineer to accept the cost proposal from Darrel Emel's Tree Service in the amount of $3,825 plus tax, to maintain the stormwater ponds at the Eaglecrest Subdivision and to remove the elm tree at the intersection of Seattle Avenue and Prospect Street. Award Contract for Sewer Main Lining January 12, 2004 Page 5 of 5 On motion by Councilmember Clauson, seconded by Councilmember Rider, Council awarded the contract to C-More Pipe Services for a cost of $35,664, plus tax to install epoxy liners in two sanitary sewer mains located on Sroufe Street and Dwight Street. Award Contract for Frederick Avenue Sidewalk Replacement On motion by Councilmember Clauson, seconded by Councilmember Diienno, Council awarded the Frederick Avenue Sidewalk Replacement Contract to On Ross Contractors for a total contract cost of $4,788 plus tax. COUNCIL/MAYOR & STAFF REPORTS Mayor Abel commented on the many e-mails City Hall has received regarding City Hall's Holiday Lights. Mayor Abel further commented and congratulated the Public Works Department for keeping the streets cleared during the last snowstorm. City Engineer Curies reported on the Rotary Park Project along Blackjack Creek, which will require a Substantial Development Permit or Shoreline Permit. On motion by Councilmember Rider, seconded by Councilmember Geiger, Council authorized the City Engineer to proceed with the permit process for the Rotary Park Project along Blackjack Creek.
