10/08/1984 - Regular - MinutesPort Orchard, Washington .October 8, 1984 Council of the City of Port Orchard, Washington, called.to regular. session by Mayor Leslie J. Weatherill. Council members present:. Clauson, Childress, Wilson, Geiger, Miller, Grosso and Grable. Also present: Attorney McCluskey, Police Chief Mathews, City Engineer Curles, Fire Chief Snow and City Clerk Hower. Councilman Clauson led the audience and 'Counc'i'l 'in '.the 'PI edge of Allegiance. On motion by Councilman Grosso, seconded and carried, Council approved the minutes of the September 24, 1984 meeting as circulated. Sherry Barnhart, Executive Director of Awareness Express requested 1985 budget support from the City of Port Orchard in the amount of $10,000.00 and reviewed benefits provided by this program. Councilman Miller moved to approve Ordinance No. 1291 amending the use and area maps of Ordinance No. 1163 reclassifying certain property located at 2475 Bethel from Residential Low to Commercial General (Leslie & Debra Harper, owners of record), seconded by Councilman Wilson and carried unanimously. Mayor Weatherill addressed item on agenda relative to Adrian Carr's request for authorization to continue land fill at property located on Austin Street. after much discussion, Councilman Wilson moved to endorse and affirm city policy that all land fill projects must be approved by the City Engineer and considered on a case by case basis, seconded by Councilman Grosso and carried unanimously. Councilman Wilson requested Council Executive Session to discuss potential legal matter relative to Williams Road (South Street) matter. Mayor Weatherill recessed Council to Executive Session. Council meeting reconvene at 8:00 P.M. At 8:00 P.M. Clerk opened and read aloud bids received in response to call for bids to construct DeKalb Street Pier & Boardwalk. Seven bids call for bids to construct DeKalb Street Pier & .. Boardwalk.. Seven bids were opened and read as follows, each accompanied with required bid bond/check. Bid Price Bid + Alternative 1. American Construction 33,670.00 47,520.00 Engineer's Estimate 20,550.00 31,850.00 On motion by Councilman Wilson, Council moved to refer all bids received relative to construction of DeKalb Street Pier & Boardwalk to City Engineer for evaluation, seconded by Councilman Grosso and carried. Councilman Wilson moved to direct City Engineer to construct the westerly portion of South Street to city standards; establish a turn -around and in the future maintain on same schedule as other city streets and also not sign proposed "road agreement" which was submitted by Dorothy Willims and Edward and Betty Pearson, Seconded by Councilman Grosso. October 8, Page 2 1984 Councilman Wilson moved to authorize City Engineer to restore westerly portion of South Street, in his best judgement, seconded by Councilman Geiger and carried. Original motion as amended carried unanimously. Mayor Weatherill addressed letter from H. Brent Anderson which requests assessment be combined with another assessment within ULID #1 to remove assessment amount from one account, thus, clearing that property title. Council referred request to City Attorney for investigation. At 8:15 Mayor Weatherill announced it was time for Public Hearing relative to application for.Special Use Permit submitted by David A. Card which would allow a mini-storage/warehouse to be located South of and adjacent to 1661 Sidney and that prior to opening Public Hearing he was relinquinshing the chair to Mayor Protem and stepping down due to the close proximity of his property of this project, in the appearness of fairness. Mayor Protem Grosso opened Public Hearing and called for input from those in support of this Special Use.Permit application. David A. Card proponent outlined proposed project, explaininq type of storage would only be residential not commercial and requested Council consider this as a residential storage facility only and not a warehouse facility. Leonard Minor urged Council approval of this Special Use Permit, based on the need in large residential neighborhoods for mini - storage facilities` Mr. Minor also stated this facility would not be readily visible from the street and need not be unsightly. No further input in support of project. City Attorney McCluskey advised Council'that'if they determine" a mini -storage facility is not a warehouse and desire to permit a facility of this nature in a residential zoned area, there needs to be an amendment to the Zoning Ordinance to provide for "Mini -Storage. Mayor Protem called for input from those in opposition to request for Special Use Permit. Councilman Geiger stated warehouse facilities are addressed in the zoning ordinance under commercial zoning to protect neighbor- hoods from abnormally large building which could deter from the aesthetic:value of residential -neighborhoods. Councilman Wilson moved to table Public Hearing until next council meeting to allow further investigation into definition of Mini -Storage facility seconded by Councilman Childress and carried. Councilman Grosso moved to set time to reconvene Public Hearing (David A. Card, Special Use Permit) at next Council meeting at 8:00 P.M., seconded by Councilman Wilson and carried. Mayor Protem Grosso turned meeting back to Mayor Weatherill. Councilman Miller moved to authorize Mayor Weatherill to sign Interagency Agreement between Department of Natural Resources and the City of Port Orchard to allow the City to build a pier at no cost to the DNR, seconded by Councilman Grosso and carried. October 8,. 1984 P49e, ..3: On motion by Councilman Wilson seconded by Councilman Clauson, Council authorized unanimously Mayor Weatherill to sign,.with City Attorney's approval, documents relative to the City to participating in regional study conducted by CN2M Hill on Sludge Management.. On motion by Councilman Grosso, seconded by Councilman Miller, Council unanimously moved to reject all bids received in response to call for bids to construct "DeKalb Street,Pier and Boardwalk." On request of Councilman Clauson, Mayor Weatherill called for recess with meeting to reconvene at 9:.00.P,M. Councilman Geiger moved to authorize payment of the bills in the amount of $397,873.45 (Warrant No. 04366-04451) and the September payroll in the amount of $91,751.88 (Warrant No. 103623-103725), seconded by Councilman Clauson and carried.
